A. 
An application for a permit shall be required in accordance with the provisions of those applicable codes and ordinances which the Office of Code Enforcement has the responsibility to administer. Said application shall be submitted in such form as may be prescribed by the Code Enforcement Officer and shall be accompanied by any required fee. The responsibility for applying and obtaining a required permit in accordance with various ordinances rests solely with the person/persons doing the work.
B. 
Borough, township, county, state and federal governments, volunteer fire companies, churches and schools (public and private) are excluded from paying any fees as prescribed by this chapter. The above agencies are required to meet the zoning requirements of the municipality and must obtain building, plumbing and electrical permits before starting construction.

The Code Enforcement Officer shall examine said application to determine compliance with those other applicable codes and ordinances of the municipality and shall, within 30 days after filing, either approve or reject said application. If said application is rejected, the Code Enforcement Officer shall inform the applicant in writing, stating the reasons for such rejection.

The Borough Council shall establish fees and charges in a fee schedule adopted by resolution.

A. 
Business certificate.
(1) 
Any person or entity establishing a business location within the Borough of Middletown shall obtain a business certificate from the Borough for each location prior to the opening of the business.
(2) 
An application for a business location shall be made to the Borough and shall be accompanied by a fee ("application fee") as established by the Borough Manager. The application shall include:
(a) 
The name and address of the applicant.
(b) 
The name and address of the owners of the business.
(c) 
The trade name of the business.
(d) 
The address of the business.
(e) 
The nature of the business.
(f) 
Name, address and telephone number of two individuals to be contacted in case of emergency.
(g) 
Fire alarm and/or security system company name, address and phone number (if applicable).
(3) 
Provided that all applicable requirements are met, the business certificate shall be issued within 30 days after receipt of a completed application and application fee. The business certificate shall bear a certificate number, date and location of the business. The business certificate shall be prominently displayed at the business location.
(4) 
Any person or entity establishing a business location within the Borough of Middletown that fails to obtain a business certificate or conducts a type of business different from that identified in the application for business certificate shall violate this subsection.
(5) 
Any person or entity relocating an existing business within the Borough of Middletown shall obtain and file a business certificate application within five days of the date of relocation, in accordance with the provisions above. If such person or entity relocating an existing business within the Borough of Middletown fails to file a business certificate application, then such person or entity shall violate this subsection.
(6) 
Changes in the information provided in the application for business certificate shall, within 30 days of the date of change, be reported to the Borough.
(7) 
Within five days of notification of violation of this subsection, the person or entity notified shall obtain and file a business certificate application with the Borough. If the person or entity fails to file a business certificate application within the five-day period following notification by the Borough, such person or entity shall be fined $25 a month for every month that the person or entity fails to file a business certificate application with the Borough.
B. 
Other certificates. Any other permits, certificates or licenses, as required by the applicable codes and ordinances, shall be obtained by the applicant in accordance with the provisions of said applicable codes and ordinances. Application for such permits, certificates or licenses shall be made to the Code Enforcement Officer.
