(1) 
Classifications. There are three (3) types of sub-bodies established by the Village Board. They are:
(a) 
Standing committees, commissions, and boards.
(b) 
Special (statutory) boards and commissions.
(c) 
Ad hoc committees.
(2) 
Definitions of classifications. As used in this section, the following terms shall have the meanings indicated.
(a) 
Standing committees, commissions, and boards. Standing committees, commissions, and boards are bodies with members appointed by the Village President and subject to confirmation by the Village Board. Their structure and duties are established by ordinance or at the discretion of the Village Board.
(b) 
Special statutory boards and commissions. Special statutory boards and committees are those bodies whose composition, duties, and functions are specifically prescribed by the Wisconsin Statutes.
(c) 
Ad Hoc Committees. Ad Hoc Committees are created for a special purpose and for a limited duration of time. They may be created by the Village President. Their members are appointed by the President subject to confirmation of the Village Board. When the ad hoc committee has fulfilled the charge given to it by the President, the committee shall be disbanded.
(3) 
Classifications of existing committees, commissions, and boards. The existing committees, commissions, and boards of the Village are as follows:
(a) 
Standing committees, commissions, and boards.

Economic Development and Tourism Committee.
3. 
Emergency Management Committee.
4. 
Finance and Governance Committee.
5. 
Parks, Recreation, and Forestry Committee.
6.

Committee of the Whole.
(b) 
Special statutory boards and commissions.
1. 
Board of Review.
2. 
Community Development Authority.
3. 
Library Board.
4. 
Plan Commission.
5. 
Police Commission.
6. 
Zoning Board of Appeals.
(4) 
Meetings. All committees, commissions, and boards shall meet on an as-needed basis, except when a statute mandates a specific meeting date. Meetings shall be noticed by the Village Clerk in accordance with Chapter 19, Wis. Stats. Special meetings may be called by the chair of the committee, commission, or board, or by any two (2) committee, commission, or board members upon written request submitted to the Village Clerk. All meetings shall be open to the public, unless a closed session is permitted by statute.
(5) 
Quorum. Every committee, commission, or board has a quorum for the purpose of transacting business if at least fifty-one percent (51%) of the voting members are present unless Village Ordinances or Wisconsin Statutes specify otherwise, in which case such provisions shall apply.
(6) 
Records and reports. Every committee, commission, or board shall keep written minutes of its proceedings and file copies with the Village Clerk.
(7) 
Residency requirement.
(a) 
Except as provided in Section 3.01(7)(b) and (c), only Village residents or owners of a business within the Village and not residing in the Village may be appointed in a voting capacity to any Village committee, commission, or board. Any committee, commission, or board member who moves their personal or business residency from the Village may be removed from such committee, commission, or board.
(b) 
Members of the Library Board need not reside in the Village or own a business within the Village.
(c) 
Residency within the Village may be waived for certain appointees at the Village Board’s discretion as outlined in Section 3.01(10).
(d) 
Any non-resident with desirable qualifications may be appointed to serve in an ex officio non-voting capacity of any Village Committee, Commission, or Board.
(8) 
Attendance standard. Members of committees, commissions, or boards must attend a minimum of two-thirds (2/3) of the meetings of their respective bodies in any six (6)-month period. Failure to comply with this section may result in the removal and replacement of the member found to be non-compliant. Nothing in this section shall act as a limitation on the Village Board’s authority to remove, at its pleasure, any member of a committee, commission, or board.
(9) 
Appointments.
(a) 
Except as otherwise provided by this chapter, Village ordinance, or Wisconsin Statute, appointments to standing, special or ad hoc Village committees, commissions, or boards, shall be made by the Village President subject to confirmation by the Village Board.
(b) 
Unless specified otherwise, the chairperson of any committee, commission, or board, shall be appointed by the Village President, subject to confirmation by the Village Board.
(c) 
The Village President may, subject to confirmation by the Village Board, appoint any Village Board member to serve as an alternate member(s) of any standing, special, or ad hoc committee, commission, or board when the regular appointee is not able to attend.
1. 
In the event the position of Village President is vacant, as defined by the Wisconsin Statutes, for a period of more than thirty (30) days, the President Pro-Tem may appoint a Trustee to serve as an alternate member of any standing, special, or ad hoc committee, commission, or board when the regular appointee cannot attend.
(d) 
Any alternate appointed pursuant to this subsection:
1. 
May receive an appointment limited to a specific meeting or a specified period of time; and
2. 
Shall have full voting authority.
(10) 
Filling vacancies.
(a) 
In the event the position of Village President is vacant for a period of more than thirty (30) days, the President Pro-Tem may appoint a Trustee or citizen for a vacant position on any standing, special, or ad hoc committee, commission, or board, by submitting a request in writing to have the nominee’s name placed on an agenda for consideration at an upcoming Village Board meeting.
