That the owner or owners of every lot, tract or parcel of land fronting on any street, highway or public place within the limits of the Borough of Atlantic Highlands shall, within 24 hours after the termination of a precipitation causing the sidewalk or that part of the public way reserved for pedestrian traffic in front of said lot, tract or parcel of land fronting on any street, highway or public place in said Borough to be covered with snow or ice, remove, or cause to be removed, such snow or ice. Ice which is so frozen as to make removal impractical shall either be treated with rock salt or other chemicals which will thaw it sufficiently to permit removal or be thoroughly covered with sand. In addition, it shall be unlawful for anyone to shovel, place, push, blow and/or dispose of snow in any street.
It shall be a violation of this article for any owner or owners of every lot, tract or parcel of land fronting on any street, highway or public place in said Borough to fail to remove such snow or ice within 24 hours after the termination of the precipitation resulting in the same.

Any person or persons, firm or corporation violating any of the provisions of this article, upon conviction thereof, shall be subject to a penalty as provided in Chapter 1, Article II, General Penalty.

LOW-SPEED ELECTRIC BICYCLE OR TRICYCLE (LSEB) (LSET)
Means a two- or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts, that meets the requirements of one of the following classifications: "Class 1 low-speed electric bicycle or tricycle" which means a low-speed electric bicycle or tricycle equipped with a motor that provides assistance only when the rider is pedaling, and that ceases to provide assistance when the bicycle or tricycle reaches the speed of 20 miles per hour; or "Class 2 LSEB or LSET" which means a LSEB or LSET equipped with a motor that may be used exclusively to propel the vehicle, and that is not capable of providing assistance when the vehicle reaches the speed of 20 miles per hour.
LOW-SPEED ELECTRIC SCOOTER (LSES)
Means a scooter with a floorboard that can be stood upon by the operator, with handlebars, and an electric motor that is capable of propelling the device with or without human propulsion at a maximum speed of less than 19 miles per hour.
MEANS OF ELECTRIC CONVEYANCE (MOEC)
Means and includes any personal motorized bicycle, tricycle, scooter, skateboard, ball or single wheel apparatus.
PUBLIC SAFETY VEHICLE
Any vehicle being operated for or on behalf of the municipality so as to provide police, fire, medical, security, code enforcement or other services for the municipality.
The operation of a LSEB, LSET, LSES or MOEC shall be prohibited on the streets, sidewalks, paths, parks and public properties located in the Borough of Atlantic Highlands except as provided herein or as specifically permitted under Title 39 of the Statutes of the State of New Jersey, N.J.S.A. 39:1:1 et seq. Nothing herein shall be deemed to apply to any public safety vehicle.
The operation of LSEBs, LSETs, LSESs or MOECs shall be permitted in the Borough of Atlantic Highlands subject to the following rules and regulations:
A. 
Observance of traffic controls. All persons operating a LSEB, LSET, LSES or MOEC in the Borough of Atlantic Highlands shall be subject to all of the duties applicable to the driver of a vehicle by Chapter Four of Title 39 of the Revised Statutes, including the obligation to obey the instructions of official traffic control signals, signs and other control devices applicable to motor vehicles, unless otherwise directed by a police officer.
B. 
Helmet. Any person operating a LSEB, LSET, LSES or MOEC in the Borough of Atlantic Highlands shall wear a helmet in accordance with N.J.S.A. 39:4-10.1.
C. 
Passengers. No LSEB, LSET, LSES or MOEC shall be used to carry more persons at one time than the number for which it is designed and equipped.
D. 
Lights and reflectors. No person shall operate or ride upon any LSEB, LSET, LSES or MOEC during nighttime without working lighted headlights and lighted taillights.
E. 
Audible signal. A LSEB or LSET must be equipped with a bell or other audible device that can be heard at least 100 feet away. However, the LSEB or LSET shall not be equipped with a siren or whistle.
F. 
Hitching onto vehicles. No person operating a LSEB, LSET, LSES or MOEC shall attach themselves by any means to any automobile, truck, or any LSEB, LSET, LSES or MOEC. Nor shall the operator of a LSEB, LSET, LSES or MOEC knowingly permit any person who is not a lawful passenger to attach themselves by any means to the LSEB, LSET, LSES or MOEC or persons riding thereon.
G. 
Feet and hands on vehicle; tricks and stunts. All operators of LSEBs, LSETs, LSESs or MOECs shall keep their feet on the pedals or floorboard(s) and both hands on the handlebars at all times. It shall be prohibited to practice or perform any trick or stunt while operating a LSEB, LSET, LSES or MOEC on public property, including all public streets and roadways located in the Borough.
H. 
Operating regulations. Every person operating a LSEB, LSET, LSES or MOEC on a roadway shall ride as near to the right side as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. An operator may move left under any of the following conditions:
(1) 
To make a left turn from a left turn lane or pocket;
(2) 
To avoid debris, drains, or other hazardous conditions on the right;
(3) 
To pass a slower moving vehicle;
(4) 
To occupy any available lane when traveling at the same speed as other traffic.
I. 
Prohibited locations. No person shall ride a LSEB, LSET, LSES or MOEC upon a sidewalk, path or other walkway; public park or upon any other public property not specifically designed for personal vehicle use within the Borough of Atlantic Highlands.
J. 
Carrying items. No person operating a LSEB, LSET, LSES or MOEC shall carry any package, bundle or article which prevents the rider from keeping both hands upon the handlebars.
K. 
Parking. No person shall park a LSEB, LSET, LSES or MOEC upon a street except where appropriate racks or spots are provided. All LSEBs, LSETs, LSESs or MOECs, when parked on sidewalks, shall be parked only in such manner as not to obstruct or impede the normal movement of pedestrian or other traffic or access to adjacent buildings.
L. 
Speed. No person shall operate a LSEB, LSET, LSES or MOEC at a speed in excess of 20 miles per hour except where necessary to do so for the safety of the operator or other members of the public.
M. 
Reckless or careless riding. No person shall ride a LSEB, LSET, LSES or MOEC in a reckless or careless manner which endangers or is likely to endanger the safety or welfare of other persons or property.
