A. 
On or before the third Friday after an election, the election commission shall meet in public session to declare which ballots will be rejected and which shall be counted.
B. 
Any person registered as an observer present at the public session of the canvass may, by specifying the basis in writing:
1. 
Challenge a voter's ballot if the person has good reason to suspect that the voter is not qualified to vote at the election, or the ballot has not been properly cast under the standards in section 28.70.030.
2. 
Challenge the rejection of a ballot if the person has good reason to believe that the ballot has not been properly rejected.
C. 
The election commission by majority vote may accept a ballot or refuse to accept and count the ballot of a person properly challenged under this subsection. The commission may accept a partial ballot by authorizing the count of only those races and questions for which the voter was qualified.
D. 
The vote of the election commission is final.
E. 
Preliminarily rejected or challenged envelopes that the commission decides to accept shall be opened and the ballots counted under the procedures of chapter 28.80.
F. 
The municipal clerk shall place all ballot return envelopes rejected by the election commission, unopened, in a separate container with any statements of challenge. The container shall be labeled "rejected ballot return envelopes" and shall be retained for a period of 30 days after the date of certification of the election.
G. 
Within 30 days of certification of the election, the municipal clerk shall mail a notice of ballot rejection to each voter whose ballot return envelope was rejected. The notice shall state the reason for rejection.

A. 
Upon the close of the public session of canvass, the election commission shall adopt a report of the results of the commission's ballot review for submission through the municipal clerk to the assembly.
B. 
The municipal clerk shall prepare the results of the election for submission to the assembly.
C. 
The canvass shall be considered complete when the report of the results of the commission's ballot review and of the election has been adopted by the election commission.

A. 
The election commission and the municipal clerk shall report the results of the commission's ballot review and election results at an assembly meeting as soon as practicable.
B. 
If, after considering the information, the assembly determines that the election was validly held, the assembly shall certify the results of the election in accordance with the reports of the election commission and municipal clerk.
C. 
The certification shall be subject to the outcome of any recount under chapter 28.90 and any appeal or judicial review under chapter 28.300. Certification of the election is not subject to an assembly motion to reconsider.
D. 
If the election commission or municipal clerk reports a failure to comply with the provisions of law or illegal election practices, and that such failure is sufficient to change the outcome of the election, the assembly may exclude the votes cast where such failure or illegal practices occurred from the total return or may declare the entire election invalid and order a new election.
E. 
If the election commission or municipal clerk reports an apparent discrepancy in the returns, the assembly may order a recount of the votes in a specific race or contest, or for the entire election. The recount shall be conducted immediately by election officials.
F. 
After the certification of the results of the election, and after any additional process for the results of the election for a particular office to become final, the municipal clerk shall prepare an oath of office for the elected candidate and schedule the swearing in ceremony.
G. 
A runoff election for the office of mayor shall be held as required in the Charter.
