A. 
Registration form. Every owner or tenant/occupant subject to this chapter shall file for a certificate of registration with the LEA, using forms provided by the LEA. The application shall include, but not be limited to, the name, address, and telephone number of the applicant; name, address, and telephone number of the business; owners of the business; description of the business; and the name, address, and telephone number of the person responsible for the business.
B. 
Registration fee. Every owner or tenant/occupant subject to this chapter shall pay to the LEA an annual registration fee in the amount specified in this chapter. Said annual registration fee shall be paid by the date specified on the invoice, within 30 days of date of invoice.
C. 
Penalty. Failure to file a non-life-hazard registration application after being ordered to do so is subject to the penalty of an amount equal to double the applicable registration fee, but not less than $200 or more than $1,000 for each registration.
D. 
Penalty. Failure to pay the non-life-hazard registration fee by due date after ordered to do so is subject to a penalty of equal to the registration fee.
E. 
If failing to pay the registration fee within the specified 30 days is recurring, happens two or more years in a row, an additional $100 can be applied to the fee.
F. 
If registration and penalty is not paid within 45 calendar days of the last charge, an additional fee of $100 or greater not to exceed $250 may be added.
G. 
If the tenant/occupant closes or moves away, any remaining balance that is owed to the fire bureau will be paid by the property owner.
The LEAs, as established in this chapter, shall carry out the periodic inspections of life- hazard uses required by the NJUFC on behalf of the Commissioner of the New Jersey Department of Community Affairs.
A. 
In addition to the life-hazard use inspections and fees required pursuant to the NJUFC and the regulations of the DCA, all business, mercantile, storage, factory, industrial, or other uses defined in accordance with the New Jersey Uniform Construction Code and the NJUFC which are classified as non-life-hazard uses, other than those that are incidental or auxiliary to the agricultural use of farm property, shall be registered locally, with fee, and inspected annually as required.
B. 
Where more than one additional use exists under one ownership at a given location, the highest use shall be registered at full fee, and the subsequent use at 1/2 of the scheduled fee per building.
C. 
Where two or more uses, exist at the same building or premises, each one shall be considered as separate and distinct for the purpose of this article and shall be registered pursuant thereto.
D. 
All multiple-family dwellings classified as R-2, as defined by the UCC, not already classified as a life hazard use, shall be required to register with the Fire Bureau as a non-life hazard use. Each building, including the grounds and parking lots, shall be inspected not less than once every 12 months. This is in addition to the five-year cyclical inspection conducted by the New Jersey Bureau of Housing Inspections (BHI).
E. 
Inspections shall include, but not be limited to, all dwelling units, fire-protection systems, basements, laundry rooms, corridors, vestibules accessible to occupants, exterior property grounds, utilities, building maintenance shops, fire lanes and zones, and all other requirements set forth within the NJUFC.
F. 
All non-owner occupied, attached one- and two-family dwellings classified as R-3 and R-5, as defined by the UCC, shall be required to register with the Fire Bureau as a non-life hazard use. Each building, including the grounds and parking lots, shall be inspected not less than once every 12 months. This is in addition to the five-year cyclical inspection conducted by the New Jersey Bureau of Housing Inspections (BHI), if applicable.

(2) 
Missed appointments: Forfeiture of payment and must reapply.
(3) 
Changing of an occupant of a one- or two-family or attached single family dwelling without a proper inspection prior to the change of occupant subjects the seller/owner to a fine of $500.
A. 
Permits shall be obtained from the Fire Official having jurisdiction of the fire district for any of those activities listed in N.J.A.C. 5:70-2.7 of the NJUFC, and any amendments, supplements, and rules and regulations thereto. Fees for these permits must be collected before a permit can be issued.
B. 
Permit/permit application fees are non-refundable.
C. 
All nonprofit organizations, municipal government and religious organizations shall be exempt from permit fees, however they still need to submit the required permit application, and all supporting documentation, to the Fire Bureau a minimum of 14 calendar days prior to the requested date to avoid a surcharge. See surcharge fee chart below.
D. 
Food Vendor and Food Truck Requirements.
(1) 
A Type 1 fire safety permit is required for all food vendors and food trucks which possess the ability to cook within the Township of Jackson. Applicants shall submit a completed permit application along with payment to the appropriate Fire Bureau in the District they will be participating in.
(2) 
Any food vendor/food truck must apply for an annual Mobile Food Vendor License issued by Jackson Township.
(3) 
Any food vendor or food truck that wishes to perform cooking operations underneath a tent must present documentation to the Jackson Township Fire Bureau 2, 3 or 4 confirming that the tent materials are flame-resistant, approved for cooking under, and are subject for approval.
(4) 
A food truck utilizing a cooking operation that, by the way of cooking method or type of food, creates grease laded vapors must be equipped with an exhaust hood pursuant to NJUFC and NFPA 96, and a kitchen suppression system pursuant to NJUFC.
(5) 
The suppression system of any food trucks must be inspected and tested every six months by a contractor possessing a valid New Jersey Division of Fire Safety contractor permit. A report shall be provided to the Jackson Township Fire Bureau 2, 3 or 4.
(6) 
All food trucks must be equipped with a fire extinguisher (minimum size of 2A-40-BC) in addition to a "K" extinguisher if the truck is equipped with deep fat fryer pursuant to NJUFC.
(7) 
Propane cylinders must be inspected for rust, damage, leaks, and alterations pursuant to NFPA 58.
(8) 
Exposed portions of propane hoses must be checked for general conditions and leaks pursuant to NFPA 58.
(9) 
Propane cylinders valves, regulators, hoses, etc., must be protected from damage from physical impact, stones, mud, etc., pursuant to NFPA 58.
