(a)
Except as otherwise expressly provided by this section, no person shall consume any alcoholic beverage on or upon any public place, including any public street, right-of-way, sidewalk, alley, beach, park or parking lot; provided, however, that:
(1)
It shall not be a violation of subsection (a) to consume alcoholic beverages with a bona fide meal in any public park, with the exception of Heisler Park, Main Beach Park, Crescent Bay Point Park, and Riddle Field and Park.
(2)
It shall not be a violation of subsection (a) to consume alcoholic beverages with a bona fide meal:
(A)
At special event gatherings in Heisler Park, Main Beach Park or Crescent Bay Point Park in accordance with a permit issued by the community services department pursuant to the requirements established by resolution of the city council; or
(B)
At city-sponsored performing or cultural arts events in Heisler Park, Main Beach Park, Crescent Bay Point Park or Riddle Field and Park.
(3)
It shall not be a violation of subsection (a) to consume alcoholic beverages provided by the concessionaire located at Aliso Beach Park within the concession building or delineated patio area, as provided by an agreement with the city.
(b)
Except as otherwise expressly provided by this section, no person shall possess any can, bottle or other receptacle containing any alcoholic beverage that has been opened, or a seal broken, or the contents of which have been partially removed, on or upon any public place, including any public street, right-of-way, sidewalk, alley, beach, park or parking lot. This subsection does not apply when an individual is in possession of any alcoholic beverage container for the purposes of recycling or other related activity.
