10-1.1. 
Word and phrases. Whenever any words and phrases are used in this chapter, the meanings respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of the State of New Jersey shall be deemed to apply to such words and phrases used herein.
10-1.2. 
Official time standard. Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time, as may be in current use.
a. 
The Director of the Department of Public Safety or, in his or her absence, disability or inability to act, the Mayor and, in the event of his or her absence, disability or inability to act, then the Chief of Police of the municipality is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever the Director finds that such closing is necessary for the preservation of the public's safety, health or welfare.
b. 
Any regulations promulgated by the Township Council and in accordance with Paragraph "a" above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.
Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for term not exceeding 15 days or both.
If any part or parts of this chapter are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.
All former traffic ordinances of the Township of Old Bridge are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person(s) for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.
Traffic controls for street and highway construction and maintenance operations.
Adoption of the Manual on Uniform Traffic Control Devices for Streets and Highways.
When the normal function of the roadway is suspended, temporary traffic control planning provides for continuity of the movement of motor vehicles, bicycle, and pedestrian traffic, transit operations, and access to property and utilities.
The primary function of temporary traffic control is to provide for the safe and efficient movement of vehicles, bicycles and pedestrians through or around temporary traffic control zones while reasonably protecting workers and equipment.
Of equal importance to the public traveling through the temporary traffic control zone is the safety of workers performing the many varied tasks within the workspace. Temporary traffic control zones present constantly changing conditions that are unexpected by the road user. This creates an even higher degree of vulnerability for the workers on or near the roadway (see Section 6D.02). At the same time, the temporary traffic control zone provides for the efficient completion of whatever activity interrupted the normal use of the roadway.
Consideration for road user safety, worker safety, and the efficiency of road user flow is an integral element of every temporary traffic control zone, from planning through completion. A concurrent objective of the temporary traffic control is the efficient construction and maintenance of the highway.
The Township of Old Bridge, in the County of Middlesex, State of New Jersey, does hereby adopt the current Manual on Uniform Control Devices for Streets and Highways hereafter known as the MUTCD, except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility that fails to comply with the provisions of the MUTCD while performing such work is in violation of this section.
10-7.1. 
Preconstruction meeting. It shall be the responsibility of the person, contractor, or in the case of a public utility as required under the Public Utility Agreement, Section 16:25-9.2, wishing to conduct work on, under or above the street to contact the Police Department of the Township of Old Bridge in order to arrange a preconstruction meeting and submit plans for the safe movement of traffic during such period of construction or work, Any person, contractor or utility who fails to comply with this section prior to the start of such work, or whose plans are not approved by the Police Department of the Township of Old Bridge, is in violation of this section.
10-7.2. 
Emergency contact telephone numbers. The person, contractor or utility shall provide at least two emergency contact telephone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be made, or if the emergency contact person does not respond to a call from the Police Department to correct such hazardous condition(s), the Township of Old Bridge may respond to correct the hazardous condition(s). The reasonable fees for such emergency services by the Township of Old Bridge shall be charged to the person, contractor or utility responsible for the condition.
10-7.3. 
Hours. There shall be no construction, maintenance operations or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 3:30 p.m. This time period may be relaxed by the Township Engineer who shall coordinate such relaxation with the Police Department. The Chief of Police, or his designee, may adjust this time limit to permit work prior to 9:00 a.m. or after 3:30 p.m. If the officer in charge determines that the construction or maintenance operations prior to 9:00 a.m. or after 3:30 p.m. would substantially delay traffic or cause a safety health hazard, the work shall then be permitted only between 9:00 a.m. and 3:30 p.m.
10-7.4. 
Road closing. Road closing and/or traffic detours shall not be permitted unless approved by the Township Police Department.
10-7.5. 
Traffic directors. Traffic directors shall be posted at all construction or maintenance sites when determined by the Township Police Department that same is necessary to provide for the safe and expeditious movement of traffic.
10-7.6. 
Stop work. The Township Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, backfilling of open excavations and/or related work, in order to abate any nuisance and/or safety hazard for any violation of this section.
10-7.7. 
Site preparation. It is expressly understood that no materials, vehicles or equipment are to be placed in the roadway or sidewalk or until any necessary traffic control devices, including, but not limited to, all construction, signs, light devices and pavement markings are installed.
10-7.8. 
Violations and penalties. Any person, contractor or utility who commits a violation of this article shall, upon conviction thereof, be subject to a penalty as follows:
One or more of the following: imprisonment in the county jail or in any place provided by the municipality for detention of prisoners, for any term not exceeding 90 days; or by a fine not exceeding $1,000; or by a period of community service not exceeding 90 days. The minimum fine to be imposed for a first offense shall be $100. For any second offense the fine shall be not less than $250.
A separate offense shall be deemed committed on each day during or on which violation occurs or continues. Failure to abate a violation within 24 hours after notice of violation shall be considered a separate offense.
10-8.1. 
Regulations not exclusive. The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.
10-8.2. 
Parking prohibited during state of emergency in New Jersey.
a. 
Upon the declaration of an emergency, there shall be no parking upon the streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle, which has been parked prior to the posting of the signs.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle, provided that the police officer or his or her designee shall witness the removal of such vehicle and shall keep a record of the removing agency and the location of where the vehicle is to be taken. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon signs being erected as required by law.
10-8.3. 
Temporary parking prohibition for snow plowing and removal.
a. 
Whenever snow has fallen and the accumulation is such that it covers the streets and highways, an emergency shall exist and no vehicle shall be parked on the streets or highways or portions thereof indicated. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal before regaining possession of the vehicle.

