No firm or corporation may execute any plumbing or drainage work in the City of Hudson or in connection with the City's water mains or sewerage system outside of the City of Hudson without first obtaining from the Examining Board of Plumbers of the City of Hudson a certificate of competency.

No person shall be examined unless he shall have had experience of at least five years as a journeyman plumber and is able to furnish satisfactory evidence of such fact, and no application shall be received from any person who is not a citizen of the United States or who has been convicted of a violation of this chapter within five years preceding the date of application.

Any person who desires to procure a certificate of competency shall make a written application for examination upon a form to be prescribed by the Examining Board of Plumbers and shall pay an examination fee as established by the Common Council at the time of filing such application. Such examination fee is not returnable even though the applicant does not take the examination.

If the applicant satisfactorily passes the examination with a percentage of 75 or better, he shall receive a certificate of competency from the Examining Board of Plumbers. He shall pay a fee as established by the Common Council for the certificate, and all such certificates shall expire on the 31st day of December of the year in which they have been issued and shall be renewed within 30 days preceding such expiration by application to the Board of Plumbers, with a renewal fee as established by the Common Council.

In the event that the applicant fails to satisfactorily pass the examination, he may apply for reexamination after a lapse of six months without payment of an additional fee; and, in the event that such applicant again fails, he may apply for a second reexamination after a lapse of a period of one year upon payment of an additional fee as established by the Common Council. After that, the Examining Board of Plumbers will set a date for reexamination for such applicant.

The nonresident applicant for examination for a permit for one plumbing job shall make application for examination and furnish a detailed drawing of the proposed work to be done; he shall deposit a fee per job as established by the Common Council with the application with the Inspector and he will be notified when to be present for examination. In the event that he passes the examination, he shall deposit a fee as established by the Common Council for a certificate of permit, make out a plumbing plan and deposit a minimum fee for four or less fixtures, for each additional fixture up to 20 fixtures and for each additional fixture over 20, as established by the Common Council.

Any applicant who has successfully passed such examination and received a certificate of competency and who desires to engage in the business of plumbing or drainage in the City of Hudson or who wishes at any time to execute any plumbing or drainage work within the City shall register with the Examining Board of Plumbers in the City of Hudson for such purpose, and upon payment of a fee as established by the Common Council the Board shall issue to him a certificate of registration and a sign appropriately lettered or marked "Licensed Plumber" as may, from time to time, be prescribed by this chapter and the General City Law.

Every registered master plumber, before entering upon such business, and each nonresident applicant under the provisions of § 221-347 of this article shall execute and file a bond with the Plumbing Inspector as established by the Common Council with two sureties, which bond shall be conditioned upon compliance with this chapter and shall be approved by the Mayor as to the sufficiency of the sureties and by the Legal Advisor as to its form.

Any registered master plumber who shall retire from or discontinue doing plumbing and/or drainage business in the City of Hudson may surrender the same to the City of Hudson. Such license renewal may be without a test upon payment of the annual renewal fee as established by the Common Council.

Before any plumbing work requiring authorization according to the provisions of this chapter shall be started, a permit shall be obtained from the administrative authority. This permit shall be obtained by the master plumber who or whose firm has been employed to do the plumbing work.
No permit shall be issued until the owner, master plumber or the registered architect shall submit a detailed drawing of the proposed work to the administrative authority and these plans have been checked to assure that the work will conform to the provisions of this chapter.
Any addition to the plumbing system shall require a permit. The proper administrative authority shall make such rules and regulations for the installation of air-conditioning systems, water treatment equipment and water-operated devices as may be deemed locally necessary to properly protect the water supply system.
The Plumbing Inspector may revoke a permit or a certificate of approval if there is a violation of any provision of this chapter or any false statement or misrepresentation in the application, plans or specifications.
No plumbing or drainage work shall be undertaken prior to the issuance of a permit therefor by the Plumbing Inspector. A permit may be issued only to a licensed master plumber duly registered with the Hudson Examining Board of Plumbers.

The application for permit shall be made on a suitable form provided by the Board of Plumbing and shall be accompanied by a fee as established by the Common Council for four fixtures or less and for each additional fixture for the issuance of a permit as established by the Common Council. The amount of fee to be paid shall be filled in by the licensed master plumber in a space noted as "fee paid." No permit will be granted and no inspection will be made unless this fee accompanies the application.

