It is declared to be the policy of the Planning
Board to review land subdivisions as part of a plan to ensure the
orderly, efficient and desirable development of the Town, guided by
the following regulations. These regulations provide a procedure and
standards for said review. Their intent is to encourage and require
the best subdivision and development of land, and to ensure that:
A. The land to be subdivided shall be of such character
that it will produce building sites of such good quality and dimensions
that will permit their development without danger to health or peril
from fire, flooding or other deleterious conditions.
B. Proper provision shall be made for drainage, water,
sewerage and other needed improvements.
C. Proposed streets shall be designed, located and built
to accommodate safely the projected traffic volume and promote safe
and convenient circulation of vehicles and pedestrians.
D. Protection of the environment and the prevention of
the destruction of the natural character and beauty of the land shall
be encouraged.
E. In proper cases and where required by the Planning
Board, park areas of suitable size, location and character for recreational
purposes shall be identified in the subdivision plat.
For the purposes of these regulations, certain
words and terms used herein are defined as follows:
APPLICANT
Any person, firm, corporation, partnership or association
who shall lay out, for the purpose of sale or development, any subdivision
or a part thereof, as defined herein.
EASEMENT
Authorization by a property owner for the use by another
and for a specified purpose of any designated part of his property.
FINAL PLAT
A map or drawing showing a proposed subdivision, containing
all information required to appear on a preliminary plat and the modifications,
if any, required by the Planning Board at the time of approval of
a preliminary plat of such proposed subdivision.
FINAL PLAT APPROVAL
The signing of a final plat by the Chairman of the Planning
Board after a resolution granting final approval to the plat or after
conditions specified in a resolution granting conditional approval
of the plat are completed. Such "final approval" qualifies the plat
for recording in the office of the County Clerk.
FINAL PLAT, CONDITIONAL APPROVAL OF
The approval of a final plat subject to conditions set forth
by the Planning Board in a resolution conditionally approving such
plat. Such conditional approval does not qualify a final plat for
recording, nor does it authorize issuance of building permits prior
to the signing of the plat by the Chairman of the Planning Board and
recording of the plat in the office of the County Clerk.
LAND, CONSERVATION
That portion of land in a subdivision which shall be preserved
in its natural undeveloped state except for the establishment, when
approved by the Planning Board, of nature trails and accessory nature
study facilities.
LAND, RECREATION
That portion of land in a subdivision designed and developed
with permanent facilities for recreation use in accordance with a
plan approved by the Planning Board.
OFFICIAL MAP
The map and any amendments thereto adopted by the Town Board
under § 270 of the Town Law.
OFFICIAL SUBMISSION DATE
The date when a subdivision plan shall be considered submitted,
subject to § 276 of the Town Law, is hereby defined to be
that date on which the complete application (i.e., a plat which includes
all items required for submission pursuant to this chapter) is received
by the Planning Board at a regularly scheduled meeting and determined
to be complete.
PRELIMINARY PLAT
A map or drawing showing the layout of a proposed subdivision, including but not restricted to those items prescribed in §
131-13 of these regulations.
PRELIMINARY PLAT APPROVAL
The approval by the Planning Board of the layout of the proposed
subdivision as set forth in a preliminary plat, but subject to approval
of the plat in final form.
STREET
A way which is an existing state, county or Town highway,
or a way shown on a subdivision plat approved by the Town Planning
Board, as provided by law, or on a plat duly filed and recorded in
the office of the County Clerk.
STREET, BUSINESS
A road which serves or is designed to serve as an access
to abutting business properties.
STREET, COLLECTOR
A road which collects or will collect traffic from local
roads and which carries or will carry through traffic from surrounding
areas.
STREET, DEAD-END
A street or a portion of a street with only one vehicular
outlet.
STREET, LOCAL
A road which serves or will serve primarily only those properties
having frontage on it and which does not or will not carry through
traffic from surrounding areas.
STREET, MAJOR
A street which serves or is designed to be used primarily
for connecting different parts of the Town and usually carries a high
volume of traffic.
SUBDIVISION
The division of any parcel of land into two or more lots,
plots, sites or other division of land, with or without streets, including
any change of property lines.
SUBDIVISION, MINOR
A subdivision consisting of not more than five lots, plots,
sites or other divisions of land each of which has access on an existing
state, county or Town highway.
TOWN PLAN
A comprehensive plan for development of the Town prepared
by the Planning Board pursuant to § 272-a of the Town Law,
which indicates the general locations recommended for various public
works and reservations and for the general physical development of
the Town, and includes any part of such plan separately adopted and
any amendment to such plan or parts thereof.
ZONING ORDINANCE
The officially adopted Zoning Ordinance of the Town of Carmel,
together with any and all amendments thereto.