Parking of certain trucks, vehicles, and trailers prohibited. No person shall park any truck or vehicle over five tons' gross vehicle weight (GVW), a school bus, any other type of bus, recreational vehicle, camper, boat or trailer between the hours specified upon any of the streets or parts of streets described.

Prohibition of unregistered vehicles in parking yards and parking places. Unless authorized by a sworn law enforcement officer, no person shall operate, park, leave or be in possession of a motor vehicle which is unregistered or has a suspended registration in any parking yards (lots) and parking places, which are open to the public or to which the public is invited, whether owned or maintained by a governmental entity or in conjunction with any business or enterprise, whether public, quasi-public or private.

a. 
Exemptions. This section shall not apply to:
1. 
Private property to which the public is not invited, such as residential lots.
2. 
Motor vehicles which are exempted from registration under Title 39 of the New Jersey Statutes, such as car dealer inventory.
b. 
Removal. Any police officer is authorized to order the removal of any unregistered vehicle in violation of this article to a storage space or garage, and the expense involved in such a removal and storage of the vehicle shall be borne by the owner of the vehicle, except that the expense shall be borne by the lessee of a leased vehicle.
c. 
Violations and penalties. The violation of this section shall subject the person so convicted or pleading guilty to a fine of $100. A separate offense shall be deemed committed on each day during or on which the violation occurs or continues. Failure to abate a violation within 24 hours after notice of violation shall be considered a separate offense.

10-19.1. 
Application for on-street handicapped parking space; procedure.
a. 
All residents requesting the issuance of a designated on-street handicapped parking space in the Township of Old Bridge must complete and file a formal application with the Township of Old Bridge Police Department.
b. 
The application shall require the applicant to provide the following documentation:
(1) 
The applicant must possess a disabled person identification card issued by the New Jersey Division of Motor Vehicles.
(2) 
The applicant must furnish to the Police Department a valid motor vehicle registration for the vehicle requiring the space and, if the applicant is the vehicle operator, a valid motor vehicle operator license.
(3) 
The applicant may request a designated handicapped parking space only for the applicant's place of residence.
(4) 
If the applicant is not the owner of the property at which the handicapped parking space is to be designated, a written statement from the property owner must be submitted to the Police Department stating that the owner has no objection to the restriction of parking in front of the property. Said written statement may not be reasonably withheld by the property owner.
c. 
The completed application, together with the required documentation as required in Subsection b, shall be filed with the Township of Old Bridge Police Department and shall constitute a request for a designated restricted handicapped parking space.
d. 
The Township of Old Bridge Police Department shall approve or deny requests for the issuance of designated restricted handicapped parking spaces on the basis of the standards set forth in Section 10-19.2 of this subsection.
10-19.2. 
Grounds for denial of application.
Notwithstanding an applicant's compliance with Section 10-19.1 above, an application for handicapped parking space shall be denied if:
a. 
Pursuant to applicable state or municipal law, the parking of motor vehicles is prohibited at the location of the requested handicapped parking space or the permitting of such parking would interfere with the normal flow of traffic;
b. 
The applicant or handicapped person is the owner of the property at which the space is to be designated and has reasonable access to a driveway on the property or reasonable access to some other area of the property which may permit the transport of the handicapped person;
c. 
The applicant is not the operator of the vehicle for which the handicapped parking space is required unless the State of New Jersey Division of Motor Vehicles has issued the applicant a windshield placard or wheelchair symbol license plates for a vehicle owned by the handicapped person or owned by another occupant of the residence who is a member of the immediate family of the handicapped person; or
d. 
The applicant resides, either as a tenant or an owner, in a housing complex which provides off-street parking and has reasonable access to said parking and an on-site handicapped parking space has been provided by the owner of the housing complex.
10-19.3. 
Approval ordinance designating on-street handicapped parking space.
a. 
Upon approval of an applicant's request for resident handicapped on-street parking, the Township of Old Bridge will enact an appropriate ordinance pursuant to N.J.S.A. 39:4-197.6, designating the name of the subject street, the side of that street where the resident resides, and a description of the allowed parking area in front of the subject residence. Such designation shall be within the property lines of the subject residence, but otherwise shall be subject to the discretion of the Chief of Police.
b. 
Upon the designation of an on-street handicapped parking space, said space will be marked by signs indicating handicapped parking space. The markings will conform with the manual on Uniform Traffic Control Devices for Street and Highways for the NJDOT and shall include the penalty notification sign as required by NJDMV.
10-19.4. 
Notice of approval of space; annual notification of Township regarding continued need of space.
a. 
Upon approval of a request for a designated handicapped parking space and passage of an ordinance by the Township Council of the Township of Old Bridge designating said space, the applicant shall receive a letter notifying the applicant that the space has been so designated and that it is the applicant's responsibility to notify the Township of Old Bridge Police Department in the event that the designated handicapped parking space is no longer required.
b. 
Annually by January 15 of each year, written notice shall be sent by the applicant to the Township of Old Bridge Police Department on forms provided by the Township indicating that a valid and continued need for the handicapped parking space exists. In the event that such notice is not received within 30 days of January 15, the handicapped parking space sign at that location shall be removed and a resolution or ordinance will be presented to the Township Council to repeal the designated handicapped parking space.
10-19.5. 
Applicability.
The provisions of this chapter shall apply to all on-street designated handicapped parking spaces created within the Township of Old Bridge except that handicapped parking spaces requested for general public use by public buildings, including but not limited to businesses, schools and hospitals, are not subject to the renewal provision of this subsection.
10-19.6. 
Violations and penalties.
Any person improperly parking in a properly designated resident handicapped restricted parking space shall be subject to the penalties under N.J.S.A. 39:4-203 and 39:4-207.7.
10-19.7.

