Electronic bicycles, commonly referred to as "E-bikes," have become increasingly popular as an inexpensive and environmentally friendly means of travel. However, because riding most E-bikes does not require a license or training, ensuring that safety is a priority, especially as to minors operating E-bikes, is a shared responsibility among parents, guardians and the Borough. These regulations are intended to make E-bike riding a more pleasurable and safer experience and are applicable to Class 1 and Class 2 low speed electric bicycles.
CLASS 1 LOW SPEED ELECTRIC BICYCLE
Means a low-speed electric bicycle equipped with a motor that provides assistance only when the rider is pedaling.
CLASS 2 LOW SPEED ELECTRIC BICYCLE
Means a low-speed electric bicycle equipped with motor that may be used exclusively to propel the bicycle.
LOW-SPEED ELECTRIC BICYCLE OR E-BIKE
Means a two or three-wheeled vehicle with fully operable pedals and an electric motor of less than 750 watts that ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour.
A. 
A violation of this chapter shall be punishable in accordance with the provisions of Chapter 1, General Provisions, Article III, General Penalty Provisions, of the Borough Code.
B. 
In addition to any other penalty, a police officer may confiscate the E-bike and obtain the person's name, address, telephone number and age. Any E-bike confiscated will be returned after 24 hours upon the execution of a declaration of ownership. If the violator is under 17 years of age, the device will be released only to a parent or guardian.
