It shall be unlawful for any person to use, ignite, or discharge any consumer fireworks, as defined in IC 22-11-14, at any place in the consolidated City, except during the following times:
(A) 
On June 28 through July 3, between the hours of 5:00 p.m. and two hours after sunset; except for:
(1) 
On July 4, between the hours of 10:00 a.m. and 12:00 midnight;
(2) 
On July 5 through July 9, between the hours of 5:00 p.m. and two hours after sunset.
(B) 
On December 31 and January 1, between the hours of 10:00 a.m. on December 31 and 1:00 a.m. January 1.
(C) 
Fireworks should be launched no less than 25 feet from the neighboring property. Fireworks should be aimed straight up in a safe manner. Fireworks that have fallen on neighboring property or properties should be cleaned up by 5:00 p.m. the following of launch.
Violations of this section are subject to the following enforcement provisions:
(1) 
For this first offense in any 12-month period, shall be subject to admission of violation and payment of the civil penalty in accordance with Section 104.999; fine of $75.
(2) 
For the second offense in any 12-month period, the civil penalty is fixed at a minimum of $500 under the provisions of Section 104.999; and
(3) 
For the third and subsequent offenses in any 12-month period, a civil penalty of up to $2,500 shall be imposed under the provisions of Section 104.999.
