No land, building, or structure of the Borough of Monmouth Beach shall be used for the purpose of an airport, heliport, helistop, or any other aircraft landing or takeoff area for airplanes, helicopters, or any other engine-driven, heavier-than-air aircraft that is supported in flight by the dynamic reaction of the air against its rotors or wings. This prohibition shall apply to all private, commercial, recreational, and non-essential helicopter and aircraft operations. No person shall operate an aircraft or helicopter in violation of this chapter.

AIRCRAFT
Any device that is used or intended to be used for flight in the air, including but not limited to airplanes, helicopters, gliders.
AIRPORT
Any area of land or water which is used, or intended for use, for the landing and takeoff of aircraft, and any appurtenant areas which are used, or intended for use, for airport buildings or other airport facilities or rights-of-way, together with all airport buildings and facilities located thereon.
EMERGENCY SERVICES
Services provided by law enforcement, fire suppression, emergency medical services (EMS), and other public safety agencies in response to situations that pose an immediate, actual, or imminent risk to health, life, property, or the environment.
HELICOPTER
Any engine-driven, heavier-than-air aircraft that is supported in flight by the dynamic reaction of the air against one or more rotors.
HELIPORT
An area of land, water, or structure used or intended to be used for the landing and takeoff of helicopters, and which may include any or all of the areas of buildings which are appropriate to accomplish these functions, including fueling, maintenance, and hangar facilities.
HELISTOP
A designated landing area on a structure or on the ground for the purpose of picking up or discharging passengers or cargo, but not including fueling, maintenance, or hangar facilities.
NON-ESSENTIAL OPERATION
Any aircraft operation not conducted for the purpose of providing emergency services. This term includes, but is not limited to, flights for recreational purposes, sightseeing tours, charter services for private transport, and any other commercial or private use not directly related to an emergency response.
OPERATOR
Any person who uses, causes to be used, or authorizes to be used an aircraft, with or without the right of legal control (in the capacity of owner, lessee, or otherwise).
PERSON
Any individual, corporation, partnership, firm, association, trust, estate, public or private institution, group, agency, political subdivision of this State, any other state, or the United States.

The provisions of this chapter shall be enforced by the Code Enforcement Officer and/or the Police Department of the Borough of Monmouth Beach.

The prohibition established in this section shall not apply to the following:
a. 
Emergency Operations. The landing and takeoff of helicopters operated by, or under the direction of, any federal, state, county, or municipal law enforcement, fire department, emergency management agency, or licensed emergency medical service provider, when such operations are in response to a medical emergency, fire, police matter, or other imminent threat to life or property.
b. 
The landing or takeoff of helicopters or other rotarywing aircraft when such activity is conducted in connection with legitimate and bona fide governmental operations undertaken by local, county, state, or federal government agencies or officials acting in the scope of their official duties. Such operations may include, but are not limited to, activities involving pubic safety, emergency management, military exercises, disaster response, or official visits by elected or appointed government officials.
c. 
Designated Landing Areas. For the purposes of the exceptions provided in this subsection, the following locations are hereby designated as pre-approved landing and takeoff areas for helicopters engaged in emergency service operations:
1. 
The main parking lot of the Monmouth Beach Bathing Pavilion, located at 29 Ocean Avenue.
2. 
The open field area of Griffin Park, located on Griffin St. in the Borough.

Any person, firm, corporation, or entity found to be in violation of the provisions of this chapter shall be subject to a fine not to exceed $2,000, imprisonment for a term not to exceed 90 days, or a period of community service not to exceed 90 days, or any combination thereof, for each offense. Each landing or takeoff in violation of this chapter shall be deemed a separate and distinct offense.
