The authority to operate, maintain, and manage the affairs of
the Middletown Public Library are hereby exclusively granted to and
vested in the Library Board.
The Library Board shall be composed of seven members, whose
terms shall be as follows: two members for terms of one year, two
members for terms of two years, and three members for terms of three
years. The Borough Council shall appoint all members to the Library
Board and fill all vacancies by a majority vote. Appointments made
under authority of this section shall be effective immediately upon
appointment, but shall date from January 1, 1965, for the purpose
of determining the date of expiration of their respective terms. All
appointments to fill the places of those whose terms expire shall
be for terms of three years. Vacancies shall be filled for the unexpired
terms. No member of the Board shall receive any compensation or salary
for his service as such.
The Library Board shall exercise the powers, duties, and obligations
granted by this chapter in accordance with the Library Code of 1961,
P.L. 324 (24 P.S. § 4101 et seq.), and regulations thereto. The Library Board shall have
the power to adopt bylaws for the conduct of its own business and
set policy for the Middletown Public Library not inconsistent with
the Library Code.
Effective January 1, 2013, the Borough of Middletown shall cease
to appropriate any monies for the operation, maintenance, and management
of the Middletown Public Library, which thereafter shall be funded
by donations; state funding, as may be available; funding from other
sources that may be available from time to time; and such contributions
as the Borough may make from time to time. All contributions and donations
for the operation of the library shall be made to the Library Board,
which shall establish an independent operating fund for the Middletown
Public Library. Such funds shall be spent for library purposes at
the direction of the Library Board and consistent with the Library
Code.
The Library Services Department and the office of Director of
Library Services are hereby eliminated, and Middletown Public Library
shall no longer be operated as an executive department of the Borough
of Middletown. The Middletown Public Library shall be operated independently
by the Library Board, and the Borough of Middletown shall not be responsible
for the operations or staffing of the Middletown Public Library or
for the actions of the Library Board.
All physical properties of the Borough that heretofore have
been essential to the operation of the Middletown Public Library and
that have not been put to other use shall be assigned to the Library
Board for library use.