The administrative authority shall be empowered to collect such fees for the filing of plans, applications, certificates, renewals and license plates and all fees in connection with the plumbing and drainage in the City of Hudson, New York.
The administrative authority shall also have the right to enter any building or upon any premises for the purpose of examining, inspecting or reinspecting, testing or retesting any plumbing and drainage at such time as he may deem necessary to protect public health.
Upon written notice from the administrative authority, the owner or lessee shall be required to correct promptly any and all unsanitary or defective conditions which are likely to have immediate detrimental effect. He shall also correct as soon as possible other unsanitary or defective conditions which may over a period of time have a detrimental effect on health.
Whenever the plumbing within the City limits shall be condemned by the Board of Health as being unsanitary or constituting a menace to health, the owner of the property shall, when duly notified, proceed forthwith to make such improvements as may be necessary to place said plumbing and drainage in a sanitary condition, in accordance with the requirements of these rules and regulations.
Before issuing a certificate to engage in the business of master plumber, the Board shall inquire into the applicant's fitness and qualification for conducting such business and may require the applicant to submit under oath such evidence, in addition to the examination and tests provided, as will satisfy the Board that he is a person of good repute, character and responsibility and otherwise qualified to engage in the business as master or employing plumber.

The Board shall issue a metal sign to every registered master plumber, for which he shall deposit the fee as established by the Common Council with the Secretary, and this money will be refunded to him when he turns in the sign. This sign shall comply with all requirements of this chapter and the General City Law and shall be conspicuously displayed as follows:
A. 
If the registered master plumber has an established place of business in the City of Hudson, such sign shall be conspicuously displayed at such place of business.
B. 
If such registered master plumber does not have an established place of business in the City of Hudson, such metal sign shall be conspicuously displayed at the location within the City of Hudson where he is performing plumbing work. If he is performing plumbing work at more than one location, the displaying of such metal sign at one location will be deemed sufficient.

The Plumbing Inspector shall in November of each year certify to the Board of Examining Plumbers the master plumbers entitled to renewal of their license and shall report those not entitled to renewal.
A. 
Any person, partnership, firm or corporation holding a metal plate or sign issued by the Board of Plumbers shall surrender such plate or sign to the Board if his certificate of competency as master plumber is forfeited and if his certificate of registration as master plumber is not renewed or is canceled.
B. 
There shall be no registration as master plumber or renewal of such registration of any person, firm, association or corporation violating or having violated any of the provisions of this chapter or not having disposed of all complaints entered against him in a manner satisfactory to the Hudson Examining Board of Plumbers.
C. 
Any registration as master plumber or renewal thereof may be canceled by the Board of Plumbers upon proof of any violation of any provision of this chapter after a hearing is held before the said Board upon prior notice of not less than 10 days stating the grounds of complaint and served on the person, firm, association or corporation charged with the violation; upon such cancellation the certificate of such registration shall be surrendered to the said Board.
When a master plumber has been refused the current year's license, he may appeal to the Board of Health, which with the Examining Board of Plumbers shall jointly hear and determine such appeal.
The Plumbing Inspector shall investigate the registration and license of every master plumber and shall promptly report to the Examining Board of Plumbers any violation of the provisions of law relating to the loaning, renting, selling or transferring of certificates or license plates, and the Plumbing Inspector shall immediately apply to the Examining Board of Plumbers for the forfeiture of the license and certificate of registration of any master plumber who shall have loaned, rented, sold or transferred such certificate, plate or sign in violation of law, and the Plumbing Inspector shall summon and have prosecuted such offender for a misdemeanor as provided by law.

Any person to whom such plate or sign has been issued who shall loan, rent, sell or transfer the same to another person, whether such person is entitled to receive a similar plate or sign or not, or otherwise willfully violates the provisions of this article, shall be guilty of a violation punishable as provided in § 221-384.

Such registration may be canceled by the Board of Plumbers for violation of any of the rules and regulations adopted herein upon conviction thereof after a hearing before the Examining Board of Plumbers. The alleged violator shall be given at least notice in writing of such hearing, which notice shall also state the time, place and grounds of the complaint in sufficient detail to inform the alleged violator of the charge he may be called upon to meet at such hearing.
Whenever any inspector or other person reports a violation of any of such rules and regulations for plumbing and drainage, or a deviation from any officially approved plan or specification for plumbing and drainage filed with any board or department, the Plumbing Inspector shall first serve a notice of the violation thereof upon the master plumber doing the work, if a registered plumber, and shall advise the Examining Board of such action.
Such notice may be served personally or by mail, and if by mail it may be addressed to such master plumber at the address registered by him with the Examining Board of Plumbers, but the failure of the master plumber to register will relieve the Examining Board of Plumbers from the requirement of giving notice of violation. Unless the violation is removed within three days after the day of serving or mailing such notice, exclusive of the day of serving or mailing, the Examining Board of Plumbers may proceed according to law.

Any person or persons violating any provisions of this chapter or the rules and regulations of the Examining Board of Plumbers of the City of Hudson shall be guilty of a violation punishable as follows: by imprisonment for a term not exceeding 15 days or by a fine not exceeding $250, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder. If the person convicted is a master plumber, he shall, upon conviction, in addition to the penalties herein described, forfeit any certificate of competency or registration which he may hold.
