This code shall be known as the Hi-Desert Water District Code and it shall be sufficient to refer to it as the "Hi-Desert Water District Code" or the "code" or the "Hi-Desert Code" or the "district code" or the "water district code" in any prosecution for any violation of any of its prohibitions or offenses or in any proceeding at law or in equity.

This code consists of all regulatory, penalty, and administrative ordinances and resolutions of the Hi-Desert Water District, California, of a general and permanent character. Pursuant to Sections 50022.1 through 50022.8 and 50022.10 of the California Government Code, Code Publishing Company, Seattle, Washington, is hereby authorized to revise, codify, compile, correct, edit, and publish such as this code.

Any ordinance or resolution not preserved as changed, added to, or perfected by this revision, indexing, reformatting, editing, codification, and compilation that is in conflict with any portion(s) of this code is hereby repealed, subject to the provisions of HDWDC § 1.01.060.

Title, chapter and section headings shall not be deemed to govern, limit, modify or affect the scope, meaning or intention of any section, chapter, or title of this code.

Neither the adoption of this code nor the repeal or amendments of any ordinance or resolution or part or portion of any ordinance or resolution shall affect the prosecution for ordinance or resolution violations that were committed prior to the effective date of this code adoption. The adoption of this code shall not be construed as a waiver of any license, fee, penalty, debt, forfeiture or obligation due and unpaid to the district on the date this code takes effect. All rights, fines, entitlements, duties, and proceedings existing pursuant to any ordinance or resolution on the date of the adoption of this code shall remain in effect unless specifically repealed in this code adoption. No bonds or cash required to be posted, filed or deposited pursuant to any ordinance or resolution shall in any way be made invalid by this code adoption.

Any reference in matters of record to any ordinance or resolution existing prior to the adoption of this code shall be construed to apply to the corresponding code provisions in effect at the time of codification. Pursuant to Section 50022.8 of the California Government Code, copies of this code that have been duly certified by the secretary of the Hi-Desert Water District board shall be received without further proof as prima facie evidence of the provisions of such code in all courts and administrative tribunals of this state.

It is hereby declared to be the intention of the district board that the sections, paragraphs, sentences, clauses and phrases of this code are severable, and if any phrase, clause, sentence, paragraph or section of this code is declared unconstitutional or without effect by any final judgment or decree of a court of competent jurisdiction, such judgment or decree shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this code.

Pursuant to Section 50022.3 of the California Government Code, copies of this code are on file with the secretary of the board and are open to public inspection but need not be published with the ordinance codified in this chapter; however, the ordinance adopting the revision, codification and/or compilation of these ordinances shall be published or posted pursuant to Section 50022.5 of the California Government Code.
