(1) 
General powers. Officers shall generally have the powers and duties prescribed for like officers of towns and villages, except as otherwise provided, and such powers and duties as are prescribed by law and, except as to the Village President, shall perform such duties as shall be required of them by the Village Board. Officers whose powers and duties are not enumerated in Chapter 61, Wis. Stats., shall have such powers and duties as are prescribed by law for like officers or as directed by the Village Board.
(2) 
Rules. All officers and departments may make the necessary rules for the conduct of their duties and incidental proceedings.
(3) 
Applicability of Ethics Statutes. The general laws for the punishment of bribery, misdemeanors and corruption in office shall apply to all Village officers. (See also Section 4.22, Ethics).
(4) 
Legal representation. Whenever a Village official in their official capacity is proceeded against or obliged to proceed before any civil court, board or commission to defend or maintain their official position, or because of some act arising out of the performance of their official duties, and they have prevailed in such proceedings, or the Village Board has ordered the proceedings discontinued, the Village Board may provide for payment to such official such sum as it sees fit, to reimburse the official for the expenses reasonably incurred for costs and attorney fees.
(1) 
The Village officials hereinafter shall be appointed by the Village Board. One (1) or more of said offices may be held by the same person. Persons appointed to perform the duties of the following offices shall hold office for an indefinite term, subject to removal as provided by Section 17.13, Wis. Stats.
(a) 
Village Administrator.
(b) 
Village Clerk.
(c) 
Finance Director/Treasurer.
(d) 
Director of Public Works.
(e) 
Zoning Administrator.
(f) 
Building Inspector.
(g) 
Village Assessor.
(h) 
Chief of Police.
(i) 
Village Attorney.
(j) 
Village Engineer.
(2) 
All confirmation votes by the Village Board shall be by simple majority vote of all members of the Village Board unless otherwise stated in Wisconsin State Statutes.
(1) 
Office created. To provide the Village of Belleville with a more efficient, effective, and responsible government under a system of a part-time President and part-time Village Board (hereinafter referred to as "Board") at a time when Village government is becoming increasingly complex, there is hereby created the office of Village Administrator for the Village of Belleville (hereinafter referred to as "Administrator").
(2) 
Functions and duties of the Administrator. The Administrator, under the direction of the Village Board, shall be charged with the following powers and duties:
(3) 
General duties. The Administrator shall:
(a) 
Carry out directives of the President and Board which require administrative implementation.
(b) 
Be responsible for the administration of all day-to-day operations of the Village government, including the monitoring of all Village ordinances, resolutions, Board meeting minutes and state statutes.
(c) 
Establish when necessary administrative procedures to increase the effectiveness and efficiency of Village government according to current practices in local government, consistent with Village ordinances, resolutions, and directives of the President and Village Board.
(d) 
Serve as ex officio nonvoting member of all boards, commissions, and committees of the Village, except as specified by the Village Board or Wisconsin Statutes.
(e) 
Keep informed concerning current federal, state, and county legislation and administrative rules affecting the Village and submit appropriate reports and recommendations thereon to the Village Board.
(f) 
Keep informed concerning the availability of federal, state and county funds for local programs and assist department heads and the Village Board in obtaining these funds under the direction of the President and the Village Board.
(g) 
Represent the Village in matters involving legislative and intergovernmental affairs as authorized and directed as to that representation by the President and Village Board.
(h) 
Act as public information officer for the Village with the responsibility of assuring that the news media are kept informed about the operations of the Village and that all open meeting rules and regulations are followed.
(i) 
Establish and maintain procedures to facilitate communications between citizens and Village government to assure that complaints, grievances, recommendations, and other matters receive prompt attention by the responsible official and to assure that all such matters are expeditiously resolved.
(j) 
Promote the economic well-being and growth of the Village through public and private sector cooperation.
(4) 
Responsibilities to the Village Board.
(a) 
The Administrator shall:
1. 
Attend all meetings of the Village Board, assisting the President and the Village Board as required in the performance of their duties.
2. 
In coordination with the President and the Village Board, ensure that appropriate agendas are prepared for all meetings of the Village Board, all standing committees, and all other appropriate committees and commissions of the Village, together with such supporting material as may be required, with nothing herein being construed as to give the Administrator authority to limit or in any way prevent matters from being considered by the Village Board or any of its committees and commissions.
