A. 
No person shall keep or maintain, or cause or permit to be kept or maintained, upon any premises, any dog which by habitual and continual barking, howling or whining shall disturb the peace and comfort of any neighborhood zoned R-1, R-2 and R-3, or interfere with the reasonable and comfortable enjoyment of life or property by any person in said zone.
B. 
No person shall keep or maintain, or cause or permit to be kept or maintained, any dog owned by him/her or in his/her possession or under his/her control which habitually commits a nuisance upon the property of any other person.
C. 
No person shall keep or maintain, or cause to be kept or maintained, any unconfined dog which habitually attacks or barks at passing pedestrians, vehicles or other users of the public sidewalks, street and highways.

Violation of this chapter is an infraction subject to punishment by fine pursuant to Chapter 1.16.

Any person whose enjoyment of life or property is subject to unreasonable interference due to a violation of Section 6.12.010 shall file a complaint with the city police department. Said complaint will result in the sending of one warning letter informing the dog’s owner and/or person in control of the complained violation of Section 6.12.010. The warning shall state that the owner and/or person maintaining the dog will have five days to correct said violation and thereby conform to the provisions of Section 6.12.010.

If a complaint is lodged with the city police department after the five-day grace period has elapsed, concerning the same dog previously complained of, the police department may issue a citation pursuant to Chapter 1.16, providing the complaining party provides one or more of the following:
A. 
A log of barking, growling, whining or other incidents, occurring after the sending of the five-day letter;
B. 
Taped recording substantiating at least two incidents stated in the log;
C. 
The names, address and telephone numbers of one or more witnesses who will corroborate the barking, howling, whining, or other incidents or a signed affidavit from the witnesses stating the same.
