A.
It shall be unlawful for any owner of any taxicab, limousine, livery or private livery van to operate or to permit or cause the operation of such vehicle upon the public streets and highways of the village, unless that owner shall have first obtained and shall have in force and effect an owner's license therefor, as hereinafter provided. It shall likewise be unlawful and shall constitute a separate offense under this chapter for any owner of any such regulated vehicle to direct, allow or cause the same to be operated upon the public streets and highways of the village by any driver not in possession of a valid and current driver's license issued by the village under and pursuant to the provisions of this chapter. For the purposes of this chapter, where and when the use or placement upon a motor vehicle of any registration plate, license medallion, roof light, business name or inscription, paint scheme or any other or similar device, sign or design identifies or is likely to identify that vehicle as a taxicab, livery, private livery van or limousine for hire, and the owner or driver of such vehicle shall stand or park such vehicle at or near any train station, bus stop, taxi stand, gasoline or service station, club, hotel, motel, restaurant, cabaret, parking lot, public street or highway or other public place within the village and shall either actively communicate the immediate availability for hire of such vehicle to or shall otherwise solicit such business from any member of the public, such conduct shall constitute an act of operating such vehicle upon the public streets and highways of the village.
B.
Every owner's license issued hereunder shall be issued as of the first day of January or subsequent date of issue and shall expire on the 31st day of December next succeeding its date of issuance, unless sooner canceled or revoked.
C.
Every person who desires to operate a vehicle regulated under this chapter and owned or controlled by such person, within the village, shall make written application to the Village Clerk, verified under oath, upon a form or forms prescribed and furnished by the Village Clerk, and requesting the issuance of an owner's license as required by this chapter. The owner shall provide and complete all information required on the application form or forms and shall submit any other relevant information, records or documents deemed necessary or advisable by the village in order for such owner to establish that the public convenience and necessity will be served by the issuance of such license.
D.
Upon the application for license, the owner shall itemize and identify the number of regulated vehicles to be operated by the owner, together with a description of each such vehicle, including its make, model, year of manufacture, motor and vehicle identification numbers, passenger seating capacity and New York State Department of Motor Vehicles registration number, and shall provide the street address and location of any and all terminals and depots proposed to be used by the owner in connection with its operations within the village.