3. 
Assist in the preparation of ordinances and resolutions as requested by the President or the Village Board, or as needed.
4. 
Keep the President and Village Board regularly informed about the activities of the Administrator's office by oral or written report at regular and special meetings of the Village Board.
(b) 
If action normally requiring Village Board approval is necessary at a time when the Village Board cannot meet, the Administrator may carry out lawful directives from the President.
(5) 
Personnel. The Administrator shall:
(a) 
Be responsible for the administrative direction and coordination of all employees of the Village according to the established organization procedures.
(b) 
Recommend to the Village Board the appointment, promotion, and, when necessary for the good of the Village, the suspension or termination of department heads.
(c) 
In consultation with the appropriate department head, be responsible for the appointment, promotion, and, when necessary for the good of the Village, the suspension or termination of employees below the department head level.
(d) 
Serve as personnel officer for the Village with responsibilities to see that complete and current personnel records, including specific job descriptions, for all Village employees are kept; evaluate in conjunction with department heads the performance of all employees on a regular basis; recommend salary and wage scales for Village employees not covered by collective bargaining agreements; develop and enforce high standards of performance by Village employees; assure that Village employees have proper working conditions; and work closely with department heads to promptly resolve personnel problems or grievances.
(e) 
Assist in labor contract negotiations and collective bargaining issues.
(f) 
Work closely with department heads to assure that employees receive adequate opportunities for training to maintain and improve their job-related knowledge and skills and act as the approving authority for requests by employees to attend conferences, meetings, training schools, etc., provided that funds have been budgeted for these activities.
(6) 
Budgeting and purchasing. The Administrator shall:
(a) 
Prepare the annual Village budget, in accordance with guidelines as may be provided by the Village Board and in coordination with department heads and pursuant to state statutes, for review and approval by the President and the Village Board.
(b) 
Administer the budget as adopted by the Village Board.
(c) 
Report regularly to the Village Board on the current fiscal position of the Village.
(d) 
Supervise the accounting system of the Village and ensure that the system employs methods in accordance with current professional accounting practices.
(e) 
Serve as the purchasing agent for the Village, supervising all purchasing and contracting for supplies and services, subject to the purchasing procedures established by the Village Board and any limitation contained in the Wisconsin Statutes.
(7) 
Cooperation. All officials and employees of the Village shall cooperate with and assist the Administrator so that the Village government shall function effectively and efficiently.
(1) 
Appointment. The Village Clerk shall be appointed by majority vote of the Village Board.
(2) 
If required to do so by the Village Board, the Village Clerk shall execute and file an official bond. If the Village Board does not require the Clerk to execute and file an official bond, the Village shall obtain a dishonesty insurance policy or other appropriate insurance policy that covers the Clerk, in an amount determined by the Village Board, in lieu of the bond requirement.
(3) 
Duties.
(a) 
To perform any duties prescribed by law relative to elections, to keep subject to inspection all election returns required to be filed in the Clerk's office, and to notify persons elected or appointed to Village offices.
(b) 
To transmit to the County Clerk, within ten (10) days after election or appointment and qualification, a certified statement of the name and term for which elected or appointed, of the President, Clerk, Treasurer and Assessor; and to the Clerk of the Circuit Court immediately after their election or appointment and qualification, a like statement of the time and term for which elected or appointed of every Municipal Judge or Chief of Police of the Village.
(c) 
To attend all meetings of the Village Board; to record and sign the proceedings thereof and all ordinances, rules, bylaws, resolutions and regulations adopted, and to countersign and keep a record of all licenses, commissions and permits granted or authorized by them, and for such purpose to keep the following books: A minute book, in which shall be recorded in chronological order full minutes of all elections, general or special, and the statements of the inspectors thereof; full minutes of all the proceedings of the Board of Trustees; the titles of all ordinances, rules, regulations and bylaws, with reference to the book and page where the same may be found. An ordinance book, in which shall be recorded at length, in chronological order, all ordinances, rules, regulations and bylaws. A finance book, in which shall be kept a full and complete record of the finances of the Village, showing the receipts, the date, amount and sources thereof, and the disbursements, with the date, amount and object for which paid out; and to enter in either such other matters as the board prescribes, and such other books as the board directs.
