The following definitions apply to this chapter:
(1) 
"Appointive officer"
means public officials appointed by the city council and includes the city administrator, municipal judge, city administrator or designee, and department heads.
(2) 
"City employee"
means all other city staff that are not appointive officers.

The city administrator shall be the principal management position as the appointed administrative officer, responsible to the mayor and council for all administrative city functions except those specifically delegated otherwise by code or charter including that the council shall appoint and remove, determine qualifications for, and prescribe compensation for all appointive officers including but not limited to the city administrator, municipal judge, city administrator or designee, and department heads.

(1) 
Notwithstanding HMC § 2.11.020, the administrator shall perform day-to-day management responsibilities for the city. The administrator shall serve at the discretion and pleasure of the city council. Specifically, the administrator shall:
(a) 
Attend all council meetings unless excused by the mayor or council;
(b) 
Make reports and recommendations to the mayor and council about the needs of the city;
(c) 
Furnish council with such information as it may require or request;
(d) 
Administer and enforce all city ordinances, resolutions, franchises, leases, contracts, permits and other city decisions;
(e) 
Review and examine the departmental organization and operating procedures so as to effect greater economy and efficiency in departmental management;
(f) 
Administer the city's personnel program;
(g) 
Supervise department heads and other such departmental arrangements as adopted by council except as otherwise delegated in the code and charter. Specifically, the city administrator shall have no line of authority over the municipal judge or city attorney;
(h) 
Develop such administrative rules as consistent with council policy, ordinances and resolutions as necessary to the efficient operation of city programs;
(i) 
Prepare and administer the annual city budget pursuant to Oregon State law, which includes authority to freeze or to administratively reduce appropriations within any department as deemed necessary for the proper fiscal management of the city;
(j) 
Administer city utilities and property;
(k) 
Purchase and enter into contracts on behalf of the city as consistent with the council-adopted budget or policy;
(l) 
Encourage and support regional and intergovernmental cooperation;
(m) 
Promote cooperation among the council, staff and citizens in developing city policies and building a sense of community;
(n) 
Perform other duties as directed by the council; and
(o) 
Delegate duties, but remain responsible for actions of all subordinates.

Initial compensation for the city administrator shall be determined by the city council, generally through negotiations of an initial employment agreement. Salary increases beyond general increases to city employees shall be based upon satisfactory performance evaluations. The city administrator shall not, however, receive less than any increases granted to other city employees.

The city council and the city administrator shall establish performance standards that shall be the basis of annual reviews by the city council of the city administrator. These annual reviews shall be the basis for yearly salary increases and shall be used as the standard for continued employment.

When the city administrator is temporarily disabled from acting as city administrator or when the office becomes vacant, the council must appoint a city administrator pro tem. The city administrator pro tem has the authority and duties of city administrator, except that a pro tem administrator may appoint or remove city employees only with council approval.
