For purposes of this chapter, the following terms shall have the meanings set forth below:
ADMINISTRATOR
The Township Administrator of Rochelle Park, or their designee, responsible for coordinating billboard rentals and approvals in consultation with the Township Committee.
CYCLE
A consecutive four-week rental period for a flip/turn. Multiple cycles may be purchased in advance.
FLIP or TURN
An individual eight-second display within a rotating sequence of advertisements on a digital billboard face, appearing once every 64 seconds.
The Township may rent only those billboard flips expressly allocated to it under the 2013 Settlement Agreement with Allied Developers, LLC. Nothing in this chapter shall be construed to expand or modify the Township's rights under said agreement.
The Township is authorized to rent its allocated billboard flips for commercial, nonprofit, governmental, and other lawful purposes in accordance with this chapter.
A. 
Township public service announcements, emergency alerts, and community messaging shall have priority over all paid advertisements.
B. 
In the event of a conflict, Township use shall supersede paid use, with advertisers receiving appropriate make-up time as outlined in § 65-5.

Rates. The Township Committee may establish billboard flip rental rates based upon prevailing market rates for comparable locations within the region.
A. 
All applications to rent billboard flips shall be submitted to the Administrator.
B. 
The Administrator shall review applications for compliance with this chapter and may approve or deny applications, subject to the consent of the Township Committee.
C. 
The Administrator shall coordinate scheduling and placement of advertisements with the billboard operator on behalf of the Township.
D. 
The Mayor shall designate a Billboard Liaison from among the members of the Township Committee. The Billboard Liaison shall report monthly at a Township Committee meeting on billboard usage, rentals, revenues, and any issues requiring Committee attention.
A. 
Advertisements must comply with all applicable laws, regulations, and standards of decency.
B. 
The Township reserves the right to reject any advertisement that is false, misleading, defamatory, obscene, or otherwise inconsistent with public policy or community standards.
All revenues derived from billboard rentals shall be deposited into the Township's General Fund. Such revenues may only be appropriated by action of the Township Committee in accordance with law.
The Administrator shall maintain records of all billboard rental applications, approvals, denials, contracts, and revenues. Such records shall be available for public inspection in accordance with the Open Public Records Act (OPRA).
If any section, subsection, clause, or provision of this chapter shall be adjudged invalid, such adjudication shall apply only to that portion and the remainder shall be deemed valid and effective.