(d) 
To countersign and cause to be published or posted every ordinance, bylaw or resolution as required by law, and to have proper proof thereof made and filed.
(e) 
To be the custodian of the corporate seal, and to file as required by law and to safely keep all records, books, papers, or property belonging to, filed or deposited in the Village Clerk's office, and deliver the same to the Clerk's successor when qualified; to permit, subject to Subchapter II of Chapter 19, Wis. Stats., any person with proper care to examine and copy any of the same, and to make and certify a copy of any thereof when required, on payment of the same fees allowed town clerks therefor.
(f) 
To draw and countersign all orders on the Village treasury ordered by the Village Board and none other.
(g) 
To stamp or endorse street trade permits at the request of an employer under Section 103.25(3m)(b), Wis. Stats.
(h) 
To stamp or endorse traveling sales crew worker permits at the request of an employer under Section 103.34(11)(c), Wis. Stats.
(i) 
To make and deliver to the Village Finance Director/Treasurer a tax roll and to make and transmit to the County Treasurer, on forms provided by the department of revenue, a statement showing the total amount of all taxes levied in the Village.
(j) 
To perform all other duties required by law or by any ordinance or other direction of the Village Board.
(k) 
To notify the County Treasurer in which the village is located, by February 20th, of the proportion of property tax revenue and of the credits under Section 79.10, Wis. Stats., that is to be disbursed by the taxation district treasurer to each taxing jurisdiction located in the Village.
(1) 
Appointment. The Village Finance Director/Treasurer shall be appointed by majority vote of the Village Board.
(2) 
If required to do so by the Village Board, execute and file an official bond which may be furnished by a surety company as provided by Section 632.17(2), Wis. Stats. If the Village Board does not require the Finance Director/Treasurer to execute and file an official bond, the Village Board shall obtain a dishonesty insurance policy or other appropriate insurance policy that covers the Finance Director/Treasurer, in an amount determined by the Village Board, in lieu of the bond requirement.
(3) 
Duties.
(a) 
Except as provided in Section 66.0608(3m), Wis. Stats., receive all monies belonging to or accruing to the Village or directed by law to be paid to the Treasurer.
(b) 
Except as provided in Section 66.0608(3m), Wis. Stats., deposit upon receipt the funds of the Village in the name of the Village in the public depository designated by the Village Board. Failure to comply with this subsection shall be prima facie grounds for removal from office. When the money is deposited, the Treasurer and bonders are not liable for the losses defined by Section 34.01(2), Wis. Stats., and the interest shall be paid into the Village treasury.
(c) 
Pay money only on the written order of the President, countersigned by the Village Clerk and specifying the number thereof, the payee and the amount and the object for which drawn.
(d) 
Keep just and accurate detailed accounts of all transactions under Subsection (3)(c), showing when, to whom and for what purpose all payments are made, in books provided by the Village Board, and preserve all vouchers filed in the office.
(e) 
Render an account and settlement of all official transactions to the Village Board at its last meeting prior to the annual election, and at all other times when required by the Village Board.
(f) 
Deliver to the successor when qualified all books of account, papers and property of the office and all money on hand as Treasurer.
(g) 
Perform other duties as required by law or the Village Board.
(h) 
Keep but one (1) fund in the treasury, except as otherwise provided.
(i) 
Execute the bond required by Section 70.67, Wis. Stats., and take receipt therefore, which the Treasurer shall file in the office of the Village Clerk.
(j) 
On receipt of the tax roll, and while acting as collector of taxes, exercise the same powers and perform the same duties as are by law conferred upon and required of town treasurers while acting in that capacity, and be subject to the same penalties and liabilities.
(k) 
Invest Village funds in accordance with Village Board Policy.
(4) 
Records. Comply with Subchapter II of Chapter 19, Wis. Stats., concerning records of which the Finance Director/Treasurer is legal custodian.
(5) 
Taxes. Perform all the duties relating to taxation required of the Village Finance Director/Treasurer under Chapters 70 to 79, Wis. Stats.
