The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
means that the assembly has precluded all defenses to liability and has placed the entire responsibility for the damages caused upon an excavator who violates this chapter.
means a period of 24 hours which falls on any day other than a Saturday or Sunday or a municipal, state or federal holiday.
means any undermining or reduction in lateral support or any severance, penetration, impairment or destruction of any underground facility or of any human-made protective coating, jacket, covering or other protective device of any underground facility.
means any condition constituting a clear and present danger to life or property.
mean any operation in which earth, rock or other material below the ground is moved or otherwise displaced by any means; road maintenance that changes the original road grade; and any demolition or movement of earth by equipment, tools or explosive device, including but not limited to augering, backfilling, digging, ditching, drilling, grading, plowing-in, pulling-in, ripping, scraping, trenching and tunneling.
means the exact date of the excavation.
means any person who either excavates or authorizes excavation.
means a service through which a person can call one telephone number to notify all participating utilities of their proposed excavation and request a surface marking of underground facilities within the proposed excavation area.
means that the surface mark for facilities less than ten feet deep is located within 24 horizontal inches of the outside dimensions of the underground facility. For facilities buried deeper than ten feet, the surface mark shall be within 30 horizontal inches from the outside dimensions of the underground facility.
means the use of stakes, paint or other clearly identifiable materials or marks to show the vertical projection of the subsurface location of underground facilities in accordance with the current color code of the American Public Works Association.
means any item buried or placed below ground for use in connection with the storage or conveyance of water or sewage, electronic, telephonic or telegraphic communications, cablevision, electric energy, petroleum products, gas, gaseous vapors, hazardous liquids or other substances, including but not limited to pipes, sewers, conduits, cables, valves, lines, wires, vaults, manholes, attachments, and those parts of poles or anchors below ground.
means a person who supplies any of the following by use of underground facilities for commercial or public use:
Flammable, toxic or corrosive gas.
Petroleum, petroleum products or hazardous liquids.
Electricity.
Telecommunications, including cable television.
Sewage disposal and drainage.
Water.
Storm and subdrains.
Steam or hot water.
Slurry systems.
Traffic signalization.
Street lighting.
A person who is a record owner of real property wherein are located underground facilities used solely to furnish any or all of such services or materials only to such property shall not be deemed a utility. |
