[HISTORY: Adopted by the Town Board of the Town of Red Hook 4-13-1976 by L.L. No. 10-1976 as Ch. 14 of the 1976 Code. Amendments noted where applicable.]
A. 
There is hereby established a Recreational Park Commission for the Town of Red Hook, Dutchess County, New York, pursuant to a lease dated the 28th day of May 1975, between the Recreational Park of Red Hook, Inc., a membership corporation (domestic) and the Town of Red Hook, a domestic municipal corporation, whereby the Recreational Park of Red Hook, Inc., being the owner of certain property in the Town of Red Hook, by said agreement leased to the Town of Red Hook numerous acres of its property for a period of 99 years; and the Town of Red Hook shall pay an annual rent of $1 per year.
B. 
This Commission is to be established and invested with the complete authority to manage, control, maintain, expand, renovate and improve, and use the leased property as a recreational facility and public park for the benefit, welfare and general well-being of the residents of the Town of Red Hook and the members of the Recreational Park, Inc.
The purposes and objectives of the Commission shall be as follows:
A. 
To plan and provide opportunities for the residents of the Town of Red Hook and members of the Recreational Park, Inc., for recreation and relaxation and enjoyment through participation in a wide variety of programs of a recreational nature.
B. 
To study the recreational and park needs and resources of the town.
C. 
To encourage recreational programs and activities, whether directly sponsored by the Commission or otherwise.
D. 
To encourage broad community participation in its programs and coordinate its policies and activities with those of the Town Board.
A. 
The Commission shall consist of seven members, who shall be residents of the town; four members of the Commission shall be selected by the Recreational Park, Inc.; and three members shall be selected by the Town Board, All seven members shall be approved by the Town Board of Red Hook.
B. 
The members shall serve without compensation.
C. 
The terms of the members of the Commission shall be established by the Recreational Park, Inc., and the Town Board of Red Hook. Upon the completion of a member's term, or if a vacancy occurs, the same method of selection shall be used as aforesaid.[1]

D. 
Vacancies in such Commission shall be filled by appointment by the Town Board of Red Hook and the Recreational Park, Inc., in the same manner as the initial appointments. In case of a vacancy however, an appointment is to be made for the unexpired term of such vacancy.
E. 
The Chair shall be the executive officer of the Commission. The Chair may appoint committees, with Commission approval, with such duties as he or she may lawfully prescribe.
A. 
The members of this Commission, after its effective date, at its first meeting, shall select from their number a Chair, a Secretary and such other officers as they shall deem necessary.
B. 
The Commission shall hold at least one regular meeting each month, which shall be open to the public, and it shall adopt rules of procedure for the conduct of all business within its jurisdiction. Such rules, procedures and conduct of business may be modified, changed or amended by a full quorum of the Commission in attendance at the meeting.
C. 
The Secretary shall take and keep, in a proper book, true and correct minutes of all meetings, shall notify members of the time and place of meetings and shall, in general, perform the duties incident to the office.
A. 
The Commission shall ascertain and evaluate recreation needs of town residents and shall be responsible for the making of policies which govern the regulation and use of all town parks and related facilities, with the approval of the Town Board.
B. 
The Commission shall develop and recommend to the Town Board plans for future recreation programs and facilities, with the approval of the Town Board.
C. 
The Commission shall make, submit and file a detailed annual report to and with the Town Board with respect to its activities during any calendar year, not later than three months after the conclusion of such calendar year. Such report shall include the following:
(1) 
A description of each program conducted by the Commission and how conducted.
(2) 
The approximate number of attendees and the persons served or participating in the program.
(3) 
The location of the activity.
(4) 
The expenditure of funds thereon, classified as to the source or sources thereof.
D. 
The Commission shall have the power to accept moneys by way of gift, devise or bequest from any source to be used for recreational or other purposes within the power and responsibility of the Commission. Any moneys or gifts so received by the Commission shall be turned over to the Town Supervisor and deposited by the Town Supervisor to the Commission's account.
E. 
The Commission shall have the power to use the services of volunteers, without compensation, in the conduct of recreational programs as the Commission may determine.