(1) 
Appointment. The Village Attorney shall be appointed by majority vote of the Village Board, except that the Village Attorney shall serve at the pleasure of the Village Board.
(2) 
Duties. The Village Attorney shall have the following duties:
(a) 
The Village Attorney shall advise the Village Board on the legal business in which the Village is interested.
(b) 
He or she shall, when requested by Village officers, give written legal opinions, which shall be filed with the Village.
(c) 
He or she shall draft ordinances, bonds and other instruments as may be required by Village officers.
(d) 
He or she may appoint an assistant, who shall have the power to perform his or her duties and for whose acts he or she shall be responsible to the Village. Such an assistant shall receive no compensation from the Village, unless previously provided by ordinance.
(e) 
The Village Attorney shall perform such other duties as provided by state law and as designated by the Village Board.
(3) 
Special Counsel. The Village Board may employ and compensate special counsel to assist in or take charge of any matter in which the Village is interested.
(4) 
Compensation. Compensation or a method of calculating compensation shall be agreed upon between the Village Attorney and the Village Board in writing.
(1) 
Appointment. The Chief of Police shall be appointed by majority vote of the Police Commission and subject to discipline or removal pursuant to the procedures established in Section 62.13, Wis. Stats. The Chief of Police shall exercise the powers and duties of Village marshals and Village constables, and any other powers and duties prescribed by the Village Board, Village ordinances or the Wisconsin Statutes. Upon a permanent vacancy, an officer designated by the Police Commission shall temporarily replace the Chief until the vacancy is filled.
(2) 
The compensation to be paid to the Chief of Police for his or her services, the hours of active-duty benefit time shall be such as may be determined by the Village Board.
(3) 
General duties. The Chief of Police shall have the following duties as well as those outlined in Section 6.03 of the Village Code and Section 62.13, Wis. Stats.:
(a) 
Have command of the Police Department of the Village under the direction of the Village Board and Village Administrator.
(b) 
Have general administration control of the Department.
(c) 
Be responsible for the Department’s government, efficiency, and general good conduct.
(d) 
Perform all duties prescribed to the office by laws of the State and ordinances of the Village of Belleville.
(e) 
Cause to maintain accurate records of complaints, crimes, traffic accidents, ordinance violations, arrests, summons, incidents, and calls for police service and shall provide a system of periodic summary and analysis to ensure the most efficient and effective deployment and use of the Department’s resources. He or she shall submit or cause to be submitted to the various agencies such reports and summaries as are required by state statutes or ordinances and may participate in voluntary programs designed to improve law enforcement and public safety.
(f) 
Develop Department policies and procedures.
(g) 
Maintain Department ethics and discipline.
(h) 
Have control of the assignment, hours of duty, and transfer of all members of the Department.
(i) 
Authorize overtime work for police officers, with supporting justification provided to the Village Board, or committee thereof.
(j) 
Delegate special assignments or duties to police officers and monitor to see that responsibilities are carried out.
(k) 
Plan, organize, staff, direct and control all the human and material resources of the Department for the most effective and efficient discharge of its duty to protect persons and property, preserve the peace, protect the rights of citizens, and enforce the Wisconsin Statutes and the ordinances of the Village as are within its jurisdiction. He or she shall supervise the preparation and presentation of annual reports and budgets for the Police Department. He or she shall be required to certify the correctness of all bills incurred by the Department.
(l) 
Submit such reports and comply with such administrative procedures as may be prescribed by the Village Board related to fiscal and administrative matters.
(m) 
Identify and evaluate ideas to achieve more efficient and effective operation.
(n) 
Plan and execute programs designed to prevent and repress crime, apprehend, and prosecute offenders, recover property, and regulate non-criminal conduct, giving highest priority in the allocation of resources to crime and other offenses most hazardous to life and property.
(o) 
Participate in the recruitment, testing and selection of new personnel.
(p) 
Maintain productive relationships with Village departments and other governmental agencies and private organizations concerned with law enforcement, crime prevention, administration of justice and public safety. He or she shall cooperate and exchange information with other Village departments in matters relating to their various functions.
(q) 
Perform other miscellaneous duties as assigned.
