For the purposes of this chapter, the following definitions shall be
applicable unless the context clearly indicates to the contrary:
PUBLIC PROPERTY
Includes any property which has been conveyed to the Mayor and Council
of the Town of Selbyville by a deed of record in the Office of the Recorder
of Deeds, in and for Sussex County, and any property held by the Mayor and
Council of the Town of Selbyville under a lease notwithstanding that such
lease is not of record in the Office of the Recorder of Deeds, in and for
Sussex County, and any property over which the Mayor and Council of the Town
of Selbyville exercises control by any agreement, oral or written.
SKATEBOARDS
A piece of wood or other material to which wheels are attached and
propelled by a human being.
STREETS
Any boulevard, road, avenue, highway, alleyway, sidewalk and any
other public thoroughfare, including the sidewalks adjacent to any such public
thoroughfare located within the corporate limits of the Town of Selbyville.
Any person, firm or corporation violating any of the provisions of this
chapter shall be issued a written warning for the first offense; for any subsequent
violations, upon conviction be subject to a fine of not less than $25 nor
more than $200 and costs, including Town Attorney fees and Victim's Compensation
Fund assessment, and imprisonment for a term of not less than 10 days nor
more than 30 days for the first such conviction. For a second or subsequent
conviction, any person, firm or corporation shall, upon conviction, be subject
to a fine of not less than $50 nor more than $500 and costs, including Town
Attorney fees and Victim's Compensation Fund assessment, and imprisonment
for a term of not less than 20 days nor more than 60 days for each such conviction.
Each day that a violation of any of the provisions of this chapter continues
shall be deemed and taken to be a separate and distinct violation.
