No person shall consume or possess an open container of any alcoholic beverage on any street, sidewalk, alley, parking lot or other public or City property within the City limits of San Juan Bautista, California between the hours of 6:00 p.m. and 6:00 a.m., unless he or the sponsor of an event he is attending has first obtained a special use permit allowing the consumption of alcoholic beverages in such places.
As used in this Article, “open container” shall include, but is not limited to, any bottle, can, thermal jar or jug, vessel, or other receptacle which is open, has been opened, or which has a seal broken, or the contents of which have been partially removed.
Any person violating this Article shall be guilty of a misdemeanor, and upon conviction thereof, shall be punished as set forth in the California Penal Code, by fine not exceeding one thousand dollars ($1,000) and/or County Jail for a term not exceeding one (1) year.
Any person or organization wishing to consume alcoholic beverages between the hours of 6:00 p.m. and 6:00 a.m. may apply to the City Manager of the City of San Juan Bautista for a permit to do so.
The City Manager shall grant such permit in conjunction with a special event and if in his opinion the consumption of alcoholic beverages would not endanger the public peace, health, morals, and welfare. Such application shall be on a form supplied by the City Manager and a fee established by resolution of the City Council shall accompany each application for a permit.