(b) 
In the event any citizen position on a standing, special or ad hoc committee, commission, or board remains vacant for a period exceeding sixty (60) days, any Village Trustee may nominate an eligible Village resident for the vacant position by submitting a request in writing to the Village Clerk to have the nominee’s name placed on an agenda for consideration at an upcoming Village Board meeting.
(c) 
If, after a vacancy has existed for ninety (90) days and the Village President nor any Village Trustee has proposed a suitable nominee who is also a Village resident, the Village Board may consider the nomination of a qualified resident of the Belleville School District.
(d) 
Any nomination pursuant to Section 3.01(10)(a) or (b) shall be made by the Village President submitting a request in writing to the Village Clerk to have the nominee’s name placed on an agenda for consideration at an upcoming Village Board meeting. The Village Board may determine what background information, if any, shall be provided to support the nomination.
(1) 
Composition. The Village Arts & Cultural Committee shall consist of five (5) members, of whom, unless there is a vacancy, at least four (4) members shall be citizen members who are not Village officials.
(2) 
Appointment.
(a) 
Trustee members. Unless the Village Board determines otherwise, trustee members shall be appointed annually at the Village Board's organizational meeting.
(b) 
Citizen members. Citizen members shall be appointed for staggered terms of two (2) years. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member, a successor shall serve for the unexpired term.
(3) 
Purpose. The Arts and Cultural Committee may make recommendations to the Village Board regarding:
(a) 
Preservation and enrichment of the character of the community.
(b) 
Celebrating cultural history and heritage.
(c) 
Broadening the role of arts in the community.
(d) 
Fostering artistic creativity and artistic economy in the community.
(e) 
Facilitating recurring and new creative, cultural, and community events and ideas that will enhance the creative momentum and community spirit that already exists in Belleville.
(1) 
Composition. The Economic Development & Tourism Committee of the Village of Belleville shall be comprised of two (2) Village Trustees and eight (8) other members.
(2) 
Appointment.
(a) 
Trustee members. Unless the Village Board determines otherwise, the Trustee members shall be annually appointed by a majority vote at the Village Board's organizational meeting.
(b) 
Citizen members. Citizen members shall be appointed for staggered terms of two (2) years, subject to Village Board approval. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member position, a successor shall serve for the unexpired term.
(3) 
Purpose.
(a) 
To lead and coordinate economic development initiatives in conjunction with the Village of Belleville.
(b) 
To attract new businesses to the Village of Belleville.
(c) 
To work with existing businesses and local business organizations in the Village of Belleville to help in their growth and expansion through funding, technical, advisory, and infrastructure programs available to the Village of Belleville.
(d) 
To cooperate with economic development agencies and organizations to improve the economic development efforts in the Belleville area.
(e) 
To pursue grants, agency funding, and contributions that benefit the Village of Belleville.
(f) 
To promote enhancements that improve the Belleville area.
(g) 
To work with the Village Board and Village staff to create economic opportunities in the Village of Belleville.
(h) 
To communicate the importance and benefits of development in all businesses, outside governmental sectors, and citizens in the Village of Belleville.
(i) 
To administer the Village’s Room Tax program.
(j) 
To promote Belleville on a regional, statewide, and national level.
(1) 
Composition. The Emergency Management Committee shall consist of five (5) members, of whom, unless there is a vacancy, at least three (3) members, shall be citizen members who are not Village officials.
(2) 
Appointment.
(a) 
Chairperson. The Chairperson shall be a Village Trustee appointed for a one (1) year term.
(b) 
Trustee members. Unless the Village Board determines otherwise, trustee members shall be annually appointed at the Village Board's organizational meeting.
(c) 
Citizen members. Citizen members shall be appointed for staggered terms of two (2) years. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member, a successor shall serve for the unexpired term.
(3) 
Duties.
(a) 
The Emergency Management Committee shall develop and promulgate emergency management plans consistent with the state plans, direct the Village's emergency management program, and perform such other duties related to emergency management as are required by the Village Board.
(b) 
The Emergency Management Committee shall direct local emergency management training programs and exercises, direct participation in emergency programs and exercises ordered by the county head of emergency management services, advise the county head of emergency management services on local emergency management programs, and submit to him/her such reports as he/she requires.
(c) 
During the continuance of a state of emergency proclaimed by the Governor, the Emergency Management Committee Chairperson, on behalf of the Village, may contract with any person to provide equipment and services on a cost basis for disaster relief.
(d) 
The Emergency Management Committee becomes the Emergency Operations Center (EOC) during a declared emergency. The EOC is the central command and control system responsible for carrying out the principles of emergency preparedness and emergency management, or disaster management, at a strategic level during an emergency and ensuring the continuity of operations of the Village.
(4) 
Emergency management plan. The Emergency Management Committee shall prepare a comprehensive emergency program for the Village and shall present such plan to the Village Board for its approval. When the Village Board has approved the plan, the Emergency Management Committee shall utilize the services, equipment, supplies and facilities of the Village to the maximum extent practicable in satisfying the objectives of the plan.
