The following persons shall be eligible to apply for fireworks licenses: enrolled members of the Tulalip Tribes who are 18 years of age or over.

Licensees who operate retail fireworks sales establishments shall be present during times of operation or shall be in close control of the business. A licensee is in close control of the business where, though absent for reasonable periods of time, (s)he remains responsible for and in control of the operation of the business, ensuring that the provisions of the license, this code, and any regulations adopted hereunder, are not violated in his/her absence.

A licensee may employ or be assisted in the operation of his/her fireworks stand by meeting the definition of an authorized assistant in subsection (1) of this section. Tax and Licensing shall require sufficient documentation, legal or otherwise, verifying a legal relationship in order to qualify as an authorized assistant under this section. Once the appropriate documentation is provided, and Tax and Licensing has verified the documentation and legal relationship, they shall issue a badge for those persons authorized to assist under this section.
(1) 
(a) 
Any adult Tulalip Tribal member.
(b) 
A licensee’s spouse. For purposes of this code, a “spouse” means a person who is married to another under the law, but does not include a person who is living separate and apart from his or her spouse and who has filed, in an appropriate court, a petition for legal separation or dissolution of marriage.
(c) 
A non-Tribal parent or step-parent of the licensee, providing that the licensee’s step-parent has not remarried.
(d) 
A person 16 years of age or older who is a child, step-child, or adopted child of, or under the legal guardianship of a Tulalip Tribal member licensee, and who is supervised by this same licensee. A step-child is no longer a step-child if the licensee is remarried.
(e) 
Any Tulalip Tribal member 16 or 17 years of age, with the written consent of his or her parent or legal guardian.
(2) 
No person shall be authorized to be employed or assist as an authorized assistant in the operation of a fireworks stand whose license has been revoked, suspended, or who is otherwise ineligible for a license under TTC § 10.25.240.