(10) 
Regulators must be installed so that the pressure relief value is pointing downward, and the vent must be protected to prevent dirt, mud, etc., from entering the valve pursuant to NFPA 58.
(11) 
Food trucks shall be subject to full inspection for all other applicable requirements in accordance with the NJUFC.
E. 
Permit requirements and fees shall follow the NJUFC requirements and fee schedule.
(1) 
Exception: There shall be a Type 1A permit for use when a mobile food vendor is working from a vehicle such as an ice cream truck or not working from a vehicle such as a sidewalk vendor using a portable generator at events where a Type 1 permit is not required.
(a) 
The fee for a Type 1A Permit will be $15.
F. 
If you are requesting a permit: The permit application, all supporting documentation, and fee must be received by the Fire Bureau a minimum of 14 calendar days prior to the needed date to avoid a surcharge, unless further arrangements have been made with the Fire Bureau.
(1) 
Surcharge fee chart.
(a) 
14 or more calendar days: no added surcharge.
(b) 
7-13 calendar days: $25 surcharge in addition to permit fee.
(c) 
4-6 calendar days: $35 surcharge in addition to permit fee.
(d) 
1-3 calendar days: $50 surcharge in addition to permit fee.
G. 
Failure to obtain a required permit prior to commencing the operation, process, or activity for which a permit was required: a minimum of $125 fee and a maximum fee of $500 may be charged in addition to permit fee.
H. 
Failure to obtain a required permit after being ordered to do so while continuing the operation, process, or activity: a maximum of $5,000 per day during which the operation, process, or activity continues.
I. 
Fire report fee.
(1) 
The fee for furnishing copies of fire investigation reports shall be $30.
(2) 
The fee for furnishing copies of fire incident reports shall be $15.
(3) 
The fee for furnishing photos shall be $30. Fee does not include cost of reproduction photo services or postage.
(4) 
Fees for photo services and postage.
(a) 
First disk/memory device: $5.
(b) 
Second disk and more: $4 each.
J. 
Certificate of Fire Code Status in accordance with N.J.A.C. 5:71-3.7(b)9: $40.
A. 
Plan review and submittal. Submission to the Fire Official having jurisdiction shall include any plans submitted to the Planning Board or Board of Adjustment for the development, construction, or improvement of properties. The Fire Official shall submit requirements to the applicant and the Planning Board or Zoning Board of Adjustment prior to the applicant's board hearing. The Township's engineering firm, in conjunction with the Fire Official plan review requirements, shall conduct a site inspection before a permit is closed for compliance and issued a certificate of occupancy by the Construction Official.
B. 
Plans submitted to the Fire Official shall include one set of full construction plans that include building, fire, plumbing, mechanical, utility drawings, two sets of site plans, and one set of architectural plans. Site plans shall include, but not be limited to, to-scale plans of the site, location and size of fire lanes, zones, water mains, drafting locations, fire hydrants, FDCs, exterior driveways, fire-protection equipment, doorways, use of rooms, high-hazard materials, and utility controls.
C. 
Any administrative approval by the Planning Board for alterations or additions to a previously approved site plan shall be forwarded to the Fire Official for review, recommendations, and approval, prior to the Planning Board issuing its approval.
D. 
Fire hydrants. The Fire Official having jurisdiction shall approve fire hydrant locations and quantity. At a minimum, hydrants shall be spaced so that the traveled distance between hydrants does not exceed 500 linear feet, this may be less based on the geographic location of the hydrant. Fire hydrants shall comply with JTMUA rules and regulations. Fire hydrant barrels shall be painted silver, and the cap and bonnet shall comply with NFPA standards based on water flow. Fire hydrants located on dry water systems shall be entirely painted black.
E. 
Site or subdivision plan fee. Each applicant shall pay the following fees to the local Fire Bureau for review of any site or subdivision plans:
(1) 
Initial review of any site or subdivision plan: $100.
(2) 
Review of any resubmitted site or subdivision plan, payable upon resubmission: $50.
(3) 
Variance site plan review: $100.
A. 
All penalties under the NJUFC shall be adopted for the purpose of enforcing this chapter, except those penalties imposed hereinafter for violations of this chapter which are not included within the NJUFC.
B. 
False fire alarm. The Fire Official may assess penalties for violations of § 204-5O herein as follows:
(1) 
Three false fire alarms within a 180-day period: $200.
(2) 
Fourth and subsequent false fire alarms within one year from first occurrence: $250 per occurrence, in addition to remedies available within the NJUFC and the UCC.
C. 
Obstruction penalty. Any person who shall violate § 204-6A or B or § 204-7C, as listed herein, shall be punished by a fine of not less than $50 nor more than $250, and, at the discretion of the code official charged with enforcement of this regulation, a vehicle may be towed, or the obstruction or property otherwise removed. The cost of removal, towing and storage shall be charged to the owner of the vehicle or property and shall be paid prior to the release of said vehicle or property.
D. 
Any person or corporation who shall violate any other provision of this ordinance or who fails to comply therewith or shall violate or fail to comply with an order made hereunder shall be punished by a fine of not more than $2,000 or by imprisonment of not more than 90 days, or both, at the discretion of the court before which such conviction is held, by civil action summary proceeding under the Penalty Enforcement Law[1] in Municipal Court.

A. 
Pursuant to Sections 15 and 17 of the New Jersey Uniform Fire Safety Act, any person aggrieved by an order of the LEA shall have the right to appeal to the Ocean County Construction Board of Appeals, in accordance with N.J.A.C. 5:70-2.19, entitled "Appeals."