(4) 
Chief is responsible for training. Supervise and participate in the advanced and continuing training of police officers and non-sworn department employees. Cause adequate and progressive programs of training to be organized and conducted to prepare department members in the knowledge, procedures, and techniques of their duties and responsibilities. The Chief of Police will ensure that members of the Department attend training courses, seminars, and conferences necessary to maintain and improve their skills and professional knowledge. Encourage department members to further their education through study, special courses, college attendance, extension programs and independent study.
(5) 
Reports of Chief. The Police Chief shall report to the Village Board and Village Administrator from time to time or upon the request of said Village Board or Village Administrator departmental matters and shall perform such other duties in conformance with their office as may from time to time be required by the Village Board or Village Administrator.
(1) 
Appointment. The Fire Chief shall assume office pursuant to the bylaws of the Fire Department and Fire District. The Fire Chief or their qualified designee shall be the Village Fire Inspector for the Village.
(2) 
Duties.
(a) 
The Fire Chief shall have general supervision of the department, subject to this Chapter and the bylaws of the department and shall be responsible for the personnel and general efficiency of the department.
(b) 
The Fire Chief shall enforce all fire prevention ordinances of this Village and state laws and regulations pertaining to fire prevention and shall keep citizens informed on fire prevention methods and on the activities of the department.
(1) 
Appointment. The Emergency Medical Services (EMS) Chief shall assume office pursuant to the bylaws of the EMS Department and EMS District.
(2) 
Duties.
(a) 
The EMS Chief shall have general supervision of the department, subject to this Chapter and the bylaws of the department and shall be responsible for the personnel and general efficiency of the department.
(b) 
The EMS Chief shall enforce all ordinances of this Village and state laws and regulations pertaining to public health and shall keep citizens informed on public health methods and on the activities of the department.
(1) 
Appointment. The Village Board may appoint one (1) or more commissioners of noxious weeds on or before May 15th each year. A Weed Commissioner shall take the official oath and the oath shall be filed in the office of the Village Clerk. A Weed Commissioner shall hold office until a successor is made necessary or the Village Board determines not to appoint a Weed Commissioner.
(2) 
Duties.
(a) 
Destruction of noxious weeds. A Weed Commissioner shall investigate the existence of noxious weeds. If a property owner or other responsible party neglects to destroy noxious weeds as required under Section 66.0407(3), Wis. Stats., the Weed Commissioner shall destroy, or have destroyed, the noxious weeds by the Public Works Department. The Weed Commissioner may enter upon any lands that are not exempt under Section 66.0407(5), Wis. Stats., and destroy or cause to have destroyed noxious weeds without being liable to an action for trespass or any other action for damages resulting from the entry and destruction if reasonable care is exercised.
(b) 
Compensation of Weed Commissioner.
1. 
A Weed Commissioner shall receive compensation for the destruction of noxious weeds as determined by the Village Board upon presenting to the Treasurer the account for noxious weed destruction, verified by oath, and approved by the appointing officer. The account shall specify by separate items the amount chargeable to each piece of land, describing the land, and shall, after being paid by the Treasurer, be filed with the Village Clerk. The Clerk shall enter the amount chargeable to each tract of land in the next tax roll in a column headed “For the Destruction of Weeds", as a tax on the lands upon which the weeds were destroyed. The tax shall be collected under Chapter 74, Wis. Stats., except in case of lands which are exempt from taxation, railroad lands, or other lands for which taxes are not collected under Chapter 74, Wis. Stats. A delinquent tax may be collected as is a delinquent real property tax under Chapters 74 and 75, Wis. Stats., or as is a delinquent personal property tax under Chapter 74, Wis. Stats. In case of railroad lands or other lands for which taxes are not collected under Chapter 74, Wis. Stats., the amount chargeable against these lands shall be certified by the Village Clerk to the Secretary of Administration who shall add the amount designated to the sum due from the company owning, occupying, or controlling the lands specified. The Secretary of Administration shall collect the amount chargeable as prescribed in Subchapter I of Chapter 76, Wis. Stats., and return the amount collected to the Village from which the certification was received.
2. 
For the performance of duties other than the destruction of noxious weeds, a Weed Commissioner shall receive compensation to be determined by the Village Board.
