The purpose of this article is to establish minimum rental fees for the placement of antennas, equipment, or related communication infrastructure on City-owned towers or tower sites.

This article applies to all public, private, commercial, or governmental entities requesting or maintaining tower space on City-owned or City-leased communication towers.

Unless otherwise approved by the City Council:
(1) 
Base tower rental fee: Each tenant shall pay a minimum monthly rental fee of $150.00 per antenna/equipment location.

(a) 
A written Tower Lease Agreement shall be executed between the City and the tenant before installation, outlining:
(1) 
Equipment specifications.
(2) 
Term and renewal.
(3) 
Access procedures.
(4) 
Insurance and indemnification (if applicable).
(5) 
Maintenance obligations.
(6) 
Removal and restoration requirements.
(b) 
No equipment may be installed until the agreement is fully executed.

Failure to pay the required fees within 30 days of due date may result in:
(1) 
Late charges as established by City policy;
(2) 
Suspension of site access; or
(3) 
Termination of the lease and removal of equipment at the tenant's expense.
