As used in this chapter, the following words, terms and their derivations shall have the following meanings unless their use in the text of this chapter clearly demonstrates a different meaning:
SMOKING
The burning of, inhaling from, exhaling the smoke from, or the possession of a lighted cigar, cigarette, pipe or any other item or device which contains tobacco or any other matter that can be smoked, or the inhaling or exhaling of smoke or vapor from an electronic smoking device or similar device.
TOWNSHIP PROPERTY
All buildings, facilities, structures, parks, recreation facilities, playgrounds, athletic fields, parking lots and other lands and real property owned or under the control or supervision of the Township of Andover, including but not limited to any parking area, driveway, or drive aisle.
Smoking shall be prohibited at, upon, or inside of all Township property. No-smoking signs or the international no-smoking symbol shall be clearly, sufficiently, and conspicuously posted, wherever it can be practically done, at each municipal building entrance and at each outdoor area where smoking is prohibited by this chapter. The signs shall be clearly visible to the public and shall contain letters or a symbol which contrasts the color of the sign, indicating that smoking is prohibited therein. The sign shall also indicate that violators are subject to a fine.
This chapter shall be enforced by the Andover Township Police Department, the Township Health Officer, the Township Administrator, and the Township Code Enforcement Officer.
Unless another penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this chapter shall be subject to a fine of not less than $250 for a first offense, a fine of not less than $500 for a second offense within one year, and a fine of not less than $1,000 for a third or subsequent offense within one year. Each and every smoking event shall constitute a separate offense.
