An advisory council, to be known as the "Middletown Environmental
Advisory Council," is hereby created.

The Middletown Environmental Advisory Council shall be composed
of five residents of the Borough of Middletown.
Environmental Advisory Council members shall be appointed in
accordance with the following procedure:
A. All
Environmental Advisory Council members shall be appointed by the Middletown
Borough Council.
B. Environmental
Advisory Council members' terms of office shall expire on the first
Monday in January following the last year of their respective terms
of office.
C. Duly
appointed Environmental Advisory Council members shall serve terms
of three years, the terms being so staggered that two terms shall
expire each year, except that in one year of three, one term may expire.
The transition from seven members to five shall be effected so that
existing members shall complete their respective three-year terms
of office by not filling, as they arise, what would otherwise be the
first two vacancies, in effect ultimately replacing, in each third
year, the appointment of three members by the appointment of one member.

D. Whenever
possible, one member shall attend the Planning Commission, the Shade
Tree Commission and the Recreation and Parks Board meetings.
Environmental Advisory Council members shall receive no compensation
for their services, but may be reimbursed for expenses necessarily
incurred in the performance of their duties within the annual budget
for the Environmental Advisory Council, as set by the Borough Council.
The appointing authority shall designate the Chairman of the
Council.
The Middletown Environmental Advisory Council shall have the
following powers:
A. To
identify environmental problems.
B. To
recommend plans and programs to the appropriate agencies for the promotion
and conservation of the natural resources and for the protection and
improvement of the quality of the environment within the area of this
municipality.
C. To
develop alternatives as to the possible use of open land areas of
this municipality.
D. To
promote a community environmental program.
E. To
keep an inventory of all open areas, publicly or privately owned,
including but not limited to flood-prone areas, swamps and other unique
natural areas.
F. To
advise the appropriate local governmental agencies in the acquisition
of property, both real and personal.
G. To
undertake such environmental tasks as requested by the Middletown
Borough Council.
The Environmental Advisory Council shall keep records of its
meetings and activities and shall make an annual report which shall
be printed in the annual municipal report.
The Middletown Borough Council may require the submission of
an annual request for operating expenses, in a budget form, itemizing
each major category.
