Said rules and regulations are hereby established as follows:
A. All persons, firms or corporations using the Borough parks and Borough
grounds in the Borough of Franklin Park shall clean up all debris,
extinguish all fires when such fires are permitted and shall maintain
and leave the premises in good order and the facilities in a neat
and sanitary condition.
B. It shall be unlawful for any person, firm or corporation using such
parks and public grounds and facilities to either perform or permit
to be performed any of the following acts:
(1) To willfully mark, deface, disfigure, injure, tamper with or displace
or remove any building, bridges, tables, benches; paving material;
waterline or other public utilities or parts or appurtenances thereof;
signs, notices or placards, whether temporary or permanent; monuments,
statues; posts or other boundary markers or other structures or equipment,
facilities or park property or appurtenances whatsoever, either real
or personal.
(2) To throw, discharge or otherwise place or cause to be placed in the
waters of any fountain, pond, lake, stream or other body of water
in or adjacent to any Borough park or any tributary, stream, storm
sewer or drainage flowing into such waters any substance, matter or
thing, liquid or solid, which will or may result in the pollution
of said waters, nor shall said waters be used for bathing.
(3) To bring in or dump, deposit or leave any bottles, broken glass,
ashes, paper, boxes, cans, dirt, rubbish, waste, garbage or refuse
or other trash. No such refuse or trash shall be placed in any waters
in or contiguous to any park or left anywhere on the grounds thereof
but shall be placed in the proper receptacle, where these are provided;
where receptacles are not so provided, all such rubbish or waste shall
be carried away from the park by the person responsible for its presence
and properly disposed of elsewhere. Receptacles are for park use only.
(4) To
expose themselves, excrete or urinate in any parks and recreations
areas, except in designated restroom facilities.
(5) To commit disorderly actions and/or acts disturbing the peace and
good order.
(6) To endanger the safety of any person by any conduct or act or to
commit any assault, battery or engage in fighting.
(7) To sell, use, possess or transport any illegal drugs or drug paraphernalia
or to possess or use alcoholic beverages in violation of the rules,
regulations and permits governing Borough recreation facilities.
(8) To operate motorcycles, motor scooters or bicycles, with or without
motors attached, is prohibited by notices posted thereon. The operation
of motorcycles, motor scooters or bicycles, with or without motors
attached, is permitted only in specifically designated areas. No person
shall wash, clean, polish or repair any vehicle or any other article
or item of personal property within the parks and recreation areas.
(9) To violate any rule for the use of a Borough park made or approved
by the Recreation Board and the Borough Council.
(10) To hunt for or take any game or wildlife or to discharge a firearm
or bow of any description into or upon any Borough grounds and facilities
and Borough parks in the Borough of Franklin Park, except where it
may be designated by posting that hunting is permitted. A person or
persons attempting to drive wildlife out of any Borough grounds and
facilities or Borough parks into a legal hunting area will be considered
hunting as defined in the rules and regulations of the Pennsylvania
Game Commission.

(11)
To use any parks or recreation areas of the Borough between
the hours of dusk and dawn without the proper permit or permission.
(12)
To be a part of an organized group using any parks or recreational
facility for any purpose without first obtaining the proper permit
from the Borough. Organized groups include, but are not limited to,
sports leagues, day-care facilities, parties, personal or group training,
or other activities deemed by the Borough of Franklin Park to be organized
and require a permit.

(13)
To use sound-amplification devices in violation of the Borough's
ordinances regulating unnecessary noises and sounds.
(14)
To park vehicles within any parks or recreation areas overnight
without securing the proper permission from the Borough.
(15) To
carry any kind of lighted pipe, cigar, cigarette or any other lighted
smoking equipment and any other use of tobacco products in any area
of the parks and public grounds and facilities prominently posted
with "No Smoking" or "Tobacco-Free Zone" signs or with the international
"No Smoking" symbol, which consists of a pictorial representation
of a burning cigarette in a circle with a bar across it. The carrying
of any kind of lighted pipe, cigar, cigarette or any other lighted
smoking equipment and any other use of tobacco products is permitted
in areas prominently posted with a "Smoking Permitted" sign.

(16) To
violate any permanent or temporary posting or notice installed by
the Borough Parks and Recreation Department concerning these rules
and regulations or any other limitations on the hours of operation,
use of the sports fields, or prohibited conduct within the parks and
recreation facilities.

(17) To
have pets in the parks without a physical leash. Pets are not permitted
on any athletic field, playground area, or as otherwise posted. Service
animals as defined by law are excluded from this rule. Owners shall
be responsible for cleaning up after their animals.

(18) To
sell or offer for sale any article or service for hire within the
limits of any park or set up therein any stand or booth for such purpose
unless duly authorized to do so by written permission from the Borough.

Any person, firm or corporation who shall violate
any provision of this chapter or who fails to comply therewith or
with any of the requirements thereof, upon conviction thereof in an
action brought before a Magisterial District Judge in the manner provided
for the enforcement of summary offenses under the Pennsylvania Rules
of Criminal Procedure, shall be sentenced to pay a fine of not less
than $100 nor more than $1,000, plus costs, including reasonable attorneys'
fees incurred by the Borough, and, in default of payment of said fine
and costs, to a term of imprisonment to the extent permitted by law
for the punishment of summary offenses. A separate offense shall arise
for each day or portion thereof in which a violation of this chapter
is found to exist and for each section of this chapter found to have
been violated. The Borough may also commence appropriate actions in
equity to prevent, restrain, correct, enjoin or abate violations of
this chapter. All fines and penalties collected for violations of
this chapter shall be paid to the Borough Treasurer. The initial determination
of ordinance violation is hereby delegated to the Borough Manager,
the Manager of Golf Course and Sports Fields, the Recreation Program
Director, the Police Department, the Code Official, the authorized
designee of the Borough Manager, and to any other officer or agent
that the Borough Manager or the Borough Council shall deem appropriate.
