In order to protect the integrity of confidential government records, and to prevent the disclosure of government records in a manner contrary to the requirements of the New Jersey Open Public Records Act, it is unlawful for members of the Public to enter any municipal office area designated by the Borough to be restricted to "Authorized Personnel Only." These areas shall include, but not be limited to, designated office areas in the North Arlington Municipal Building, Police Department, Public Library, Recreation Center, Board of Health, Office of Emergency Management and the Department of Public Works Building.
As used in this section, the following terms shall have the meanings indicated:
PUBLIC
Shall include any Borough resident or non-Borough resident but does not include Borough of North Arlington employees, officers and elected or appointed officials; contractors of the Borough of North Arlington; officers, employees and elected officials of the State of New Jersey; officers, employees and elected officials of the County of Bergen; officers, employees and elected officials of the United States Federal Government; and any other such person who has been authorized by the Mayor, Administrator, Council President, Chief of Police, Fire Chief and or Clerk of the Borough of North Arlington.
Any office area restricted from public access shall be marked with a sign posted outside the office entrance, which shall state that the area is restricted to "Authorized Personnel Only."
Any member of the public who trespasses in a restricted area, as identified in this section, unless invited by a Borough employee or official, may be escorted from the building by the North Arlington Police Department. Any person who violates any provision of Chapter 361 and a violation of any of the provisions of this chapter shall be punishable upon conviction as provided in Chapter 1, Article I, General Penalty and or be subject to prosecution under N.J.S.A. 2C:18-3.
