No person, firm or corporation shall keep, maintain, house or possess within the Incorporated Village of Lindenhurst any pigeons unless the same shall be at all times securely enclosed within a building or loft in such manner as to prevent the running at large or flying about of such pigeons, except as hereinafter provided.
It shall not constitute a violation of § 67-17 for any person, firm or corporation to keep, maintain, house, possess or allow to fly for exercise fancy pigeons or pigeons, provided that such pigeons are kept so as not to constitute a nuisance or to create a hazard to public health. Such pigeons shall be deemed to be kept so as not to constitute a nuisance or to create a hazard, provided that there is compliance with the following conditions:
A. 
Fancy pigeons and racing pigeons are allowed out of the lofts or houses in which they are kept for exercise, for not longer than two hours in the forenoon of any day and for not longer than two hours after 12:00 noon of any day, except when returning home from a toss or race.
B. 
The lofts or houses in which such pigeons are kept must be cleaned regularly once each day or at least always maintained in a sanitary condition.
C. 
Pigeons refuse must be stored in metal containers with metal covers or in rodent-proof containers.

D. 
There shall be at least one square foot of floor space in any loft or house in which such pigeons are kept for each such pigeon department therein.
Nothing herein contained shall be deemed to authorize the keeping of any pigeons in violation of the terms of provisions of any other ordinance or regulation of the Incorporated Village of Lindenhurst.
The Building Inspector of the Incorporated Village of Lindenhurst shall be charged with the enforcement of this article and shall have the right to enter and inspect at any time any building, structure, yard, enclosure, loft, house or premises necessary for the enforcement of any of the provisions of this article.

Any person, firm or corporation violating any of the provisions of this article or failing to comply therewith or with any of the requirements thereof shall be liable to a fine of not less than $25 nor more than $500 for each and every offense. Each day such violation shall be permitted to exist shall be considered a separate offense.
