The definitions set forth in Chapter 70.77 RCW as now in effect or hereinafter amended shall govern the construction of this chapter, when applicable. RCW 70.77.120 through and including RCW 70.77.230 as now in effect or hereinafter amended are hereby adopted by this reference and a copy of the same shall be kept on file in the office of the city clerk for public use and inspection.

No person shall possess, use or discharge any fireworks within the City, nor shall any person offer for retail sale or sell any fireworks within the City. Except as authorized by a State license and City special event permit granted pursuant to RCW 70.77.260(2) (Public display) or RCW 70.77.311(2) (Use by individual or group for religious or other specified purpose on approved date and at approved location) or Chapter 8.40 KMC, no person shall ignite, explode or discharge any fireworks within the City.

The provisions of this chapter shall be applicable to the sales, possession, use, and discharge of all fireworks except “toy caps.”

The police chief, or designee, is authorized to enforce all provisions of this chapter, including the authority to revoke any permit issued pursuant to this chapter upon any failure or refusal of the permittee to comply with the provisions of this chapter and any related requirements of the police chief or his designee, or any other applicable ordinance or regulation of the City.

Except as set forth in this section, any person violating or failing to comply with the provisions of this chapter is guilty of a misdemeanor, and, upon conviction thereof, shall be punished in the following manner:
A. 
The sale, possession, or use of unlawful fireworks by any person shall be punishable by a penalty of $500.00 for each violation.
B. 
The discharge of unlawful fireworks by any person shall be punishable by a penalty of $1,000 for each violation.
