The Village of Victor, consistent with Public Officer's Law § 103, Subdivision (d), recognizes the right of the general public to record meetings with the exception of those matters conducted in Executive Session. The use of recording devices at any meeting of any Village Board shall be done in accordance with the following rules, regulations, or procedures:
A.
No recording of Executive Session is permitted.
B.
No surreptitious or secretive recording of proceedings is allowed.
C.
Any person desiring or intending to record a public meeting or hearing in whole or in part shall advise the Chairperson of the meeting before the commencement of the proceeding. No proceeding shall be interrupted to commence or cease recording, except in the event the person recording leaves the meeting.
D.
Regardless of whether the person recording the proceeding intends to retain a recording of the proceedings for future purposes, any person recording a proceeding must provide a complete, unedited copy of the recording to the Village Clerk within five business days of the meeting in an unencrypted media format with playback software available to the general public free of charge.
E.
All recording devices will be placed openly, in a location at the discretion of the Chairperson of the meeting, in a proximity to be effective, but not where it will be obstructive to the Board or the audience.
F.
Recording devices will remain in a fixed position throughout the proceeding, and will remain recording throughout the proceeding.
G.
No recording may be played back, or otherwise played aloud, during the proceeding, without the express permission of the Chairperson.
H.
The Chairperson shall take special care during the proceeding where a recording is being made to remind all persons to speak clearly, identify themselves when beginning to speak or make comments, and to ensure that only one person is speaking at a time.
