The board of directors does hereby approve a water availability charge of $21.00 per acre (with fractions of an acre rounded up to the nearest whole acre), and a sewer availability charge of $21.00 per acre (with fractions of an acre rounded up to the nearest whole acre) proposed to be established on land in the Murrieta service area for fiscal year 2024-2025. All computations of acreage and parcel size shall be as shown upon the assessment records of the assessor of Riverside County.

Pursuant to Section 71635 of the Water Code, the board of directors does hereby direct that, at the time and in the manner required by law for the levying of taxes for county purposes, the board of supervisors of Riverside County shall levy, in addition to any other tax it levies, the water and sewer availability charges in the amounts for the respective parcels fixed by this board of directors. Furthermore, the officers of Western shall furnish in writing to the board of supervisors of Riverside County, and to the county auditor, a description of each parcel of land within the Murrieta service area upon which a water and sewer availability charge is to be levied and collected for fiscal year 2024-2025, together with the amount of the water and sewer availability charge fixed on each parcel of land.

Water and Sewer Capacity Charges. The board hereby adopts the water and sewer capacity charges specified in Exhibit A, effective on August 1, 2023.

B. 
Adjustments to Rates. On July 1, 2024, and each July 1st thereafter, the rates for the water and sewer capacity charges set forth in Exhibit A may be adjusted for inflation using the 12-month percentage change in the Engineering News-Record Construction Cost Index (index) published for the month of March immediately preceding the July 1st adjustment date (e.g., the annual percentage change in the index as of March 2024 would be the inflationary percentage used to increase the charges as of July 1, 2024). For the sake of clarity, the index as of March 2023 is 13,176.3.
C. 
Inconsistency With Other Charges. To the extent that the water and sewer capacity charges established by this section are inconsistent with charges previously adopted, it is the explicit intention of the board that the water and sewer capacity charges adopted in this section shall prevail.
