As used in this article, the following terms shall have the meanings indicated:
Any portion of any public street or right-of-way in which there exists a depth of water exceeding six inches.
As defined in N.J.S.A. 39:1-1.
No person shall operate a motor vehicle on a closed roadway, or on a flooded roadway in a manner that casts or discharges a wave or wake that carries beyond the edge of the street or curbline, or that results in the disabling of the motor vehicle in the roadway. It shall not be a defense that the wave or wake that was created by operation of a motor vehicle on a flooded roadway did not cause actual damage to public or private property.
Any person violating the provision of this article shall, upon conviction thereof, be punishable by a fine of not less than $100, nor more than $2,000, by imprisonment for a term not exceeding 90 days, or community service for not more than 90 days, or any combination thereof.