(5) 
Emergency orders and regulations. Whenever necessary to meet an emergency for which adequate regulations have not been adopted by the Village Board, the Village President and, in his or her absence, the Chairperson of the Emergency Management Committee and, in his or her absence, the Committee Vice Chairperson and, in his or her absence, the Village Board President Pro-Tem may by proclamation promulgate and enforce such orders, rules and regulations relating to the conduct of persons and the use of property as shall be necessary to protect the public peace, health and safety and preserve lives and property and to ensure the cooperation necessary to emergency plan activities. Such proclamations shall be posted in three public places and may be rescinded by the Village Board by resolution at any time.
(6) 
Disaster warnings and alerts.
(a) 
Upon the declaration of a state of emergency by the Governor, by the Village President or, in the absence of the Village President, by the Emergency Management Committee Chairperson, the Emergency Management Committee Chairperson shall issue all necessary proclamations as to the existence of such state of emergency and shall issue such disaster warnings or alerts as shall be required in the emergency plan.
(b) 
The Emergency Management Committee shall act in accordance with the emergency plan after the declaration of an emergency or the issuance of disaster/emergency warnings. Such state of emergency shall continue until terminated by the issuing authority, provided that any such declaration not issued by the Governor may be terminated at the discretion of the Village Board or the Emergency Management Committee.
(7) 
Obstruction of emergency response activity. Any person who shall willfully obstruct, hinder or delay any member of the Emergency Management Committee in the enforcement of any order, rule, regulation, or plan issued pursuant to this chapter, or do any act forbidden by any order, rule, regulation, or plan issued pursuant to this chapter, shall be subject to a penalty as provided Section 1.09 of this Code.
(8) 
Adoption of National Incident Management System (NIMS).
(a) 
The President in Homeland Security Directive (HSPD) 5 directed the Secretary of the Department of Homeland Security to develop and administer a National Incident Management System (NIMS) which would provide a consistent nationwide approach for federal, state, local, and tribal governments to work together more effectively and efficiently to prevent, prepare for, respond to and recover from domestic incidents, regardless of cause, size or complexity.
(b) 
To facilitate the most efficient and effective incident management it is critical that federal, state, local, and tribal organizations utilize standardized terminology, standardized organizational structures, interoperable communications, consolidated action plans, unified command structures, uniform personnel qualification standards, uniform standards for planning, training, and exercising, comprehensive resource management, and designated incident facilities during emergencies or disasters.
(c) 
The Village Board establishes the National Incident Management System (NIMS) as the Village standard for incident management, which will standardize procedures for managing personnel, communications, facilities and resources along with improving the Village's ability to utilize federal funding to enhance local readiness, maintain first responder safety, and streamline incident management processes.
(1) 
Composition. The Finance and Governance Committee shall consist of five (5) members, of whom, unless there is a vacancy, at least two (2) members shall be citizen members who are not Village officials.
(2) 
Appointment.
(a) 
Chairperson. The Chairperson shall be a Village Trustee and, unless the Village Board determines otherwise, shall be appointed annually at the Village Board's organizational meeting.
(b) 
Trustee members. Unless the Village Board determines otherwise, Trustee members shall be appointed annually at the Village Board's organizational meeting.
(c) 
Citizen members. Citizen members shall be appointed annually and serve a one (1) year term. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member, a successor shall serve for the unexpired term.
(3) 
Duties. The Finance and Governance Committee provides recommendations to the Village Board for the following Village operations:
(a) 
Rules for committees, commissions, and boards.
(b) 
Administrative processes and procedures.
(c) 
Budgeting and financial planning.
(d) 
Communications and public relations.
(e) 
Personnel management.
(f) 
Food Pantry processes and procedures.
(g) 
Information Technology.
(1) 
Composition. The Parks, Recreation, and Forestry Committee shall consist of seven (7) members, of whom, two (2) of which shall be Village Trustees and five (5) of which shall be citizen members.
(2) 
Appointment.
(a) 
Chairperson. The Chairperson shall be a Village Trustee and, unless the Village Board determines otherwise, shall be appointed annually at the Village Board's organizational meeting.
(b) 
Trustee members. Unless the Village Board determines otherwise, trustee members shall be appointed annually at the Village Board's organizational meeting.
(c) 
Citizen members. Citizen members shall be appointed annually for two (2) year terms. All citizen members shall hold office until their respective successors are appointed. Whenever a vacancy occurs for any citizen member, a successor shall serve for the unexpired term.
(3) 
Duties.
(a) 
Parks and waterways.
1. 
To create and develop a short and long-term plan and budget for the creation, development, and acceptance of parkland or the purchase of parkland and/or the development of recreational trails.
2. 