(1) 
Appointment. The Village Director of Public Works shall be appointed by majority vote of the Village Board.
(2) 
Duties. The Village Director of Public Works shall have the following duties and powers:
(a) 
Have general charge and supervision of all public works and public utilities in the Village.
(b) 
Be responsible for the maintenance, repair and construction of streets, alleys, curbs, gutters, sidewalks, bridges, street signs, storm sewers, cemetery, Village buildings and structures and all machinery, equipment and property used in any activity under the Village’s control.
(c) 
Have charge of all public services, including garbage and refuse collection and disposal, parks and recreation, forestry, snow and ice removal, street cleaning, and mosquito and rodent control.
(d) 
Perform such other activities and duties as are required from time to time by the Village Administrator or Village Board, his or her job description, or employment contract.
(1) 
Pursuant to Sections 61.195, 61.197 and 66.0101, Wis. Stats., the Village hereby elects not to be governed by those portions of Sections 61.19 and 61.23, Wis. Stats., which relate to the selection and tenure of the Village Assessor, and which are in conflict with this Section.
(2) 
Appointment. The Village Assessor shall be appointed by majority vote of the Village Board. Said person so appointed to perform the duties of such office shall have an indefinite term or as determined by contract.
(a) 
A corporation or an independent contractor may be appointed as the Village Assessor.
(b) 
The corporation or independent contractor so appointed shall designate the person responsible for the assessment.
(c) 
The designee shall file the official oath under Section 19.01, Wis. Stats., and sign the affidavit of the Assessor attached to the assessment roll under Section 70.49, Wis. Stats.
(d) 
No person may be designated by any corporation or independent contractor unless he or she has been granted the appropriate certification under Section 73.09, Wis. Stats.
(e) 
For purposes of this subsection, "independent contractor" means a person who either is under contract to furnish appraisal and assessment services or is customarily engaged in an independently established trade, business, or profession in which the services are offered to the public.
(f) 
Whenever the Assessor, in the performance of their duties, requests or obtains income and expense information pursuant to Section 70.47(7)(af), Wis. Stats., or any successor statute thereto, then such income and expense information that is provided to the Assessor shall be held by the Assessor on a confidential basis; except, however, that said information may be revealed to and used by persons in the discharge of duties imposed by law, in the discharge of duties imposed by office (including but not limited to use by the Assessor in performance of official duties of the Assessor's office and use by the Board of Review in performance of its official duties), or pursuant to order of a court. Income and expense information provided to the Assessor under Section 70.47(7)(af), Wis. Stats., unless a court determines that it is inaccurate, is, per Section 70.47(7)(af), Wis. Stats., not subject to the right of inspection and copying under Section 19.35(1), Wis. Stats.
(1) 
Appointment. The Village Building Inspector shall be appointed by majority vote of the Village Board. Said person so appointed to perform the duties of such office shall have an indefinite term or as determined by contract.
(2) 
Duties.
(a) 
Possess and maintain proper state certification in areas of their responsibility.
(b) 
Possess such executive ability as is requisite for the performance of their duties and shall have a thorough knowledge of the standard materials and methods used in the installation of equipment in their area of responsibility.
(c) 
Be well versed in approved methods of construction for safety to persons and property, the Wisconsin Statutes relating to work in their area of responsibility, and any orders, rules and regulations issued by authority thereof.
(d) 
Have sufficient experience in the installation of equipment to enable them to understand and apply the appropriate codes adopted by the Village of Belleville.
(3) 
Authority to enter premises and appeals.
(a) 
In the discharge of their respective duties, each inspector under this Section or their authorized agent may enter any building, upon presentation of the proper credentials, during reasonable hours for the purpose of inspection and may require the production of any permit or license required hereunder.
(b) 
No person shall interfere with an inspector or their authorized agent while in the performance of their duties, and any person so interfering shall be in violation of this Section and subject to a penalty as provided in Section 1.08 of the Village Code.
(c) 
If consent to entry to personal or real properties which are not public buildings or to portions of public buildings which are not open to the public for inspection purposes has been denied, an inspector shall obtain a special inspection warrant under Section 66.0119, Wis. Stats.
