As used in this Chapter the following terms shall have the meanings indicated:
SPECIAL EVENT
Any event involving the extraordinary use of public property, including, without limitation, the public right-of-way, public parks, public buildings or other City facilities; or events on public or private property as otherwise provided in the City Code. Extraordinary use of public property includes amplified sound, closing of streets, electrical or plumbing hookups to City utility connections, fireworks, firearms "salutes" by military honor guards, and noise generating events that continue past 11:00 P.M.
ORGANIZER
The individual(s) applying for a Special Event Permit. This individual(s) must oversee the special event or have primary control of its conduct, staging, presentation or organizing. The Organizer will obtain all licensing as required by the Code of the City of Hollister and ensure that all their event participants apply for required licensing.

A. 
Period Of Operation And Duration.
1. 
The maximum time limit for any event is five (5) consecutive days. Within a 30-day period, the maximum time limit for any reoccurring event is ten (10) non-consecutive days.
2. 
All Special Event Permits must be submitted no later than thirty (30) days prior to the event for consideration of approval.
B. 
The proposed activity or use will not unreasonably interfere with or detract from the general enjoyment of the public property as listed in definitions.
C. 
The proposed activity or use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety, and recreation.
D. 
The proposed activity or use will not entail unusual, extraordinary or burdensome expense by the public or unusual or burdensome police protection or activity.
E. 
The desired facility has not been previously reserved for other use on the day and hour required in the application.
F. 
The use will not unreasonably interfere with another use previously permitted at the day and hour required in the application.
G. 
The use or frequency of the use applied for will not unreasonably deprive the public of general use of the public space or unreasonably deprive or interfere with the use of the remainder of the space by the public.
H. 
The Organizer is responsible for the cleaning and restoration of the location(s) the event occupies and/or causes debris or litter within twenty-four (24) hours of the conclusion of the event, or at such other time as may be set forth in the permit, to the condition which existed prior to the event and will provide waste disposal and toilet facilities for those attending the event.

A. 
A completed application with details of the event, signed by the Organizer.
B. 
A complete Special Event Impact Form must be submitted thirty (30) days prior to the event date. Failure to submit a completed form may result in revocation of an approved permit.
C. 
The permit applicant must provide a certificate of general liability insurance, naming the City as an additional insured, with minimum limits of one million dollars ($1,000,000.00) per occurrence for bodily injury and property damage.
D. 
For events including food vendors, the Organizer must complete a Taney County Health Department Organizer Application and submit any associated fees. The Organizer is also responsible for ensuring each vendor has submitted their Taney County Health Department Permit Application to the City of Hollister with required fees.
E. 
For events where items will be sold, the Organizer is responsible for ensuring all vendors, including the Organizer, submit a Business License Application to the City of Hollister thirty (30) days prior to the event for approval with associated fees. If a vendor fails to acquire their City of Hollister Business License prior to the event, the vendor will not be permitted to sell items at the event, and the Organizer will be responsible for ensuring adherence by all vendors.
F. 
The Organizer will provide a list of vendors participating in the special event. For reoccurring events, a listing must be provided at the end of each 30-day permit period with vendors that participated during the previous thirty (30) days.

The Board of Aldermen shall approve or disapprove all new Special Event Permit applications, all special event applications that involve a request for the sale or consumption of alcoholic beverages, and all special event applications that have substantially changed or are not in compliance with a change in City of Hollister requirements for special events.

A. 
Upon written application to the City Clerk's office and payment of a one hundred fifty dollar ($150.00) fee for events lasting from one (1) to three (3) days and a two hundred fifty dollar ($250.00) fee for events lasting four (4) or five (5) days. The application will be reviewed by City staff as to the compliance of the proposed event as it relates to the City of Hollister's Municipal Code.
B. 
For events including food vendors, the Organizer will complete a Taney County Health Department application and pay a twenty-five dollar ($25.00) fee. Each food vendor will be responsible for the associated fees for obtaining a Taney County Health Permit.
C. 
A fee of twenty-five dollars ($25.00) will be paid by the organizer for each special event where services from Western Taney County Fire Protection District are required. When the permit is submitted to the City Clerk, a determination will be made regarding this fee.

A. 
A Special Event Permit may be suspended or revoked by the Board of Aldermen or their designee upon any of the following:
1. 
If the patrons of a special event have become disorderly whereas the public peace or the safety of persons or property are threatened.
2. 
If the organizer refuses to remove from the event any person(s) violating any Federal, State or provisions of the Municipal Code of the City of Hollister after such organizer has been requested to do so by the City.
3. 
If the organizer fails to comply with any Federal, State or local law including the regulations pertaining to special events or the conditions of the Special Event Permit.
4. 
If a Special Event Permit is revoked, the City of Hollister will have the discretion whether to accept a subsequent special event application submitted by the organizer for the event in which the permit was revoked, including any person with ownership interest in the event.
