A.
It is hereby found and determined that economical hydroelectric
energy from the Niagara - St. Lawrence Power Projects will be available to
certain municipalities operating public utility services and that it is necessary,
in order to qualify for the purchase of said power, to establish a public
utility service agency for the purchase and resale of electric energy power
to consumers in the Village of Ellenville.
B.
It is further found and determined that the most efficient
method of purchasing and distributing electric energy power to consumers in
the Village of Ellenville is through contracts and leasing agreements.
As used in this chapter, the following terms shall have the meanings
indicated:
Rural and residential users only.
The purchase and resale of hydroelectric power from the Niagara -
St. Lawrence Power Projects to consumers through contracts, leasing and agency
agreements with existing public utility companies.
A public utility service to be known as the "Village of Ellenville Public
Utility Service Agency" is hereby authorized and established pursuant to Article
14-A of the General Municipal Law.
The Village of Ellenville Public Utility Service Agency shall be administered
by three Commissioners to be nominated by the Mayor of the Village of Ellenville,
subject to the approval of the Village Board of Trustees.
The Village of Ellenville Public Utility Service Agency, through the
Commissioners by majority vote of same and subject to the approval of the
Board of Trustees of the Village of Ellenville, shall have the following powers:
A.
To purchase economical electric energy of the Niagara
- St. Lawrence Power Projects, through the New York State Power Authority.
B.
To sell electric energy to consumers in the Village of
Ellenville at rates fixed by appropriate governmental agencies and pursuant
to the contracts and/or leases specified in § 32-SC and D below.
C.
To make contracts and/or leases with Central Hudson Gas
and Electric Corporation, or such other public or private utilities, for the
use of facilities for the transmission and distribution of such electric energy
purchased by consumers in the Village of Ellenville.
D.
To make contracts with Central Hudson Gas and Electric
Corporation, and such other public or private utilities serving the Village
of Ellenville, to act as agents for the Village of Ellenville Public Utility
Service Agency in the distribution, metering, billing and general administrative
functions in connection with the sale of electric energy by the Village of
Ellenville Public Utility Service Agency to consumers in the Village of Ellenville.
E.
To exercise all powers necessary and convenient to carry
out the purposes of this chapter.
The contract's cost for purchasing and transmitting electric energy
to consumers in the Village of Ellenville is $43,000, and the maximum estimated
cost of purchase and transmission will be $821,000. All costs incurred by
the Ellenville Public Utility Service Agency will be offset and reimbursed
to the said Agency by rates charged customers.
This chapter does not contemplate the exercise of the power of condemnation
nor the establishment of utility facilities or services duplicative of those
of existing private utility companies serving the Village of Ellenville.
This chapter shall not become effective until approved by a majority
of the votes cast on the question of the approval or disapproval of the proposition
submitted to the voters at a general election to be held on March 19, 1985.[1]