To develop criteria by which the Committee, the Public Works & Properties Committee, and the Village Board can determine if parkland, waterways, recreational trails, or passive parkland is acceptable. These criteria shall be in written form, which shall be provided to each developer, citizen, or interested individual for use in proposing the development of acceptance of or purchase of parkland or recreational trails.
3. 
To maintain an inventory of the parks and their usage and to determine if the needs of the neighborhood within which the park or recreational trial is located are being met.
4. 
To create and develop a plan with an associated budget for maintaining the existing park areas, waterways, and recreational trails within the Village.
5. 
To create and develop a capital improvement plan/budget for upgrading, replacing and adding to existing park and recreational facilities, equipment and/or recreational trails within the Village.
6. 
To research and apply for and seek alternate funding sources such as grants, donations, and bequeaths.
7. 
To identify projects which will require fund-raising activities and organize fundraising activities.
(b) 
Recreation.
1. 
To develop working relationships with other educational facilities, schools, and colleges to provide programs for the community.
2. 
To work with the Public Works, Properties, and Utility Committee and community organizations, to develop and maintain recreational education and leisure areas.
(c) 
Forestry.
1. 
To serve in an advisory capacity to the Village Board relating to trees and shrubs located within street right-of-way, parks, cemeteries, and other public places in the Village, and to trees and shrubs located on private property that constitute a hazard, threat, or nuisance as described herein.
2. 
To prepare and maintain an inventory of trees located on public lands.
3. 
To prepare and recommend to the Village Board a plan for the planting, care and maintenance of trees in the Village, including the number, species and location.
4. 
To identify, improve and promote desirable plant species.
5. 
To apply for county, state, federal and private grant moneys for the preparation and implementation of the Village’s trees and natural area program upon approval of the Village Board.
6. 
To recommend such persons or firms who are qualified in urban forestry to assist in the development of urban forestry and natural area management for the Village.
7. 
To conduct Arbor Day observance and ceremonies annually.
8. 
Inform and educate Village citizens about the care of natural areas in their neighborhoods.
(1) 
Composition. The Public Safety Committee shall consist of five (5) members, of whom, unless there is a vacancy, at least two (2) members shall be citizen members who are not Village officials.
(2) 
Appointment.
(a) 
Chairperson. The Chairperson of the Committee shall be a Village Trustee and shall, unless the Village Board determines otherwise, be appointed at the Village Board's organizational meeting.
(b) 
Trustee members. Unless the Village Board determines otherwise, trustee members shall be appointed annually at the Village Board's organizational meeting.
(c) 
Citizen members. Citizen members shall be appointed annually. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member, a successor shall serve for the unexpired term.
(3) 
Duties.
(a) 
Oversee the general operations and management of the Police Department.
(b) 
Contract and purchase all necessary apparatus and supplies for the use of the Department expressly delegated to the Chief through a motion, resolution or procurement policy specifically adopted by the Committee.
(c) 
Audit all bills, claims, and expenses of the Department except where expressly delegated to the Chief through a motion, resolution, or procurement policy specifically adopted by the Committee.
(d) 
Providing recommendations to the Village Board regarding issues related to traffic control and general public safety.
(e) 
Reviewing and advising the Village Board on alcohol license applications, renewals and amendments upon request of the Village Board or Village Clerk.
(f) 
Addressing and making recommendations to the Village Board on alcohol regulation, licensing, and enforcement issues upon request of the Village Board or Village Clerk.
(g) 
Providing research for interpreting and developing alcohol-related ordinances and policies.
(h) 
Conducting hearings and making recommendations for any alcohol license suspension, revocation, or non-renewal proceedings.
(i) 
None of the functions and powers in this section shall be construed to include powers for a Board of Police Commissioners in Section 62.13(3), (4)(a), (5) and (7), Wis. Stats., including but not limited to hiring, firing, disciplining or promotion of personnel, nor shall the Committee conduct any hearing or other quasi-judicial proceeding.
(1) 
Composition. The Public Works, Properties, and Utilities Committee shall consist of five (5) members, of whom, unless there is a vacancy, at least two (2) members shall be citizen members who are not Village officials.
(2) 
Appointment.
(a) 
Chairperson. The Chairperson shall be a Village Trustee and, unless the Village Board determines otherwise, shall be appointed annually at the Village Board's organizational meeting.
(b) 
Trustee members. Unless the Village Board determines otherwise, Trustee members shall be appointed annually at the Village Board's organizational meeting.
(3) 
Citizen members. Citizen members shall be appointed annually for one (1) year terms. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member, an appointed successor shall serve for the unexpired term.
(4) 
Duties.
(a) 
Public works.
1. 
Oversee the general operations and management of the Public Works and Utilities Department.
2. 
Recommending a five (5)-year capital improvement plan for Village Infrastructure.
3. 
Provide recommendations for construction and maintenance of streets, sidewalks, gutters, storm sewers, retention ponds, stormwater drainage, and other public projects.
4. 
