The purpose of this chapter is to regulate the operation of cryptocurrency kiosks within the city to ensure consumer protection, protect vulnerable populations, and prevent fraudulent activities.

For the purposes of this chapter:
(1) 
“Agent”
means any individual working for the business owner and/or operator.
(2) 
“Business owner”
means the owner of the location a cryptocurrency kiosk has been installed.
(3) 
“Cryptocurrency kiosk”
means any automated teller-style machine (ATM) that allows users to exchange any form of currency for digital currencies.
(4) 
“Elderly care facility”
means any licensed facility, residence, or establishment that provides care, supervision, or assistance with daily living activities to persons aged 60 years or older. This includes, but is not limited to, nursing homes, assisted living facilities, residential care facilities, memory care units, and adult day care centers, whether public or private.

“Operator”
means the business entity responsible for the operation of the cryptocurrency kiosk.
(6) 
“Public transit system route”
means any officially designated path or corridor regularly used by public transportation vehicles, including buses and Call-A-Ride operated by the City of Albany.

“School building”
means any structure or facility used primarily for the instruction of students of any age, whether operated as a public or private institution. This definition includes all administrative, satellite, and alternative education campuses.

Cryptocurrency kiosks shall be prohibited in residential zones and within one-quarter mile of an elderly care facility, school building, and/or public transit system route.

(1) 
Upon discovery of a cryptocurrency kiosk in violation of this chapter, the business owner, operator, or agent shall immediately disconnect the kiosk from power and move it to a location inaccessible by users.
(2) 
If the business owner, operator, or agent refuses to take action, the City shall take steps to lawfully bring the location into compliance, including but not limited to seizing the cryptocurrency kiosk.

Any operator and/or location operator found to be in violation of this chapter shall be punished under the general penalty provided for in Chapter 1.04 AMC.

Every section of this chapter or subsection or separate part thereof shall be considered a separate provision to the extent that if any portion shall be declared unconstitutional, it shall not affect the remaining parts of this chapter.
