The purpose of this chapter is to establish reasonable regulations for the placement, permitting, and maintenance of portable sanitary facilities in order to protect the public health, safety, and welfare, prevent nuisances, and ensure appropriate setbacks and screening within residential and commercial areas.

For purposes of this chapter:
Shall mean any temporary, self-contained structure intended for human sanitary use and waste collection.
Any placement or use of a portable sanitary facility shall require a permit issued by the Township Zoning Officer.
A portable sanitary facility located exclusively within the rear yard of any property shall be exempt from the payment of any fee but must still be issued a permit.
All permitted facilities shall:

The portable sanitary facility shall be removed upon completion of construction and no Certificate of Occupancy may be issued until said facilities have been removed.

Permits for non-construction sites. Any property owner may apply for and receive a permit to authorize a portable sanitary facility on any property for a period not to exceed 10 days. Any property owner may obtain a total of three such permits in any one calendar year with a maximum length of 10 days for each and said permits shall not be issued consecutively, there must be at least a 10-day window between permits.

In the event an emergency condition requires a portable sanitary facility to be located at any property within Jackson Township during a non-business day, the property owner shall be required to apply for and obtain a permit the next business day following the locating of such portable sanitary facility on their property. The term of the permit shall commence as of the date the portable sanitary facility was placed on site and the applicant shall be required to establish the date of same with their application.
The fee for each initial permit and each renewal shall be $50, as set forth in the Township Fee Schedule.
This chapter shall be enforced by the Township Code Enforcement Officer or other designated official. Any person(s) who is found to be in violation of the provisions of this chapter shall be subject to a fine not to exceed $500.
The Township may require immediate removal of any facility constituting a nuisance, hazard, or violation of this chapter or any facility which requires a permit and same has not been obtained or renewed as required by that chapter.
