Any applicant, builder or developer may appeal to the Board of Supervisors, pursuant to Tulare County Ordinance Code Section 165, the decision or action of a Tulare County agency, office or employee to impose a fee upon the applicant, builder or developer under the provisions of this Chapter. Upon final decision by the Board of Supervisors, the applicant, builder or developer may protest the imposition of the fees pursuant to this Article and the provisions of Government Code Section 66020 et seq.

Any applicant, builder or developer may protest the imposition of any fee imposed under the provisions of this Chapter by meeting the following requirements:
(a) 
Tendering any required payment in full or providing satisfactory evidence of arrangements to pay the fee when due or to ensure performance of the conditions necessary to meet the requirements imposed.
(b) 
Serving written notice on the Clerk of the Tulare County Board of Supervisors, which notice shall contain all of the following information:
(1) 
A statement identifying the development, construction or application affected, including the name of the applicant, developer or builder and contact information sufficient to allow contact by phone and mail, and a copy of the receipt evidencing payment of the appeal fee.
(2) 
A statement that the required payment is tendered, or will be tendered when due, or that any conditions which have been imposed are provided for or satisfied, under protest.
(3) 
A statement informing the Board of Supervisors of the factual elements of the dispute and the legal theory forming the basis of the protest.

The protest must be filed no later than 90 days after the date of the Board of Supervisors' final decision on the imposition of the fee.

Where a protest has been filed in compliance with these provisions, the protest resolution procedure shall be as set forth under the provisions of Government Code Section 66020 et seq., as amended from time to time.
