Wherever a space is marked off on any street for the parking of an individual vehicle, every vehicle parked there shall be parked wholly within the lines bounding that space, and it shall be a violation of this Part for any person to park a vehicle or allow it to remain parked otherwise.

The Borough Manager shall have authority to create temporary no-parking zones on any Borough right-of-way for purposes of street cleaning or sweeping; provided, that sign posting is done at least 12 hours prior to the beginning of the prohibition. During the duration of any such no parking, it shall be unlawful for any person to park a vehicle or to allow a vehicle to remain parked in any such posted location.

1. 
It shall be unlawful for any person to park any commercial vehicle, truck tractor, tractor or motor home on any street in the Borough between 11:00 p.m. and 6:00 a.m.
2. 
It shall be unlawful for any person to park any kind of trailer, wrecker, bus, tow truck, rollback truck or truck camper on any street in the Borough between 11:00 p.m. and 6:00 a.m. for more than three consecutive nights unless a permit is granted by the Police Chief. Any owner of a vehicle specified in this section who wishes to park on the street shall apply to do so on a written form provided by the Police Department. Permits granted by the Police Chief shall be for a one-year period, which may be renewable upon application to be filed by the vehicle owner with the Police Chief. The Police Chief's decision shall be made upon a review of the health, safety and welfare of the street, neighborhood and community. Any one-year permit granted by the Police Chief may be subject to review and reconsideration if conditions granting the permit shall change.

2. 
Electric Vehicle Charging Stations. Wherever a parking space is marked off or otherwise designated as an electric vehicle charging station, it shall be a violation of this Part for any vehicle other than an electric vehicle to park or remain parked in such a space, and it shall be a violation of this Part for an electric vehicle to park or remain parked in such a space when not charging.

It shall be unlawful for any owner of any type of motor vehicle requiring a registration plate and a state inspection sticker under the applicable provisions of the Vehicle Code to park or store or permit the same to be parked or stored on any public street, public alley, or Borough-owned or -controlled parking lot within the limits of the Borough if said motor vehicle does not have attached to it a current, valid registration plate and a current, valid state inspection sticker required under the applicable provisions of the Vehicle Code.

It shall be unlawful for any owner of any motor vehicle requiring a registration plate and a state inspection sticker under the applicable provisions of the aforesaid Vehicle Code to park or store or to permit to be parked or stored any such motor vehicle on any public street, public alley, or Borough-owned or -controlled parking lot within the limits of the Borough when such motor vehicle is to any extent partially dismantled and inoperable.

Any police officer may remove or cause to be removed to a nearby garage or other place of safety a vehicle in violation of any provision of this Part. Prior to removal of such vehicle bearing a registration plate by which the last registered owner of the vehicle can be determined, notice shall be sent by certified mail to the last registered owner of the vehicle informing him/her that, unless the vehicle is moved to a suitable location within five days of the date the notice is mailed, the vehicle will be removed and held at a suitable facility where it may be reclaimed. If the vehicle does not bear an identifiable registration plate, the notice may be secured to the vehicle.
2. 
Within the five-day period, the owner shall be given, if requested, an opportunity to explain to police officers or the Department why the owner believes the vehicle should not be removed. If the police officers or Department decides that the vehicle shall be removed, the owner shall be given an additional 48 hours to move the vehicle or have it moved.

Any person violating any provision of this Part shall receive a violation notice that their vehicle was parked in violation of this Part. This notice shall inform the violator that they must report to the offices of the Borough Police Department during normal business hours and pay to the Borough the initial fine for the violation within five business days of receipt of the notice or mail payment of the initial fine to the Borough at the address on the notice within five business days of receipt of the notice or notify the Borough in writing at the address on the notice of an intent to plead not guilty to the parking violation within five business days of receipt of the notice. Each day a violation continues shall constitute a separate offense, and each provision violated shall constitute a separate offense.
2. 
Any person who violates any provision of this Part and fails to pay the initial fine or respond with a plea of not guilty, in accordance with § 15-412, Subsection 1 above, shall be cited for such violation and, upon conviction before the Magisterial District Judge or other court of competent jurisdiction and in accordance with the procedures set forth in the Pennsylvania Borough Code,[1] be sentenced to pay a secondary fine established by the Fee Schedule plus the costs of prosecution, including, but not limited to, all court costs and reasonable attorney fees incurred by the Township in enforcing the violation.

Any person who violates §§ 15-408 or 15-409 of this Part shall, upon conviction before the Magisterial District Judge or other court of competent jurisdiction and in accordance with the procedures set forth in the Pennsylvania Borough Code,[2] be sentenced to pay a fine of not more than $1,000 plus the costs of prosecution, including, but not limited to, all court costs and reasonable attorney fees incurred by the Township in enforcing the violation. Each day a violation continues shall constitute a separate offense, and each provision violated shall constitute a separate offense. In addition to and/or in place of the above, the violator shall be responsible for all the costs of disposing of the violating vehicle under provisions of the Pennsylvania Motor Vehicle Code, 75 P.S. § 101 et seq., as amended.

The initial and secondary fines referenced in § 15-412, Subsections 1 and 2 above shall be set forth in the Borough Fee Schedule. Said fines and the time frames in which they must be paid may be amended from time to time by resolution of Borough Council. Payment of the initial fine(s) within the required time frame will save the violator from prosecution and from payment of additional fines and costs.
5. 
Enforcement Duties.
A. 
It shall be the duty of the police officers and/or the parking enforcement personnel of the Borough to report to the appropriate official all violations of any provision of this Part, indicating in each case: the section violated, the license number of the vehicle involved in the violation, the location where the violation took place, and other facts that might be necessary in order to secure a clear understanding of the circumstances attending the violation.
B. 
In addition, the officer or enforcement personnel reporting the violation shall also attach to or place upon every vehicle a violation notice stating that the vehicle was parked in violation of this Part. The notice shall contain instructions to the owner or driver of the vehicle to report to the Borough Hall and pay the required fine in accordance with § 15-412, Subsection 1 above.

The following are established as residential permit parking zones, and only vehicles containing or showing the proper residential parking permit for that zone shall be allowed to park in said zone:

Residential parking permits shall be issued to any single household residing upon a property within a zone listed in the table in Subsection 1 above upon request. A permit may be used by anyone authorized by the household to whom the permit was issued, including, but not limited to, non-resident family members, guests, delivery people, and persons working on the property. A residential parking permit can only be used in the parking zone designated for that permit.
