It is the intent of this chapter to provide for the administration of fire protection for the Village of Round Lake, exercising its home rule powers under New York Law and the New York State Constitution.[1]

The following words and phrases have the following meanings for purposes of this chapter.
CONTRACT FOR FIRE PROTECTION
A contract under which cash consideration is received by the Village or the Fire Department or a Fire Company thereof for the furnishing of fire protection to an area outside of the Village. Any such contract shall be deemed in full force and effect for the purposes of this chapter if negotiations are pending for the renewal thereof.
COUNCIL OF THE FIRE DEPARTMENT
The Chief, the First Assistant Chief and the Second Assistant Chief of the Village of Round Lake Fire Department.
FIRE COMPANY
An organization of firefighters which provides fire protection. A fire company may or may not be a component of a municipal or fire district fire department. It may be either an unincorporated association or incorporated as a not-for-profit corporation.
FIRE DEPARTMENT OF THE VILLAGE OF ROUND LAKE
An organization comprising the Board of Trustees of the Village of Round Lake, the Chief, First Assistant Chief and Second Assistant Chief of the Fire Company, and all the firefighters of each Fire Company providing firefighting services and located within the Village of Round Lake. The members of the Fire Department may be organized into one or more Fire Companies.
FIRE DISTRICT
A separate, special-purpose local government created to provide fire protection to an area of a town outside of the Village.
FIRE PROTECTION DISTRICT
An area of a town outside of the Village for which the town contracts to receive fire protection services from another entity.
JOINT FIRE DISTRICT
A separate, special-purpose local government created to provide fire protection to an area of a town outside the Village, plus the area of one or more villages within the town.
MEMBER
A volunteer firefighter who has been selected and appointed by Fire Company and approved by the Village Board of Trustees providing services to the Village through a Fire Company located within the Village, and meeting the requirements of New York State Village Law, Article 10, § 10-1006.
THE VILLAGE
The incorporated Village of Round Lake, Saratoga County, New York.
A. 
The provision of fire protection services by the Village through its Fire Department shall be administered by the Village Board of Trustees, together with the Council of the Fire Department, rather than by a Board of Fire Commissioners.
B. 
The Chief of the Fire Company shall be elected by each Fire Company at such Fire Company's annual meeting by ballot, and the Chief shall appoint the First Assistant Chief and the Second Assistant Chief, which election and appointments must be approved by the Village Board of Trustees. The Fire Company shall elect or appoint such further officers, if any, as may be provided for in the bylaws of the Fire Company. The Council of the Fire Department shall meet with the Board of Trustees at least annually and shall work with the Board of Trustees as necessary or advisable to make those administrative decisions, and take such actions, for the effective operation of the Fire Department.
C. 
Each Fire Company providing fire protection services within the Village shall obtain an annual audit of its records by an independent certified public accountant or an independent public accounting as required by NYS General Municipal Law § 209-z, and provide the Village with a copy of such audit.
