Any owners, occupants or tenants of any premises situate
on Main Street or Jobs Lane who shall desire or require deliveries
of merchandise or property along Main Street or Jobs Lane and who
shall claim that such premises cannot be served with the use of due
diligence or cannot be served without undue hardship prior to 9:00
a.m. or after 5:00 p.m. and without the parking of such trucks shall
apply to the Village Clerk for a permit therefor upon written application
forms supplied for that purpose, setting forth the facts and information
therein required, whereupon the Village Board shall, within 10 days
thereafter, hold a public hearing on said application without further
or other notice and shall grant or refuse such permit. If upon said
hearing the Board shall determine that sufficient access to said premises
exists so that loading and unloading of the type required by or for
said premises can be effected in conformance with the requirements
of this section by the use of due diligence without undue hardship,
or that the nature of deliveries is such that such merchandise and
property can be transported on foot or by other means from a nearby
point where parking is permitted or prior to 9:00 a.m. or after 5:00
p.m. without undue hardship, said Board may refuse to grant such permit.