(d) 
Any person feeling himself or herself aggrieved by any order or ruling of an inspector may, within twenty (20) days thereafter, appeal from such order or ruling to the Zoning Board of Appeals, as established in Chapter 16, Zoning Code, of the Village Code, such an appeal to be in writing.
(4) 
Stop-work orders and revocations. Inspectors may order construction, installation, alteration, or repair work stopped when such work is being done in violation of this Code. Work so stopped shall not be resumed except with written permission of the inspector, provided that if the stop-work order is an oral one it shall be followed by a written order within a reasonable period of time.
(1) 
Appointment. The Village Engineer shall be appointed by majority vote of the Village Board. Said person so appointed to perform the duties of such office shall have an indefinite term or as determined by contract.
(2) 
Compensation. Compensation or a method for calculating compensation shall be agreed upon between the Village Engineer and the Village Board in writing. The Village Engineer shall perform such duties as provided by state law and as designated by the Village Board.
(1) 
Pursuant to the authority granted by Chapter 755, Wis. Stats., there is hereby created the office of Municipal Judge for the Municipal Court for the Village of Belleville.
(2) 
The Municipal Judge shall be elected at large for a term of four years commencing on May 1st succeeding the election.
(3) 
The Municipal Judge shall execute and file with the Clerk of the Circuit Court for Dane and Green Counties the oath prescribed by Section 755.03, Wis. Stats.
(1) 
Appointment. The Municipal Judge shall, in writing, appoint a Court Clerk. The Court Clerk's salary shall be fixed by the Municipal Judge. The Court Clerk shall hold office for an indefinite term of office. The Court Clerk shall, before entering upon the duties of his or her office, take the oath provided by Section 19.01, Wis. Stats., and give such bond as the Village Board may require. The oath and bond of the Court Clerk shall be filed with the Village Clerk. The cost of such a bond shall be paid by the Village.
(2) 
Duties. The Court Clerk shall perform duties as provided in this Chapter and state law, and as required by the Municipal Judge.
(1) 
No person shall be elected by the people to a Village office who is not at the time of his or her election a citizen of the United States and of this state and an elector of the Village and, in case of a ward office, of the ward and actually residing therein.
(2) 
An appointee by the Village President, required to be confirmed by the Village Board, who shall be rejected by the Village Board shall be ineligible for appointment to the same office for one (1) year thereafter.
(1) 
Oath of office. Every officer of the Village, including members of Village boards and commissions, shall, before entering upon his or her duties and within five (5) days after notice of election or appointment, take the oath of office prescribed by law and file such oath with the Village Clerk, provided that the Municipal Judge shall take their official oath within ten (10) days after their election and file it with the Clerks of Circuit Court for Dane County and Green County prior to acting as Judge. Any person re-elected or re-appointed to the same office shall take and file an official oath for each term of service.
(2) 
Form; procedure. The form, filing and general procedure for the taking of oaths shall be governed by Chapter 19, Subchapter I, Wis. Stats.
(1) 
How occurring. Except as provided in Section 4.19(3), vacancies in elective and appointive positions occur as provided in Sections 17.03 and 17.035, Wis. Stats.
(2) 
How filled. Vacancies in elective and appointive offices shall be filled as provided in Section 17.24, Wis. Stats.
(3) 
Temporary incapacitation. If any officer is absent or temporarily incapacitated from any cause, the Village Board may appoint some person to discharge his or her duties until he or she returns or until such disability is removed.
(1) 
Elected officials. Elected officials may be removed by the Village Board as provided in Sections 17.13(2) and 17.16, Wis. Stats.
(2) 
Appointed officials. Appointed officials may be removed as provided in Sections 17.13(1) and 17.16, Wis. Stats., with the following exceptions:
(a) 
Police Chief or other law enforcement officer may be removed from office pursuant to Section 6.06 of the Village Code and Section 62.13(6m), Wis. Stats.
(1) 
The proper operation of democratic government requires that public officials and employees be independent, impartial, and responsible to the people; government decisions and policy be made in the proper channels of the government structure; public office not be used for personal gain; and the public have confidence in the integrity of its government. In recognition of these goals, there is hereby established a Code of Ethics for all Village officials and employees, whether elected or appointed, paid or unpaid, including members of boards, committees, and commissions of the Village.
