The following words, terms and phrases when used in this article, shall have the meaning ascribed to them in this section, except where the context clearly indicates a different meaning. All definitions in article 6.04, Mobile Food Vendors, is incorporated into this article for all purposes.
Mobile food vendor courts/parks
means any parcel of land where two or more mobile food vendors congregate to offer food or beverages for sale to the public.

(a) 
All plans for site work, construction, utility connections, signs and operation must be approved by all pertinent departments, including but not limited to health, fire, public works, traffic, building inspections, and zoning.
(b) 
Site requirements.
(1) 
Location.
Mobile food vendor food courts/parks may be allowed only on private property within the city limits. Such courts/parks shall not be allowed on public or vacant property.
(2) 
Zoning requirements.
The private property must be located within one of the zoning districts listed below and is subject to all requirements contained in the City's Zoning Ordinance:
(A) 
District B-2, business or commercial district.
(B) 
District I, industrial district.
(3) 
Site specifics.
(A) 
The site must be covered in all-weather surface such as asphalt or concrete.
(B) 
No Mobile Food Vendor shall be parked on unimproved surfaces.
(C) 
Electrical service must be provided for each individual Mobile Food Vendor.
(D) 
One main water connection that meets State and Local regulations must be provided for on-site use. An additional water connection must be provided for every two mobile food vendors.
(E) 
Restrooms.
A minimum of one male and one female restroom must be provided with permanent structure and must be in compliance with the American with Disabilities Act. Portable sanitary facilities will not be allowed. The number of restrooms may vary depending on the size the court/park and number of vendors.
(F) 
Garbage receptacle.
At a minimum, one two-yard commercial garbage receptacle shall be provided and must be located on site, accessible to all vendor activities, and a minimum of fifty (50) feet away from all mobile food vending units and seating areas. A larger garbage receptacle may be required depending on the size of the court/park and the number of vendors.
(G) 
Parking.
A minimum of two parking spaces for every one mobile food vendor is required.
(H) 
Signage.
One permanent sign identifying the Mobile Food Vendor Court/Park is permitted.
(I) 
Seating area.
Seating must be provided for patrons within the proposed site. Seating layout must be included in the site plan. A minimum of six seats per mobile vendor is required.
(J) 
Grease trap.
At minimum, a 500-gallon grease interceptor must be installed. The city must approve the grease trap installments at the time of site plan review.
(c) 
Mobile food vendor requirements.
(1) 
All Mobile Food Vendor's using the Mobile Food Vendor Court/Park must be in compliance with article 6.04, Mobile Food Vendors, of the City's Code of Ordinances. It is the responsibility of the Mobile Food Vendor Court/Park operator to verify that all Mobile Food Vendors using the Court/Park are in compliance with all County and City rules and regulations.
(d) 
Permit required.
A permit is required to operate a Mobile Food Vendor Court/Park. The initial permit fee is $250 and may be changed from time to time by City Council through the adopted fee schedule. No permit shall be issued unless all site requirements are met.

(a) 
A person who violates a provision of this article or the associated permit is guilty of a separate offense for each day or part of a day during which the violation is committed or continues. Upon conviction, each offense is punishable by a fine not to exceed $2,000.00 per occurrence.
(b) 
A Mobile Food Vendor Court/Park operator and/or owner is additionally responsible for allowing any Mobile Food Vendor to operate within the Court/Park that is in violation of article 6.04, Mobile Food Vendors, and shall be subject to the same fines detailed in that article.
(c) 
All issues of non-compliance shall be corrected within five (5) working days. If the operator/owner/developer of the Mobile Food Vendor Court/Park fails to correct the issue, the permit to operate the Court/Park may be revoked.