Handicapped parking at public buildings.

a. 
Definitions. For the purpose of this subsection, the following definitions shall be applicable:
PHYSICAL HANDICAP
A physical impairment which confines a person to a wheelchair, causes a person to walk with difficulty or insecurity, affects the sight or hearing to the extent that a person functioning in public areas is insecure or exposed to danger, causes faulty coordination or reduces mobility, flexibility, coordination and perceptiveness to the extent that facilities are needed to provide for the safety of that person.
PUBLIC BUILDING
Any building, structure, facility or complex used by the general public, including but not limited to theaters, concert halls, auditoriums, museums, schools, libraries, recreation facilities, public transportation terminals and stations, factories, office buildings, business establishments, passenger vehicle service stations, shopping centers, hotels or motels and public eating places constructed by any state, county or municipal governmental agency or instrumentality or any private individual, partnership, association or corporation with the following exceptions: one- to four-family private residences, warehouse storage areas and all buildings classified as hazardous occupancies. As used herein, "hazardous occupancy" means occupancy or use of a building or structure or any portion thereof that involves highly combustible, highly flammable or explosive material or which has inherent characteristics that constitute a special fire hazard.
SPECIAL VEHICLE IDENTIFICATION CERTIFICATE —A special vehicle identification certificate and/or a license plate issued by the Director of Motor Vehicles pursuant to N.J.S.A. 39:4-206
b. 
Standards. From and after the effective date of this subsection, any individual, partnership, association or corporation which owns any public building in the Township of Old Bridge shall provide reserved parking spaces for the physically handicapped on any parking lot serving such public building in accordance with the following:
(1) 
A minimum of 1% of the total number of parking spaces, but not less than one parking space, shall be provided in an area of the parking lot which is most accessible and approximate to the public building or buildings which the lot serves.
(2) 
Each space or group of spaces shall be identified with a clearly visible sign displaying the international symbol of access along with the following wording: "These spaces reserved for physically handicapped drivers."
(3) 
Each space shall be 12 feet wide to allow room for persons in wheelchairs or on braces or crutches to get in and out of on either side of an automobile onto a level, paved surface suitable for wheeling and walking.
(4) 
Where possible, such spaces shall be located so that persons in wheelchairs or using braces or crutches are not compelled to wheel or walk behind parked cars.
c. 
Violations and penalties. Pursuant to N.J.S.A. 40:48-2.46, any individual, partnership, association or corporation failing to provide parking spaces in accordance with the terms of this subsection and/or operator of any motor vehicle which does not bear a special vehicle identification certificate located in accordance with N.J.S.A. 39:4-206 and who parks such motor vehicle in a space reserved as provided by Subsection b. of this section shall be subject to a fine not to exceed $500 and a sentence not to exceed 90 days in jail or both.
The locations described are hereby designated as loading zones. No person shall park a vehicle in said location during the times indicated other than for the loading or unloading of goods and materials.