(2) 
The purpose of this ordinance is to establish guidelines for ethical standards of conduct for all such officials and employees by setting forth those acts or actions that are incompatible with the best interests of the Village and by directing disclosure by such officials and employees of private financial or other interests in matters affecting the Village. The Village Board recognizes that representatives of the Village are drawn from society and therefore cannot and should not be without all personal and economic interests in the decisions and policies of government; that citizens who serve as Village officials and employees retain their rights as citizens to have interests of a personal and economic nature; that the standards of ethical conduct for Village officials and employees need to distinguish between those minor and inconsequential conflicts that are unavoidable in a free society and those conflicts which are substantial and material; and that Village officials and employees may need to engage in employment, professional or business activities other than official duties in order to support themselves or their families and to maintain continuity of professional or business activity or may need to maintain investments, which activities or investments do not conflict with the specific provisions of this Chapter. The provisions and purpose of this Chapter and such rules and regulations as may be established are hereby declared to be in the best public interest.
(3) 
Responsibility of public office. Public officials and employees are agents of public purpose and hold office for the benefit of the public. They are bound to uphold the Constitution of the United States and the Constitution of this state and to carry out impartially the laws of the nation, state, and Village and thus to foster respect of all government. They are bound to observe in their official acts the highest standards of morality and to discharge faithfully the duties of their office regardless of personal considerations, recognizing that the public interest must be their primary concern.
(4) 
Conflicts of interest.
(a) 
No local public official or employee may use his or her public position or office to obtain financial gain or anything of substantial value for the private benefit of themselves or their immediate family or an organization with which they are associated. This subsection does not prohibit a local public official or employee from using the title or prestige of his or her office to obtain campaign contributions that are permitted and reported as required by Chapter 11, Wis. Stats.
(b) 
No person may offer or give to a local public official or employee directly or indirectly and no local public official or employee may solicit from any person either directly or indirectly anything of value if it could reasonably be expected to influence the local public official's or employee's vote, official actions or judgment or could reasonably be considered as an award for any official action or inaction on the part of a local public official or employee. This subsection does not prohibit a local public official or employee from engaging in outside employment.
(c) 
Except as provided in Subsection (4)(d), no local public official or employee may:
1. 
Take any official action substantially affecting a mater in which the local public official or employee or member of their immediate family or an organization with which the local public official or employee is associated has a substantial financial interest.
2. 
Use their office or position in a way that produces or assists in the production of a substantial benefit, direct or indirect, for the local public official or employee, one (1) or more members of the local public official's or employee's immediate family, either separately or together, or an organization with which the official or employee is associated.
(d) 
This Section does not prohibit a local public official or employee from taking any action concerning lawful payment of salaries or employee benefits or reimbursement of actual and necessary expenses or prohibit a local public official or employee from taking official action with respect to any proposal to modify an ordinance.
(e) 
It is not a conflict of interest for any local public official or employee to receive a gift or gratuity that is an unsolicited item of nominal intrinsic value.
(f) 
No local public official or employee and no business in which a local public official or employee holds a ten (10)-percent or greater interest may enter into a contract with the Village of Belleville involving a payment or payments of more than $3,000 within a twelve (12)-month period unless said local public official or employee has first made a written disclosure of the nature and extent of such relationship or interest to the Village Board and to the department acting for the Village in regard to such contract. This subsection does not affect the application of Section 946.13, Wis. Stats.
(g) 
No local public official or employee shall disclose confidential information concerning the property, government, or affairs of the Village nor shall they use such information to advance the financial or other private interest of themselves or any other person.
(5) 
Disclosure of interest in legislation. Any member of the Village Board who has a financial interest in any proposed legislation before the Village Board shall disclose the nature and extent of such interest prior to or during the initial discussion on said legislation. Any other local public official or employee who has a financial interest in any proposed legislative action of the Village Board and who participates in the discussion with or gives an official opinion or recommendation to the Village Board shall disclose the nature and extent of such interest.
(6) 
Violations and penalties. Violation of this Chapter shall be subject to a penalty as provided in this Code of Ordinances.