Review and recommend updates, additions, and deletions to the Comprehensive Plan to the Village Plan Commission.
5. 
Review and recommend to the Village Board all budgetary, revenue and expenditure proposals related to public works projects.
6. 
Provide recommendations for recycling and garbage collection, and collection of leaves and brush.
7. 
Promote and protect public health, safety, and welfare by monitoring and developing a program for the management and maintenance of environmental corridors to include greenways, detention basins, wetlands, and plant communities in publicly owned natural areas, or dedicated property areas within Village boundaries.
(b) 
Properties.
1. 
Maintenance of public facilities and properties owned by the Village.
2. 
Review and recommend to the Village Board all budgetary, revenue, and expenditure proposals related to village facilities and properties.
3. 
Maintenance of public parks, recreational trails, and facilities located within the parks.
4. 
Review the criteria and recommendations provided by the Parks, Recreation, and Forestry Committee in determining parkland dedication to the Village, subject to approval by the Village Board.
5. 
Assist in preparing the short-term and long-term capital plans for the parks and/or trail systems located within the Village.
(1) 
Composition. The Board of Review of the Village of Belleville shall be composed of the Village President, the Village Clerk, and the Village Trustees. The Village Clerk shall serve as the Clerk of the Board of Review. The Assessor shall attend all meetings of the Board of Review but shall not vote.
(2) 
Duties. The duties and functions of the Board of Review shall be prescribed in Sections 70.46 and 70.47, Wis. Stats.
(a) 
Meetings. In accordance with Section 70.47(3)(b), Wis. Stats., the Village Board does hereby exercise the right to designate hours for the annual Board of Review proceedings other than those set forth in Section 70.47(3)(b), Wis. Stats., and shall designate the hours of the annual Board of Review by separate resolution. The Board of Review may adjourn from day to day or from time to time until such time as its business is completed, provided that adequate notice of each adjournment is so given.
(b) 
Objections to valuations to be written. No person shall be permitted to appear and make objection before the Board of Review of the Village of Belleville to the amount of valuation of any property unless objection thereto shall first have been made in writing and filed with the Village Clerk forty-eight (48) hours prior to the Board of Review’s first meeting following completion of the assessment roll.
(1) 
Creation and purpose. The Community Development Authority (CDA) for the Village of Belleville is hereby created pursuant to Section 66.1335, Wis. Stats.
(2) 
Composition. The Community Development Authority shall consist of seven (7) members, of whom, unless there is a vacancy, two (2) members shall be Village Trustees. These members will have sufficient ability and experience in the fields of urban renewal, community development, and housing, as commissioners of the authority. The appointments shall be subject to confirmation by the Village Board. The Authority shall annually elect the chairperson and vice-chairperson from among the appointed commissioners.
(3) 
Duties.
(a) 
The CDA shall be a separate body politic for the purpose of carrying out qualified redevelopment projects and shall have all powers, duties, and functions of community development authorities contained in Section 66.1335, Wis. Stats., as amended from time to time.
(b) 
The authority shall also act as the agent of the Village in planning and carrying out community development programs and activities approved by the Village Board under the Federal Housing and Community Development Act of 1974.
(c) 
Under Wisconsin Statutes and its own bylaws, the CDA will undertake programs and projects for blight elimination and prevention, slum clearance and prevention, urban renewal and redevelopment, and community development and redevelopment (collectively "qualified redevelopment projects").
(d) 
Encourage well-planned, integrated, stable, safe and healthful neighborhoods, the provisions of healthful homes, a decent living environment, adequate places of employment for the peoples of the Village and an increase in the general property tax base of the Village.
(e) 
The CDA must seek the approval of the Village Board prior to entering into any project, agreement or contract which would cause for the issuance of debt.
(4) 
Agenda. The Executive Director shall prepare the agenda with direction from the Chairperson. Community Development Authority Commissioners may submit an agenda item(s) with at least ten (10) days’ notice in advance of the scheduled meeting.
(1) 
Composition. The Library Board for the Village shall consist of five (5) members. Unless there is a vacancy, membership shall consist of one (1) Village Trustee and four (4) citizen members.
(2) 
Appointment. The Village President may appoint himself or herself to the Library Board or may appoint other elected or appointed officials, except that the Library Board, unless there is a vacancy, shall always have at least four (4) citizen members who are not elected Village Officials.
(a) 
Trustee members. The Trustee members shall be appointed annually, unless the Village Board determines otherwise, at the Village Board's organizational meeting.
(b) 
Citizen members. Citizen members shall serve for a term of three years. The Village President shall appoint one of the Library Board members as the school district administrator or his or her representative to represent the public school district or districts in which the library is located. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member, a successor shall serve for the remainder of the unexpired term.
(3) 
Records. The Library Board shall keep a written record of its proceedings, including all actions taken, a copy of which shall be filed with the Village Clerk.
