This article is adopted pursuant to § 1660 of the
New York State Vehicle and Traffic Law and the New York State Municipal
Home Rule Law.
All terms used in this article shall be given their meanings
as defined in the New York State Vehicle and Traffic Law unless otherwise
defined herein.

No person shall park, stand, nor stop a motor vehicle at the following locations, except to the extent expressly authorized pursuant to Chapter 44, Assemblies, Public, or Chapter 95, Parades, Processions and Block Parties, of the Town Code:
A.
The Red Hook Recreation Park located at Linden Avenue, between the
hours of 10:00 p.m. and 6:00 a.m., except as may be permitted pursuant
to park regulations approved from time to time by resolution of the
Town Board.
B.
Rockefeller Lane, on either side, from its intersection with Mill
Road to a point 1,000 feet to the east of such intersection, Monday
through Friday, between the hours of 6:00 a.m. and 9:00 a.m. and between
the hours of 2:00 p.m. and 5:00 p.m.
C.
Metzger Road, on either side, from its intersection with US Route
9 (S. Broadway) to a point 230 feet to the east of such intersection,
at all times of every day of the week.
D.
Old Farm Road, on either side, from its intersection with US Route
9 (S. Broadway) to a point 330 feet to the west of such intersection,
at all times of every day of the week.
The parking of vehicles is hereby prohibited on all public roads
within the Town of Red Hook from 11:00 p.m. until 7:00 a.m. from November
15 until April 1 or at any other time when the presence on the public
road of such vehicle may interfere with, hinder or hamper snow-plowing
or snow-removal operations. Nothing in this article shall be construed
to prohibit compliance with the directions of a police officer or
law enforcement official nor to prohibit an emergency vehicle from
access in the course of an emergency.
A.
When any vehicle is parked or abandoned on the highways within the
Town during a snowstorm, flood, fire or other public emergency which
affects that portion of the highway upon which said vehicle is parked
or abandoned, said vehicle may be removed under the direction of a
law enforcement agent or under the direction of the Superintendent
of Highways or his/her designated deputy.
B.
When any vehicle is found unattended on any highway within the Town
where said vehicle constitutes an obstruction to traffic, said vehicle
may be removed by a law enforcement agent or under the direction of
the Superintendent of Highways or his/her designated deputy.
C.
When any vehicle is parked or abandoned on any highway within the
Town where stopping, standing or parking is prohibited, said vehicle
may be removed by a law enforcement agent or under the direction of
the Superintendent of Highways or his/her designated deputy.
A.
After removal of any vehicle as provided in this article, the law
enforcement agent or Highway Superintendent or his/her deputy may
cause such vehicle to be stored in a suitable place at the expense
of the owner.
B.
Such owner or person in charge of the vehicle may redeem the same
upon payment to the person with whom stored of the amount of all expenses
actually and necessarily incurred in effecting such removal.
C.
It shall be the duty of the law enforcement agent or the Highway
Superintendent or his/her designated deputy to ascertain, to the extent
possible, the owner of the vehicle or the person having the same in
charge and to notify him or her of the removal and deposition of such
vehicle and the amount which will be required to redeem same.
The provisions of this article shall apply on all roads in the
Town of Red Hook except for state highways and roads in the incorporated
Villages of Tivoli and Red Hook.

The intersections described in Schedule 131-A (131 Attachment
1), attached to and made a part of this Code, are hereby designated
as stop intersections. Stop signs shall be installed as provided therein
and in accordance with the provisions of the New York State Vehicle
and Traffic Law.

Pedestrian crosswalks shall be established on the streets or
parts of streets described in Schedule 131-B (131 Attachment 2), attached
to and made a part of this chapter.
A.
A violation of § 131-3 of this article is hereby declared to be a traffic infraction punishable by a fine of not more than $100.
B.
Every person convicted of a violation of § 131-4 shall, for a first conviction thereof, be punished by a fine of not more than $50; for a conviction of a second violation, both of which were committed within a period of 18 months, such person shall be punished by a fine of not more then $100 ; upon a conviction of a third or subsequent violation, all of which were committed within a period of 18 months, such person shall be punished by a fine of not more than $250 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.

A.
All trucks, commercial vehicles, tractors and tractor-trailer combinations having a total gross weight, as defined in Vehicle and Traffic Law § 117, in excess of 10,000 pounds are hereby permitted to travel and operate only on the highways enumerated and described in Subsection C below, hereinafter the truck route system. Such trucks and vehicles are hereby excluded from all other highways within the Town, outside of any village, pursuant to Vehicle and Traffic Law § 1660, Subdivision 10.
B.
Notwithstanding
the above exclusion, this section shall not be construed to prevent:
(1)
The
delivery or pickup of merchandise or other property along the highways
from which such trucks and vehicles are otherwise excluded, provided
that the route taken to effect such delivery or pickup is the most
direct route from the nearest truck route;
(2)
Vehicles
providing emergency services;
(3)
School
buses; or
(4)
The
use of these highways by such trucks and vehicles if the Town Superintendent
of Highways determines that the use is necessary to assist in the
maintenance, service and repair of highways, sidewalks, sewers and
other similar public improvements or the installation of such.
C.
The truck
route system established by this section shall consist of the following
highways within the Town of Red Hook:
(1)
The
entire length of U.S. 9;
(2)
The
entire length of N.Y. 9G;
(3)
The
entire length of N.Y. 199;
(4)
County
Road 56 (beginning at U.S. 9 and running east as Old Post Road North,
then Spring Lake Road and then Turkey Hill Road);
(5)
County
Road 78 (beginning at N.Y. 9G and running east/southeast as West Kerley
Corners Road and terminating at U.S. 9);
(6)
County
Road 78 (beginning at U.S. 9 and running east/northeast as East Kerley
Corners Road to the Dutchess-Columbia county line); and
(7)
County
Road 80 (beginning at N.Y. 9G and running east/southeast as Lasher
Road to the Dutchess-Columbia county line).
