It is in the public interest to have public telephones located on public sidewalks in the city at designated locations. When so located as to not unreasonably interfere with the rights of the public, telephones located on public sidewalks will provide a convenience to the public and will facilitate the reporting of fire, accidents and other emergencies.

The city manager is authorized to issue a permit from time to time to the telephone company serving the city ("the permittee") for the installation and maintenance of public telephones on the public sidewalks in the city. The city manager has the authority to approve the number and location of public telephones and shall exercise this authority in a manner which best serves the public interest.

Each permit issued by the city manager is subject to the following requirements:
A. 
The installation shall be in a manner approved by the city engineer;
B. 
The city shall at its expense furnish electrical service for illumination of each installation;
C. 
The permittee shall maintain the public telephones and associated booths in good repair and safe and sightly condition at the permittee's expense and to the satisfaction of the city manager;
D. 
The permittee shall indemnify the city and hold it harmless from loss, claim and judgment for damages to a person or property arising out of the installation, maintenance or presence of the public telephones;
E. 
The permit is revocable and the permittee shall remove it upon receipt of 30 days' written notice;
F. 
The permittee may remove a telephone at any time in its discretion;
G. 
If a telephone is removed, the permittee shall restore the public property as nearly as practicable to its condition before the installation.

The permittee shall pay to the city an amount equal to 15 percent of the receipts, exclusive of federal communications excise taxes, from the coin receptacle of each telephone installed under this chapter. The permittee shall make payments to the city in the manner prescribed by the city manager but not less frequently than annually.