(4) 
Duties. The Library Board shall have the duties and powers as prescribed by Chapter 43, Wis. Stats., and more particularly set forth in Section 43.58, Wis. Stats.
(1) 
Composition. The Plan Commission of the Village of Belleville shall consist of seven (7) members, of whom, unless there is a vacancy, at least four (4) members shall be citizen members who are not Village Officials.
(2) 
Appointment. The Village President may appoint himself or herself to the Commission and may appoint other elected or appointed officials.
(a) 
Trustee members. The Trustee members shall be appointed annually, unless the Village Board determines otherwise, at the Village Board's organizational meeting.
(b) 
Citizen members. Citizen members shall be appointed for staggered terms of three (3) years. All citizen members shall hold office until their respective successors are selected. Whenever a vacancy occurs for any citizen member, a successor shall serve for the unexpired term.
(3) 
Duties.
(a) 
The Comprehensive Plan.
1. 
The Plan Commission shall make, adopt and, as necessary, amend, extend or add to the Comprehensive Plan, subject to Village Board approval, for the physical development of the Village, including areas outside of Village boundaries which, in the Plan Commission's judgment, bear relation to the development of the Village. The Comprehensive Plan, with the accompanying maps, plats and descriptive and explanatory matter, shall show the Commission's recommendations for such physical development and may include, among other things, without limitation because of enumeration, the general location, character and extent of streets, highways, freeways, street grades, roadways, walks, parking areas, public places and areas, parks, parkways, playgrounds, sites for public buildings and structures, and the general location and extent of sewers, water conduits and other public utilities, whether privately or publicly owned, the acceptance, widening, narrowing, extension, relocation, removal, vacation, abandonment or change of use of any of the foregoing public ways, grounds, places, spaces, buildings, properties, utilities, routes or terminals, the general location, character and extent of community centers and neighborhood units, and a comprehensive zoning plan.
2. 
The Commission may, subject to Village Board approval, adopt the Comprehensive Plan by a single resolution or, as the work of making the whole Comprehensive Plan progresses, may from time to time by resolution adopt a part or parts thereof, any such part to correspond generally with one or more of the functional subdivisions of the subject matter of the plan. The resolution shall refer expressly to the maps, descriptive matter, and other matters intended by the Commission to form the whole or any part of the plan, and the action taken shall be recorded on the adopted plan or part thereof by the identifying signature of the Secretary of the Commission, and a copy of the plan or part thereof shall be certified to the Village Board. The purpose and effect of adopting and certifying the Comprehensive Plan or part thereof shall be solely to aid the Plan Commission and the Village Board in performing their duties.
(b) 
Matters referred to the Plan Commission. The Village Board or officer of the Village having authority thereon shall refer to the Plan Commission, for its consideration and report before final action is taken by the Village Board, public body or officer, the following matters:
1. 
The location and architectural design of any public building.
2. 
The location of any statue or other memorial.
3. 
The location, acceptance, extension, alteration, vacation, abandonment, change of use, sale, acquisition of land for or lease of land for any street, alley or other public ways, park, playground, airport, area for parking vehicles, or other memorial or public grounds.
4. 
The location, extension, abandonment or authorization for any public utility whether publicly or privately owned.
5. 
All plats of lands or certified survey maps in the Village or within the territory over which the Village is given platting jurisdiction by Chapter 236, Wis. Stats.
6. 
The location, character and extent or acquisition, leasing or sale of lands for public or semipublic housing, slum clearance, relief of congestion, or vacation camps for children.
7. 
Amendments to the Village zoning ordinances.
8. 
Amendments to the Village’s land division ordinance.
(c) 
If the Plan Commission does not make a report within forty-five (45) days of a matter being referred to it, or such longer period as may be stipulated by the Village Board, the Village Board or other public body or officer may take final action without Plan Commission action.
(d) 
The Village of Belleville, in complying with the Americans with Disabilities Act (ADA), 42 U.S.C. § 12101, has developed a plan by which access to all Village programs, facilities, services and employment is guaranteed to all citizens. A transition plan has been adopted by the Village Board and is available from the Village Clerk.
1. 
The Director of Public Works or their designee shall serve as the Americans with Disabilities Act Coordinator and shall accept all grievances filed with respect to the Americans with Disabilities Act and make decision thereon in consultation with the Village Attorney within thirty (30) days of the filing of such grievance. Such decision may be appealed to the Village President in accordance with the procedure established in this Chapter.
(e) 
Miscellaneous powers. The Commission may make reports and recommendations relating to the plan and development of the Village to public officials and agencies, public utility companies, civic, educational, professional and other organizations and citizens. It may recommend to the Village Board programs for public improvements and the financing thereof. The Commission, its members and employees, in the performance of its functions, may enter upon any land, make examinations and surveys, and place and maintain necessary monuments and markers thereon. In general, the Commission shall have such powers as may be necessary to enable it to perform its functions and promote municipal planning.
