The office of land use hearing examiner is hereby created. The examiner shall interpret, analyze, review, and implement land use regulations and shall have the jurisdiction, duties and powers as set forth in Title 18 of the Omak Municipal Code entitled “Zoning.”

The hearing examiner shall be appointed solely with regard to his or her qualifications for the duties of the office, which shall include persons with appropriate experience, such as land use planners, or public administrators, persons who have extensive experience in land use planning work in a responsible capacity, and persons with legal experience, particularly where that experience is in the area of land use management or administrative law. Any appointed hearing examiner may be removed by the mayor, subject to the approval of the council.
