Where a public sewer is not available within the proximity limits set forth in BMC § 13.60.001, the applicant may elect to construct and maintain a private sewage disposal system, approved by the city.
A permit is necessary to construct, reconstruct or alter a private sewage disposal system. The applicant for a permit for construction of a private sewage disposal system shall:
Execute an agreement to make no protest of assessment district proceedings or other legal proceedings undertaken for improvement of the public sewerage system;
No premises to be served by a private sewage disposal system may be occupied until final inspection and approval of the system by the county health department and the director.

The owner shall operate and maintain private sewage disposal facilities in a safe and sanitary manner at all times at no expense to the city.

When a public sewer becomes available to property served by a private sewage disposal system, the owner shall make a direct connection to the public sewer in compliance with this division and the rules and regulations of the city. Septic tank, cesspool, and similar private sewage disposal facilities shall be abandoned and filled with a suitable material as determined by the director.
