Pursuant to ORS 401.305, an emergency management agency for the city of Hubbard is hereby established. The emergency program manager shall have responsibility for the organization, administration and operation of the emergency management agency during an emergency in accordance with the provisions of the emergency management plan.

The city council shall by resolution adopt and may from time to time amend an emergency operations plan, together with hazard-specific plans, resource lists and call lists. The emergency management plan, together with all hazard-specific plans, resource lists and call lists and changes and additions thereto, may be referred to herein as the "plan."

Members are responsible for maintaining their manual in an up-to-date manner and in good condition. Any member may propose a change to this manual. Changes or additions will be made at the annual meeting unless warranted at an earlier date. The proposed change will be reviewed by the emergency management committee. Record of changes will be maintained in each manual in Section VIII. Members will sign a form indicating they accept the amendments to the manual as discussed at the annual meeting.

The emergency program manager is authorized to negotiate, prepare and present for city council approval by resolution any necessary and appropriate agreements between the city, public agencies, and private parties in furtherance of the policies set forth in the emergency management plan.

In the event of an emergency, a declaration of emergency shall be declared in accordance with the procedures and chain of command set forth in the plan.

Whenever a state of emergency has been declared to exist within the city, the following measures may be taken in the interest of public health, safety and welfare:
(1) 
A curfew may be established for the area designated as an emergency area which fixes the hours during which all persons other than officially recognized personnel may not be upon the public streets or other public places.
(2) 
Areas may be designated an emergency area over which the city may exercise police jurisdiction.
(3) 
Streets and areas may be barricaded and vehicular and pedestrian traffic prohibited or regulated on streets leading to the area designated as an emergency area for such distance as may be deemed necessary under the circumstances.
(4) 
Persons may be evacuated from the emergency area.
(5) 
Other measures may be taken as are imminently necessary for the protection of life or property including entering onto or upon private property to prevent or minimize danger to lives or property.

Any person who violates any provision of the plan, or any emergency measure or order taken pursuant to said plan, or this chapter, commits a civil infraction and shall be subject to a fine not exceeding $500.00.
