A.
Prior to occupancy, a certificate of occupancy must be obtained for all buildings/structures in all zoning districts. Such buildings and structures shall be subject to inspection as a condition of issuance of a certificate of occupancy when a new occupancy occurs, or when an occupancy changes, except as expressly provided by this subsection. An inspection shall not be required as a prerequisite to issuance of a certificate of occupancy if i) the owner of the building/structure presents an inspection report performed by a licensed professional inspector qualified to perform such inspection, ii) such inspection report was required and performed as part of the process for the purchase of the building/structure by the property owner, iii) such inspection occurred within 12 months preceding the date of the request for certificate of occupancy, iv) the inspection report certifies that the building/structure complies with applicable building codes, and v) that deficiencies, if any, identified in the inspection report have been remediated so that the building/structure complies with applicable building codes and City Ordinances. The certificate of occupancy requirement also applies to new construction and/or remodeled buildings/structures. The certificate of occupancy application will include an inspection checklist covering all items that will be inspected (see Attachment A).[1]

B.
Certificate of occupancy must be obtained before the utilities are turned on and the building/structure is occupied.
C.
The fee for the certificate of occupancy inspection may be paid by either the landlord or the tenant.
D.
The fee for this certificate of occupancy inspection is $100 or as otherwise provided in the adopted Schedule of Fees.
E.
The provisions of this section of this chapter are designed specifically to provide for the safety and well-being of the tenants who are to occupy buildings/structures located within the City.
F.
The City Administrator will appoint a designee who shall upon completion of an inspection issue a written list of violations that must be corrected before the property may be occupied by a tenant or will instruct in writing the City Secretary to issue the certificate of occupancy as soon as the property has been inspected and found to be compliant with applicable codes and ordinances of the City.
G.
If the initial inspection finds the property does not pass the safety inspection, the designee appointed to inspect the property will issue a list of repairs that must be completed before the certificate of occupancy is issued; when the repairs are completed, the designee will re-inspect the property and if the repairs have been completed such that the building/structure complies with applicable codes and ordinances of the City, will issue the certificate of occupancy.
H.
If the repairs are not completed in accordance with applicable codes and ordinances of the City after the reinspection of the property, an additional certificate of occupancy inspection must be applied for and the fee for the additional inspection and/or any other additional inspections made until the building passes the inspection shall be $100 or as otherwise provided in the Schedule of Fees.
I.
A landlord or property owner may request temporary service, for a period not to exceed 10 days, in order to complete any minor repairs and any cleaning of the property or building that may be needed. No one may occupy the property until a certificate of occupancy is issued.
