As a condition of the issuance of any owner's license required
by this chapter, every applicant for such license, and every holder of such
a license seeking a renewal thereof, shall submit with the application therefor
an itemized schedule of all rates of fare or other charges sought to be charged
for every passenger, including those for a shared ride, a group ride or an
exclusive ride. Once approved, such rates shall not exceed the maximum fares
and charges currently on file with the Village Clerk, unless and until any
requested amendment or other modification thereof has been submitted, in writing,
to the village and previously approved by resolution or order of the Board
of Trustees.

Pursuant to § 117-14C, the following rules, regulations and
requirements are set forth:
A. No person shall operate a taxicab or limousine/livery
to transport passengers to and from the Village of New Hyde Park without applying
for and receiving a permit. The Board of Trustees shall be the final determination
if the permit is issuable. Annual permit fees determined by the Village Board
must accompany the application to operate the taxicab or limousine/livery.
(1) (1) Vehicles used as taxicabs or limousine/livery must meet the following
standards:
(a) They will be kept free of body damage and mechanical
defects.
(b) A copy of proof of inspection by an authorized New York
State inspection facility must be submitted.
(c) Inspection of vehicles as directed or required by the
village with a copy of the current valid registration compliance, will include
and not be limited to checking operable headlights, obvious mechanical defects,
body damage and interior/exterior cleanliness.
(d) All vehicles from the same company shall be painted uniformly.
The name of the company and the telephone number shall be conspicuously painted
on the side of the cab with lettering that is not less than 12 inches high
and 20 inches in length.
(e) Vehicles shall at all times be equipped with two-way
radio receivers in operating and proper condition.
(f) Rate cards must be posted in the interior of the vehicle
in clear view of the passengers, utilizing type and characters no less than
one inch high.
(g) The rates to be charged shall only be those rates attached
on Schedule A annexed to this chapter and which rates have been previously
approved by the Village Board of Trustees. Any rate adjustment may be requested annually by written application.
The Board of Trustees shall render a decision relating to such rate increase.
(h) A current certificate of insurance from an approved and
duly licensed insurance company in the State of New York shall be required
to be furnished to the village prior to the issuance of the permit. Insurance
coverage must be no less than the minimum required by New York State for any
person who is injured in an accident and for property damage.
(i) No owner shall change his domicile or terminal within
the village without first obtaining approval from the Village Board.
(j) Every owner, upon the sale or other disposition of a
licensed taxicab or limousine, shall within 24 hours notify the Village Clerk
of such sale or other disposition and surrender the licenses and/or medallions.
(k) It shall be unlawful for any person to refuse the surrender
of a license and/or medallion to the Village Clerk, upon demand, after such
license has been suspended, revoked or expired.
(l) No trailer or semitrailer shall be attached or secured
to a taxicab or limousine.
(m) Taxicabs stickers.
[1] A village representative will affix all vehicle permits
to the taxicabs for which applications have been made.
[2] The sticker will be prepunched with an identifying sequence
unique to the vehicle to which it is affixed.
[3] It is unlawful to transfer stickers from one vehicle
to another.
[4] The vehicle will be checked as follows prior to sticker
installation:
[a] Vehicle description and VIN is same on application.
[b] Registration sticker matches license plate.
[e] Seat belts are provided for each occupant.
[g] There is no major physical damage.
(n) The Board of Trustees shall, from time to time, by resolution,
determine the maximum number of taxicabs that may be operated under licenses
issued.
(2) Drivers of the taxicabs will be expected to be neatly
dressed and polite and refrain from smoking while passengers are being transported.
(a) No driver shall stop to pick up any additional passengers
while proceeding to the destination of any passengers then occupying the taxicab
without the consent of all such passengers.
(b) No driver shall cruise in search of passengers.
(c) No driver shall permit more persons to be carried in
his taxicab than the number for which the vehicle was manufactured.
(d) Every driver licensed as such pursuant to this chapter
shall, within 48 hours, notify the Village Clerk of any change of his address
or loss of his New York State driver's license.
(e) No driver shall sound a horn or any such device, nor
in a loud or annoying tone of voice, nor by sign in any manner annoy, obstruct
the movement of or follow any person for the purposes of soliciting patronage.
(3) Taxicab licenses.
(a) Reasons for denial:
[1] Seven points or more in an eighteen-month period based
on the issue date of the summons.
[2] Any combination of two or more of the following offenses
committed within 24 months of the application:
[a] Passing of a stopped school bus.
[b] Passing downed railroad gates.
[c] Driving while intoxicated or impaired.
(b) The application form must indicate the drivers license
class.
(c) Both the form and receipt shall have the following statement:

"The receipt issued for payment of application fee is for the application
fee only and does not in any way represent or constitute a temporary license."

(4) Penalties.
(a) An offense against any provision of these rules and regulations
shall be a violation punishable by a fine of not more than $250 or imprisonment
for a period not exceeding 15 days for each such offense, or by both fine
and imprisonment.
(b) In addition to the penalties hereinabove provided, the license shall be liable to suspension or revocation by the village, for any offense against village Code, Chapter
177, Articles
I through
IV.