(4) 
Agenda. All matters to be considered at a Commission meeting or hearing shall be filed with the Village Clerk a minimum of ten (10) days prior to the Plan Commission meeting. Matters filed less than ten (10) days before the Commission's meeting may not be placed on the agenda for that meeting. Matters requiring a public hearing shall be filed with the Village Clerk a minimum of thirty (30) days prior to the public hearing.
(1) 
Establishment. A Zoning Board of Appeals shall be appointed and governed by the state zoning enabling law as contained in Section 62.23, Wis. Stats., the Village Zoning Code and ordinances, and this section. The laws of the state or Village and local ordinances shall prevail in that order.
(2) 
Composition. The Zoning Board of Appeals shall consist of five (5) citizen members and two (2) alternate members for a three (3)-year term of office. The Village President shall designate one (1) of the members Chairperson.
(3) 
Duties.
(a) 
To hear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by an administrative official in the enforcement of any Village Zoning Code or any ordinance adopted under Section 62.23, 61.35 or 62.231 (wetlands), Section 87.30 or 281.31 (floodplains), or Chapter 91 (farmland preservation), Wis. Stats.
(b) 
To authorize, upon appeal in specific cases, area or use variances from the terms of the Village zoning regulations as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement will result in unnecessary hardship, as defined by Wisconsin law, so that the spirit of the Zoning Code shall be observed, public safety and welfare secured and substantial justice done. Any use variance granted shall be limited to the specific use described in the decision of the Zoning Board of Appeals and shall not permit variances in yard, area or other requirements of the district in which located.
(c) 
The Zoning Board of Appeals may reverse or affirm, wholly or in part, or may modify any order, requirement, decision or determination appealed from and may make such order, requirement, decision or determination as in its opinion ought to be made. If a quorum is present, the Zoning Board of Appeals may act by a majority vote of the members present. The grounds of every such determination shall be stated and recorded. No order of the Zoning Board of Appeals granting a variance shall be valid for a period longer than six (6) months from the date of such order unless the zoning permit is obtained within such period and the erection or alteration of a building is started or the use is commenced within such period.
(4) 
Meeting and rules.
(a) 
All meetings and hearings of the Zoning Board of Appeals shall be open to the public, except that the Zoning Board of Appeals may go into closed session to deliberate after a hearing or an appeal. The final vote on an appeal shall be taken in open session by roll call vote, recorded and open for public inspection in the office of the Zoning Board of Appeals. Public notice of all regular and special meetings shall be given to the public and news media as required by the Wisconsin Open Meeting Law.
(b) 
Special meetings may be called by the Chairperson or by the Secretary at the request of two (2) members. Notice of a special meeting shall be mailed to each member at least forty-eight (48) hours prior to the time set for the meeting, or announcement of the meeting shall be made at any meeting at which all members are present.
(c) 
Hearings may be held at any regular or special meetings at the time set by the Chairperson.
(d) 
The Zoning Board of Appeals shall keep minutes of its proceedings, showing the vote of each member upon each question or, if absent or failing to vote, indicating such fact and shall keep records of its examinations and other official actions, all of which shall be immediately filed in the office of the Village Clerk and shall be public record. The Zoning Board of Appeals shall adopt its own rules of procedure not in conflict with this Code or with the applicable Wisconsin Statutes.
(e) 
No Zoning Board of Appeals member shall participate in the decision of or vote upon any case in which the member is financially interested, directly or indirectly, but the Chairperson shall direct an alternate member to act instead. Disqualification of a member for interest shall not decrease the number of votes required for acting upon any matter, but such member may be counted in determining whether a quorum is present for the transaction of business.
(5) 
Offices. The Village Board shall provide suitable offices for holding hearings and the preservation of records, documents, and accounts.
(6) 
Failure to Comply. Notwithstanding any other provision of this section, and in addition to any other remedies allowed by law or elsewhere in this Code, any person, firm, or corporation who or which fails to comply with any order, decision, determination, condition or variance issued pursuant to this section shall be subject to the violation, remedial action and penalty provisions of Section 16.160 of this code.
(1) 
Establishment and composition. The Police Commission shall consist of five (5) citizens who are residents of the Village, three (3) of whom shall constitute a quorum. The Commission shall keep record of its proceedings. The appointments to the Police Commission will be made in full compliance with Section 62.13, Wis. Stats. The Commission does not possess “optional powers” as defined by Section 62.13(6), Wis. Stats.
(2) 
Scope of authority.
(a) 
The Commission shall appoint a Chief of the Police Department, who shall hold office during good behavior, subject to suspension or removal by the Commission for cause. The Chief shall appoint subordinates subject to the approval of the Commission in compliance with Section 62.13(4), Wis. Stats.
(b) 
The Commission shall have such powers as provided in Section 62.13, Wis. Stats., with the exception of the optional powers provided in Section 62.13(6), Wis. Stats.
(c) 
Adopt policies for the conduct of Commission business within its scope of authority.
(d) 
Adopt rules of procedure and selection criteria for Police Officers, including their qualifications, providing those qualifications do not conflict with and meet or exceed those qualifications established by state statute or administrative rule.
(e) 
Adopt rules of procedure and selection criteria for promotion within the department including qualifications, provided those qualifications do not conflict with and meet or exceed those qualifications that may be established in state statute or administrative rule.
(f) 
Review and act on disciplinary charges concerning the conduct of and discipline imposed on Police Officers involving suspensions, reductions in rank, and removals, as permitted by law.
(g) 
Authorize reductions in salaries of subordinates and the Chief of the Police Department in the event the Village Board directs the reduction in salaries of personnel.
(h) 
Exercise other and all powers conferred upon the Commission by the Wisconsin Statutes or the Village Ordinances.
(1) 
Establishment and composition. The Utilities Board shall be composed of five (5) voting members consisting of the Village President, two (2) Village Trustees, and two (2) resident members all of whom shall be appointed by the Village President and confirmed by a majority vote of the Village Board.
(a) 
Each member’s term shall begin on October 1 of the year elected and each term shall be for five (5) years, except the initial members whose terms shall expire successively one (1) each year on each succeeding first day of October.
(b) 
The Village Board shall, at its regular meeting on the third Monday in September of each election year, elect one (1) member of the Utility Board to fill the expiring term.
(c) 
At its inaugural meeting, the Board shall appoint one (1) member as president and one (1) member as secretary. Following the expiration of the term of the member serving as the president or secretary, the Board shall appoint a president or secretary at its first meeting following the Village Board’s election of a member to fill the expiring term.
(2) 
Meetings. The Utility Board shall establish a schedule of meetings as necessary to carry out the business of the public utilities. Special meetings may be held as required following appropriate notice. The Board may adopt rules for the conduct of its meetings. No action shall be taken by the Board except by the affirmative vote of at least three (3) members, which shall constitute a quorum.
(3) 
Powers and duties. Except otherwise provided in this chapter, the Utilities Board shall be responsible for the entire management of and shall supervise the operation of the Water, Sewer, and Stormwater Utilities of the Village. The duties of the Utility Board shall include:
(a) 
Recommending utility ordinance amendments;
(b) 
Implementing operational policies and procedures for utility operations and administration;
(c) 
Refining development plans;
(d) 
Reviewing and making recommendations on proposed improvements, additions, extensions, or changes to facilities;
(e) 
Discussing issues of safety, function, maintenance needs, and general operation and administration;
(f) 
Planning for the effectuation of plant and infrastructure improvements;
(g) 
Other planning the Board deems necessary and essential for the improvements of the plant and infrastructure; and
(h) 
The Village Board has delegated its authority to establish utility rates as prescribed by State Statutes and administrative rules to the Utility Board. The Utility Board shall have full authority over setting utility rates and fees. The Village Board may reclaim that right at any time by amendment to this ordinance.
(4) 
Employees. The Board may make recommendations to the Village Board regarding management and staffing but does not directly affect employment matters. The Village Engineer may be engaged by the Board.
(5) 
Construction work. The Board shall immediately supervise any utility construction work. Notwithstanding the foregoing, any construction exceeding the sum of $50,000.00 shall be reviewed by the Public Works & Properties Committee and must be approved by the Village Board. No sewer or water extensions beyond Village limits are permitted unless specifically authorized by the Village Board.
(6) 
Finances. The Village Finance Director/Treasurer shall be responsible for collecting all receipts payable to all Village Utilities. Utility expenditures shall be presented to the Board monthly. All Village Utilities shall be audited on an annual basis.
(1) 
Establishment. A Committee of the Whole is hereby established in the Village of Belleville and is subject to the same noticing requirements and exemptions as outlined in Section 19.85, Wis. Stats.
(2) 
Composition and appointment. The Committee of the Whole shall be composed of the seven (7) members of the Village Board. The Chairing member of this committee shall be the President Pro-Tempore.
(3) 
Meetings. The Committee of the Whole shall establish a schedule of meetings as necessary to carry out the business of the Village. Special meetings may be held as required following appropriate notice.
(4) 
Powers and duties. Except otherwise provided in this chapter, the Committee of the Whole shall act as a workgroup of the Board to provide for the following:
(a) 
Listen and respond to resident questions and concerns;
(b) 
Acts as the starting point for village policy and strategy discussions;
(c) 
Reviews presentations by businesses, groups, or other government agencies;
(d) 
Discuss items that require action by one (1) or more standing committee(s);
(e) 
Discuss items that are not specifically delegated to other standing committees;
(f) 
Receives reports from the committees, commissions, and boards of the Village;
(g) 
Receives reports and information from all Village officials and departments.
(h) 
Other items as may be referred by Village staff, Village Board, or other standing committees, commissions or boards.
